Response to Review of energy labelling requirements for solid fuel boilers

SER (French renewable energy trade association) would like to submit the following inputs : Data more representative of the market should be used for the revision. The Commission should not use data from BAFA, the German financial aid scheme, but use instead data from the Flamme Verte label. Flamme Verte has more demanding thresholds than ecodesign but they are less demanding so more representative than BAFA (see figures attached). Seasonal energy efficiency requirement should not inflate to stay compatible with the laws of thermodynamics used in biomass boilers in real life situation, and to not encourage the use of subterfuges to be able to meet these requirements. Biomass boiler tests must be carried out to the same standards in all laboratories in all EU countries. It would therefore be advisable to define a common way of managing artefacts arising during these tests (e.g. sagging of the wood log stack, leading to disruption of pollutant measurements) in order to prevent these from distorting the test results. Solid fuels boilers are incomparable with heat pumps, these different technologies has different technical requirements, different calculation methodologies, different functionalities and therefore they cant be compared together on the same label. Merging these two products in a single label will decrease the granularity of information and hamper the ability of consumers to make informed purchasing decisions. The comparison of solid fuel boilers and fossil fuel boilers would absolutely need to keep using the biomass label factor that take into account the contribution to greenhouse gases, in order to steer consumers' choice of fossil fuels towards renewables.

Response to Ecodesign requirements for solid fuel local space heaters (review)

SER (French renewable energy trade association) would like to submit the following inputs : Seasonal energy efficiency (ɳs) needs a new calculation method. In that, SER support the working document supplied by the Technical Committee 295 of the European Committee for Standardization (CEN) that take into account partial load output, and the renewable aspect of the wood. The current seasonal energy efficiency should not have a higher threshold. In the Flamme Verte label campaign of control measurements of 2022, an increase of 1% of ɳs already exclude 30% of the appliances. Nominal load emissions should be focused on PM and OGC. Because NOx mainly depend on the solid fuel quality, and CO was only an historical indicator of the good combustion and is not really useful anymore. The EN PME test method stay the best current methodology to measure PM emissions in laboratories. With this method the condensable part of PM is measured in the OGC emissions. Products has to be performant on both PM & OGC, a joint indicator of PM+OGC seems the best evolution for ecodesign. The Flamme Verte label propose for this joint indicator a threshold at 150 mg/m3 for wood logs and 70 mg/m3 for pellet, meaning a decrease of 10 mg/m3 compared to the current ecodesign. Partial load emissions seems to lack data. A threshold seems premature. If the DG ENER really want to fix a threshold, the few Flamme Verte data transfered to DG ENER show that the threshold should be 2 to 2,5 times higher than the current nominal threshold to be close on the current partial load performances. That means 100 mg/m3 for wood logs appliances and 50 mg/m3 for pellets appliances. Market surveillance should use more realistic tolerances based on studies from test laboratories such as the study made by CETIAT and 12 other laboratories in relation to the Flamme Verte label. Automatic combustion control would be an obligation of means not results and shouldnt be mandatory. These technologies developed by only few manufacturers have no European standards to measured their performances. Standardization work has yet to be launched on this subject. Such technology also exist at the flue outlet that is out of scope of this ecodesign regulation. Difficulties in the pellet market must be taken into consideration. Since the beginning of 2023, the pellet appliance market has seen very high drops in sales. This has resulted in the creation of a large stock of unsold appliances, which could take 3 to 4 years to be sold out. During this period, it wont be possible for manufacturer to invest heavily in research and development. It is imperative to consider these economic difficulties when reviewing the performance thresholds. The entry into force of the Regulation should not take place before 2028 to give companies time to make the technological changes needed to adapt to the new European requirements.

Response to Energy labelling requirements for air-to-air conditioners, air-to-air heat pumps and comfort fans [review]

The French renewable energy association (SER) is convince of the usefulness of the energy labelling to help consumers to choose less energy consuming products and to help therefore to reduce the energy consumption of the EU. For example since 2000, the SER create and manage the French wood burning label called “Flamme Verte”, which has a labelling showing a number of stars representing the energetic and environmental performances of the products. Since more than twenty years it has been useful to encourage manufacturers to improve their products not only on the energetic efficiency but also on the emissions parameters. However, SER is strongly opposed on this call for evidence to the option of merging local space heater and heat pump in the same energy labelling classes. Indeed, this change will not permit to reach the above objectives of the energy labelling regulation. As already exposed when the ecodesign and ecolabelling regulations have been made, different technologies has different calculation methodologies, and therefore they can’t be compared together. The local space heater and the air conditioner have different technical requirements, different functionalities, different heating capacity ranges. They don’t rely on the same energy vector (electricity in one way which could be renewable depending on the electricity production of the member state, or wood solid fuels who is 100% renewable, even if this can depend on the good forestry practices of the member states). Under these joint energy labelling classes, local space heaters will wrongly be considered less efficient than heat pumps, and there will be a technological wall that local space heater will not be able to cross. Therefore there will be less investments to reach better energetic efficiency of these products. On another side different classes, for heat pumps in one way and local space heaters in another way, adjusted to be incentive in their own technological improvements, will facilitate to reach the european objectives on energy consumption and renewable energy.

Response to Guidance on REDII forest biomass sustainability criteria

Le Syndicat des énergies renouvelables (SER) remercie la Commission européenne pour cette consultation et tient à soulever l'importance de ces orientations pour permettre une mise en œuvre harmonisée des nouveaux critères de durabilité pour la biomasse forestière par les États membres et les opérateurs économiques. Nous souhaitons avant tout rappeler le rôle majeur que joue et continuera à jouer le bois énergie dans la lutte contre le changement climatique et la transition énergétique de la France et de l’Union européenne, particulièrement dans le secteur de la chaleur, encore largement carboné. C’est une énergie locale, créatrice d’emplois, renforçant les investissements locaux, qui permet de réduire les émissions de CO2, la dépendance aux énergies fossiles, et qui porte 50% des objectifs français de développement de la chaleur renouvelable. Ce projet appelle de notre part plusieurs remarques générales, ainsi que des propositions de modifications répertoriées dans le document joint. La France s’est dotée d’un arsenal législatif et réglementaire important pour assurer une gestion durable des forêts. Il est primordial que cette directive permette aux Etats membres de capitaliser sur ce qui existe déjà, qui a fait ses preuves et garantit un niveau élevé de protection de l’environnement, et ne vienne faire peser une charge administrative et financière lourde et supplémentaire sur des opérateurs économiques souvent de petite taille. Le SER note que certaines dispositions du projet de règlement d’exécution dépassent son objectif qui est de clarifier l’interprétation qui doit être faite par les Etats membres, de façon harmonisée, des critères existants de durabilité applicables à la biomasse forestière. Ce projet de texte ne doit pas aller au-delà de la directive RED II en imposant des dispositions supplémentaires ou même en anticipant les discussions en cours concernant sa révision. Le SER rappelle également que la gestion forestière n’est pas guidée par la production de bois-énergie mais par la production de bois d’œuvre, qui ne fait pas partie du champ d’application de la directive RED II. Le bois-énergie est un sous-produit de l’exploitation forestière. En conséquence, il est important que ce projet de règlement d’exécution ne se réfère qu’aux impacts potentiels engendrés directement par la production de bois-énergie. Enfin, nous demandons à la Commission européenne de bien vouloir laisser le temps nécessaire aux États membres et aux schémas volontaires pour prendre en compte les orientations définies par ce projet de règlement d’exécution (qui sont arrivées tardivement), et par la suite de laisser le temps aux opérateurs économiques de se mettre en conformité.
