Response to Delegated act framing the programming of the Neighbourhood, Development and International Cooperation Instrument (NDICI)

The ONE Campaign welcomes the opportunity to provide feedback on the NDICI financial programming laid out in the attached draft Commission delegated regulation. ONE is a global movement, co-founded by Bono, campaigning to end extreme poverty and preventable disease by 2030, so that everyone, everywhere can lead a life of dignity and opportunity. We recommend that the thematic targets in the draft delegated regulation reflect the targets in the provisional agreement on the NDICI. These include targets for gender, climate, and human development. To this end, the new, proposed target in Article 3(b), “at least 45 % for inclusive and sustainable growth for human development,” should be revised, ensuring a standalone target for at least 20% of the envelope to contribute to actions that support human development and social inclusion objectives. This is in line with both the European Consensus on Development, and the provisional agreement on the NDICI. COVID-19 is expected to push as many as 150 million people into extreme poverty this year alone. It is essential that the EU ambitiously invests in human development to not only reduce widening inequalities, but also to build a strong foundation to build back better after the pandemic. Throughout the COVID-19 crisis, over 1.6 billion children were pushed out of school, exacerbating an existing global learning crisis. ONE’s analysis shows that from the beginning of the pandemic to 2030, a shocking 763 million people – or 1 in 11 worldwide – could have failed to acquire basic literacy skills at age 10, which has massive implications for the rest of their lives. Failing to address this crisis puts the futures of an entire generation in jeopardy, meaning we risk losing doctors, scientists and leaders who will help tackle future global health crises. Equally important is investing in health systems strengthening and global health security, which COVID-19 has shown underpins everything in our lives, from trade to education and economic development. Investing in revitalising and recovering health systems will not only ensure partner countries are equipped to end this pandemic, it will help ensure everyone is properly equipped to prevent the next one. With such enormous challenges ahead, clear and specific targets will help ensure EU aid reaches the people and sectors most in need. Based on the Annex to the draft delegated regulation, specific actions listed under sections pertaining to “inclusive and sustainable growth,” include private sector development and improving sustainable infrastructure. While these are no doubt vital areas of engagement, they also require significant financing, and combining these sectors with the human development target risks failing to meet the amount needed for education, health, and social protection. The Commission delegated regulation should therefore clarify the thematic targets in Article 3 to include a unique target for human development. As the delegated regulation covers three geographic sub-regions that receive nearly 37% of the total NDICI envelope, this target will help ensure that spending for the entire NDICI meets the horizontal 20% target for human development. Response to EU Company law upgraded Package:digital solutions and providing efficient rules for cross border operations of companies

The ONE Campaign’s comment on the Proposal for a Directive amending Directive 2017/1132 as regards digital tools and processes Executive summary: We welcome the opportunity to comment on the Proposal for increasing access to critical company information to all stakeholders, particularly those for whom the existing system fails to work, including SMEs, employees, civil society, investors and law enforcement. ONE is a campaigning and advocacy organisation of more than nine million people around the world taking action to end extreme poverty and preventable disease, particularly in Africa. We have offices on three continents, including in Belgium, France, Germany, and the United Kingdom. The proposal for the Directive extends the scope of access to information about companies, and correctly identifies many of the issues, particularly the barriers to access and use of data. However, we live in a world where people and companies get their information where, when and how they want it (via apps, via Software As A Service and Data As A Service platforms, and via deep integration with other datasets). To deliver the outcomes of the directive, it is essential that the company information identified by the proposal is not just free of charge, but published under an open licence that allows reuse, and as structured data that can easily be combined with other datasets. By making this information available as open data – an approach recognized by both the European Commission and the G7 as maximizing the utility of the data – the underlying goals of the directive can be achieved both quickly, easily, and for almost zero cost. Without open data we do not believe that the underlying goals will be achieved. As the Open Definition describes, open data “means anyone can freely access, use, modify, and share for any purpose (subject, at most, to requirements that preserve provenance and openness)”. Our recommendations for the proposal are therefore as follows: 1. Company information must be made available as structured data, free of charge, under an open reuse licence. 2. The core data points made available should, at a minimum, be those that allow companies, employees and other stakeholders to understand who they’re doing business with, and the risks involved in doing so, and therefore should include the directors, shareholders, and crucially, beneficial owners. 3. The Commission should work with wider stakeholders to understand how further information made available as open data could further reduce the barriers to cross border business, increasing trust and transparency, and creating a hostile environment for bad actors. These overall recommendations are described more fully, with reference to the proposed directive, in the attachment. We would be happy to engage further with the Commission on this subject.
