Response to Review of ecodesign requirements for lighting products

The Walt Disney Company, together with its subsidiaries, is a diversified worldwide entertainment company with operations in multiple business segments including Studio Entertainment. This response to the public consultation focuses on our Studio Entertainment business segment. This segment includes both our Disney Theatrical business comprising of theatrical stage shows such as ‘The Lion King’ and ‘Aladdin’, and also the extensive motion picture feature and television production actively implemented by Walt Disney Studios under its various studio brands, including Walt Disney Pictures, Marvel Studios, Lucasfilm and The Disney Channel. All of our production work, be it stage, film or television, makes extensive use of specialist entertainment lighting equipment. We strongly support the European Commission’s objective to reduce the energy consumption of lighting. As a Company we are already taking steps to adopt new high-efficiency luminaries where they match or exceed the functionality and performance of traditional entertainment luminaries. The final viewing experience of an audiovisual or stage production can be significantly influenced by lighting design. Consequently, access to suitable lighting products is of paramount importance for our productions. We are grateful that the Commission has previously recognized these specific technical needs, granting an exemption for “studio lighting, show effect lighting, theatre lighting” in Regulation 1194/2012 and we commend the efforts made to this aim also in the context of the current revision. We notably welcome the inclusion of a number of essential entertainment lighting products in the exemptions list annexed to the Draft Regulation. However, we note with concern that this equates only to a partial exemption of business critical lighting products; as a consequence, we would be left with products that are significantly less functional than those currently in use, meaning that the Draft Regulation would fail to meet the criteria for implementing measures set out by Article 15(5) of the 2009 Ecodesign Directive. We caution that if implemented as currently written a damaging effect on stage, film and television production across Europe will ensue from the Draft Regulation. We respectfully urge the European Commission to analyze further and take into account the suggestions which have already been developed by a wide industry coalition across different sectors which will be deeply impacted by the Draft Regulation as it currently stands. In particular, this Joint Position document (attached hereto) identifies four key concerns for our Studio Entertainment business segment as requiring urgent attention: • Standby power requirements for film, TV and theatrical lights; • White light sources for specific needs of the film, TV and entertainment sectors; • Colour-tuneable light and the definition of Green; • Additional lamp bases for exemption when used in professional entertainment lighting products A fuller examination of all these issues can be found in the Joint Position document. We stand by the Commission’s goals of greater sustainability and energy efficiency. Our ambition is to improve the efficiency and reduce the power use of the production lighting systems on our shows and in our film and television productions, without reducing the artistic quality of the lighting. However, to allow us to do this, suitable equipment has to be available. We therefore ask the Commission to please consider our above comments, all of which reflect our ongoing concerns to ensure that entertainment lighting equipment that is both energy efficient and also able to meet our current production requirements remains generally available after September 2021.
