Response to Intellectual Property Action Plan

Sky plc (“Sky”) thanks the European Commission (“Commission”) for the opportunity to provide feedback on the Roadmap on “Intellectual property (IP) action plan” (“Roadmap”). With 24 million customers across seven countries, Sky is Europe’s leading media and entertainment company. Our 32,000 employees help connect our customers to the very best entertainment, sports, news, arts and to our local, original content. Following the success of Sky originals like Chernobyl, we plan to double our current €8 billion investment in original content by 2024. We are also developing a new TV and movie studio. Sky supports the intension of the Commission to further improve the management and protection of IP rights, as well as its broader aim of moving towards a greener and more digital European economy. As part of an IPR-intensive industry*, Sky welcomes the perspective of an IP action plan aimed at upgrading, further harmonising and reinforcing the effectiveness of IP, its smarter use and safeguarding. Fight IP theft - online piracy and the Digital Services Act: A strong IPR framework, and copyright specifically, is crucial to ensure we can continue to offer the best quality of content, services and technology for the benefit of our customers and the overall European economy. Yet, our sector remains one of the most impacted when it comes to copyright infringements. The Roadmap rightly points out to the fact that piracy still constitutes a real problem. Indeed, the unauthorised distribution of our feed and content leads to loss of revenue which cannot be reinvested in high quality creative and cultural content. While we do agree with the need to continue monitoring the application of the IPR Enforcement Directive, and to ensure the swift implementation of the Copyright Directive, we also believe that further regulatory actions should be taken alongside a strengthened enforcement of antipiracy rules. The upcoming Digital Services Act (DSA) is an opportunity to create a proportionate system of online accountability that will enable Internet companies to continue to grow in a socially responsible and economically sustainable way. To achieve this goal, the DSA should not only focus on “stepping up the fight against counterfeiting” as the Roadmap proposes, but also against piracy. It should create a proportionate accountability regime with objective and measurable standards of prevention and removal of harmful and illegal content. A system of regular reporting obligations, overseen and sanctioned by a competent authority is of utmost importance. Promote better licensing of standard-essential patents: The Roadmap reads that ‘the licensing of standard-essential patents (SEPs) remains a risky and costly exercise for patent holders and implementers’. In our opinion, transparency and timely declarations should be encouraged to create greater predictability and avoid the potential for “hold-up” and “royalty stacking”. In addition to that, FRAND valuation should ensure that valid, infringer and enforceable SEPs should be valued on their own merits. And finally, traditional patent law and burdens of proof should be applied to test the merits of the licensor’s SEPs and royalty demands, just as they are for all patents. *According to a 2019 study developed by the European Patent Office (EPO) and the European Union Intellectual Property Office (EUIPO), industries that make intensive use of intellectual property rights (IPRs) generate 45% of economic activity in the European Union and employ up to one in three people in the EU - https://www.epo.org/service-support/publications.html?pubid=201#tab3

Dear Commission The broadcasting and consumer electronics industries have worked productively with the Commission on regulatory efforts in the consumer electronics sector that have contributed to phasing out inefficient legacy products such as plasma and cathode ray tube televisions through strict energy laws. We welcome the opportunity to work with the Commission on new measures to tackle non-energy eco-design advances and are pleased to see that manufacturers are already phasing out hazardous substances such as mercury. We are concerned though that the new draft regulations for televisions are focusing on new technologies that are central to the future of broadcasting. Customers are migrating to UHD through developments such as OLED or TrueQD but measures proposed by the Commission on further restrictive energy requirements would have the effect of preventing our customers being able to replace their existing televisions with new models having the same picture quality that they are already enjoying. The proposed regulations would effectively halt the sale of all new premium televisions. We strongly urge the Commission to consult and deliberate very carefully over the implementation of these restrictions and consider extending the time frame to allow industry to make the scientific advancements needed to meet the challenges posed by the proposals.

Response to Fairness in platform-to-business relations

Sky welcomes the European Commission’s approach to fairness in platform to business relations. This is an important and fundamental issue to the modern European digital economy and deserves scrutiny. Online service and businesses cannot avoid interacting with online platforms who are very often gatekeepers to European consumers online. Sky has an interest in this policy position for a number of reasons, including that our services and apps are available via online platforms and that our content (or content describing how to access our content illegally) is often made available illegally via online platforms and the removal or monetisation of this content requires interacting with online platforms on a commercial level. On fairness in online platform to business relations, comprehensive rules as part of a regulatory framework are just as important as ex post competition law in securing good outcomes for European businesses and consumers. Online platforms have substantial power in dictating business practices and the terms under which goods and services are made available. With this power must come consummate responsibility, accountability and transparency (with rigorous scrutiny rather than voluntary commitments). We support the European Commission adopting a legislative approach (option 3). Businesses need long term assurance that online platforms and their decisions in Europe will be properly scrutinised with effective redress mechanisms capable of tackling problems before they become existential threats to European businesses. We also note that the proposals should be wider than focusing on only small and medium businesses. Large European players such as broadcasters also lack the influence and scale to negotiate effectively with global technology companies to avoid harmful or arbitrary business practices. We look forward to engaging further on these proposals.
