Response to Child sexual abuse online: detection, removal and reporting

Verizon Media, and our parent company Verizon, operate robust digital safety programs designed to detect and remove child sexual abuse material (CSAM) from our services. We praise and value the engagement of the European Commission in the fight against CSAM and in the ongoing effort to provide legal clarity to companies involved in this crucial effort. We also encourage the European Commission to preserve the foundational legal principles on which this work relies (such as limitations to liability) and ensure consistency with the broader legislative framework and with EU proposals currently being discussed, such as the Digital Services Act. Regarding the three policy options highlighted in the Inception Impact Assessment, we strongly urge the European Commission to ensure any future legislative frameworks do not undermine current successful, well-established efforts that are delivering strong results and protecting children globally today. It is therefore imperative for the European Commission to create synergies with - and not obstacles to - programs run by existing organizations, including the National Center for Missing and Exploiting Children’s (NCMEC) CyberTipline. NCMEC is the recipient of millions of CyberTip reports each year from communications service providers and NCMEC partners with law enforcement authorities around the world, including those in Europe, to share reports which authorities need to identify child sexual abuse victims, protect children from imminent threats to their safety, and prosecute offenders located in their jurisdictions. A clear obstacle to such pivotal organisations and programs, and indeed the fight against CSAM, would be to impose a duplication of reporting obligations on companies that are already undertaking voluntary efforts to identify CSAM on platforms that then generate CyberTip reports submitted to NCMEC. Establishing new obligations on providers under EU law could create conflicting legal requirements for providers with existing legal frameworks in other jurisdictions. Verizon Media will be actively contributing to the European Commission’s upcoming public consultations on this topic in order to help reinforce the critical efforts to protect child safety worldwide.

Verizon Media welcomes the opportunity to provide initial feedback to the European Commission on the Inception Impact Assessment (IAA) and Roadmap on ‘deepening the Internal Market and clarifying responsibilities for digital services’. Verizon Media is a media and tech company that represents the best of the internet, creating high quality news and other original content and partnering with trustworthy news providers. With brands like Yahoo, HuffPost, TechCrunch, RYOT, MAKERS, Aol, as well as Yahoo Mail and Yahoo Search, Verizon Media is dedicated to helping people stay connected, informed and entertained. Verizon Media is also a challenger to the digital advertising market leaders. Through our own operations, and in partnership with others, we help drive diversity and choice in consumer services and brand advertising. Our approach to the debate on the Digital Services Act is shaped by the diverse nature of our services and our strong engagement on human rights. Our Business & Human Rights Program, launched in 2008 at Yahoo, is an industry best practice. We support the European Commission’s goal to develop responses to identifiable harms for which there is an established evidence base. Policy interventions should then be adequate and proportionate in their form, using a mix of co-regulation and legislative intervention. They should provide legal certainty to incentivise investments in the European digital single market. We would counsel against policies with overbroad scope which would encompass a wider range of intermediary activities than is supported by the evidence. Foundational principles of the online ecosystem, which ensure innovation in the European internal market and protect fundamental rights, should be safeguarded. Ultimately, the Digital Services Act should provide a coherent legal framework for content moderation in the European Union, embracing a diverse and complex online ecosystem and clarifying the roles of all the key actors involved in the online chain on the basis of clear scope, definitions, obligations and safeguards.
