ALLRAIL the Alliance of Rail New Entrants represents independent, non-incumbent passenger rail undertakings across Europe. Our members are predominantly privately owned companies competing both in commercial markets under the Open Access (OA) framework and in competitively tendered Public Service Obligation (PSO) markets. Together, they drive innovation, efficiency and modal shift in European mobility, fully aligned with the objective of creating a genuine Single European Railway Area (SERA). ALLRAIL advocates for fair competition, transparency and a level playing field in the European rail sector. We work to ensure that EU legislation and State aid rules promote sustainable growth and meaningful market opening, rather than reinforcing the structural advantages of state-owned incumbents. We therefore welcome the targeted revision of the Commission Guidelines on State Aid for Rescuing and Restructuring Non-Financial Undertakings in Difficulty (the R&R Guidelines). This reform comes at a crucial moment for the rail sector, where structural discipline and fair competitive conditions are essential to delivering an efficient, customer-focused and financially sustainable railway market. Response to Technical specification for interoperability relating to the telematics subsystem of the rail system

ALLRAIL, the Alliance of Passenger Rail New Entrants, is a non-profit association representing independent passenger rail companies (e.g. rail operators, ticket vendors, and rolling stock lessors) in Europe. ALLRAIL advocates for faster market opening in passenger rail in order to accelerate modal shift to rail and achieve the ambitious climate change reduction goals of the EU Green Deal in the transport sector. The European Union aims to cut transport emissions by 90% by 2050, focusing on promoting multimodal travel and collective mobility. This approach encourages passengers to use multiple public transport modes together, with rail transport as backbone. ALLRAILs objective is to ensure that such choice will entail an easy, convenient ticketing & travel experience. Enshrining these as rights in EU legislation provides passengers with a guarantee of service quality, thereby boosting rails competitiveness vis-à-vis less sustainable alternatives. This is the only way to attract more and new passengers to one of the most eco-friendly collective transport modes. ALLRAIL strongly supports the European Commissions Implementing Regulation on a technical specification relating to the telematics subsystem of the rail system in the EU for interoperability of data sharing in rail transport and repealing Regulations (EU) No 454/2011 and (EU) No 1305/2014. This regulation is critical for ensuring fair competition, transparency, and full passenger access to all rail options. It is essential that this regulation is adopted without weakening modifications and that National Access Points (NAPs) and NeTEx/SIRI are fully mandated for ticketing and journey planning data sharing.

ALLRAIL urges fair liability rules for multimodal passenger journeys

Topic — The EU is reviewing rules to strengthen passenger rights during multimodal journeys.
Message — Liability for delays should fall on the operator causing the disruption. Ticket sellers should not be penalized for operational issues they do not control. Mandatory warnings about limited rights must be removed to encourage rail travel.123
Why — Independent rail vendors would avoid paying for delays caused by large operators.4
Impact — Dominant carriers would be held financially accountable for every delay they cause.5

We would first like to thank the European Commission for the opportunity to give feedback to this proposal. We value the European Commission's efforts to engage with stakeholders in shaping effective policy. ALLRAIL, the Alliance of Passenger Rail New Entrants, is a non-profit association representing independent passenger rail companies (e.g. rail operators, ticket vendors, and rolling stock lessors) in Europe. ALLRAIL advocates for faster market opening in passenger rail in order to accelerate modal shift to rail and achieve the ambitious climate change reduction goals of the EU Green Deal in the transport sector. ALLRAIL welcomes the EU Commissions Proposal for a Regulation on the Use of Railway Capacity in the Single European Railway Area (SERA). This proposal comes at a timely juncture to amend and complement Directive 2012/34/EU in order to take into account major developments that have occurred in European rail transport since the adoption of the aforementioned Directive. Response to Revision of the specifications for EU-wide Multimodal Travel Information Services (Delegated Regulation 2017/1926)

ALLRAIL, the Alliance representing independent passenger rail companies, welcomes the EU Commission's proposal to revise Delegated Regulation (EU) 2017/1926. We believe that ensuring that passengers have access to comprehensive travel and traffic information through travel information services (TIS) is capital for them to increase their trust towards multimodal journeys.Therefore, ALLRAIL notes with satisfaction the extension of the scope of the Delegated Regulation to cover dynamic traffic and travel data and information. However, the EU Commission should ensure that smaller transport companies receive appropriate support to implement the new requirements arising from the revised Delegated Regulation.
