Response to Delegated Act on the provision applying as from January 2026 of the amended Fisheries Control Regulation

We thank the European Commission for the opportunity to contribute to this consultation and share the concerns of the Spanish fisheries and seafood processing sector. Below we present comments directly relevant to the delegated act, as well as requests for the Commission to provide guidance and support to Member States for effective and proportionate implementation. Points directly linked to the delegated act 1. Clarification on shall be available wording We request that the Commission issue clear guidance confirming that the requirement for information to be available to the next operator includes the option for operators to make data accessible without necessarily transmitting it electronically in real time. Such guidance should also define acceptable formats and procedures to ensure uniform interpretation by all Member States. 2. Traceability requirements for mixed lots The obligation to transmit all data listed in Article 58.5 of Regulation (EU) 2842/2023 for mixed lots creates excessive and impractical information flows, particularly when a new lot comprises numerous small lots from artisanal fisheries. We propose a simplified approach, consistent with UNE Guide 195004 and Spanish national practice, requiring only: New lot number Details of the operator who performed the mixing New quantity in kg Consumer information required under Regulation (EU) 1379/2013 All other traceability data would still be retained by the operator and made available to the competent authority upon request. Points where Commission guidance/support to Member States is essential Inspection planning Encourage Member States to publish traceability inspection plans for 2026 early, and to consider maintaining current inspection rates for processing companies (around 3%) during the initial adaptation phase. Digitalization of fish auctions Support Member States in ensuring that all first-sale points can provide data in digital format, with possible EMFAF co-financing. Training and outreach Recommend that Member States strengthen training and information campaigns on national traceability systems (e.g. CATCH IT), tailored to SMEs. SME adaptation support Encourage the use of EMFAF funding to help SMEs meet the new requirements, covering both digitalization and data storage costs. This approach would ensure that the delegated act is workable in practice, while promoting consistent and proportionate implementation across all Member States.

Desde ANFACO-CECOPESCA apoyamos esta modificación, que consolida un marco legal que avala la congelación de túnidos en salmuera a -18°C para consumo humano. Apelamos, asimismo, a una buena coordinación internacional, con el fin de asegurar que los terceros países implanten adecuadamente la validación de sus buques a -18°C, contando con la máxima cooperación de la Comisión Europea. Del mismo modo, consideramos fundamental que se proporcione formación suficiente a los Estados miembros, de manera que los inspectores puedan interpretar con la necesaria proporcionalidad las gráficas de temperatura y los nuevos procedimientos de aplicación, favoreciendo así una implementación comprensiva y homogénea de estas disposiciones.

Response to Methods of analysis for official controls as laid down in Commission Regulation No 2073/2005

Artículo 1.2, frase 1: Para parámetros microbiológicos se establece claramente en la norma EN-ISO 16140-2 los requisitos de validación para métodos alternativos microbiológicos, sin embargo en el caso de la histamina hay muchos métodos alternativos pero la ausencia de referencia a la norma específica de validación que deben cumplir propicia que cualquier método alternativo aceptado por la autoridad competente pueda ser empleado y el único método validado y reconocido internacionalmente se recoge en la norma EN ISO 19343:2017. Por este motivo consideramos que para el análisis de histamina, como se marca para otros métodos de control oficial químicos (Reglamento (CE) nº 333/2007 , Reglamento de Ejecución (UE) nº 2021/808 ), al ser un método químico es necesario marcar los requisitos mínimos de funcionamiento que deben cumplir los demás métodos alternativos y que no es suficiente indicar al uso de otros protocolos científicos aceptados internacionalmente para validar distintos tipos de métodos analíticos alternativos.

La Asociación Nacional de Fabricantes de Conservas de Pescados y Mariscos Centro Técnico de Conservación de Productos Pesqueros (ANFACO-CECOPESCA), desea presentar los siguientes comentarios sobre el proyecto de reglamento propuesto por la Comisión Europea para modificar el Reglamento (CE) nº 2073/2005 sobre criterios microbiológicos para los productos alimenticios, así Respecto a Listeria monocytogenes. Reconociendo la necesidad de superar el vacío legal en la aplicación de los criterios durante toda la vida útil, hay muchos aspectos a considerar para una implementación eficiente la propuesta, como es, de manera especial, las medidas de prevención en la fuente a través de las mejores técnicas disponibles y la comunicación eficiente entre operadores. Asimismo, se precisa una clarificación técnica coordinada por DG-SANTE con los estados miembros para aclarar los protocolos y requisitos para que los operadores de empresas alimentarias (FBOs) de tal mane a que los procedimientos para justificar ante las autoridades competentes la aplicación del criterio <100 ufc /g durante la vida útil sean homogéneos en toda la UE.

The National Association of Canned Fish and Seafood Processors – National Technical Centre for Fish Products Processing (ANFACO - CECOPESCA), is a representative association joining more than 250 business organizations, mainly fisheries and aquaculture companies. Our activities as a private body date from 1904. On Friday 2nd February 2018, we have been informed that DG MARE launched the “Evaluation of the marketing standards framework for fishery and aquaculture products”: According to the Evaluation roadmap “The consultation aims to obtain information from stakeholders and general public on the effects of marketing standards and their contribution to ensuring a fair and sustainable market for fishery and aquaculture products. In particular, questions will address the relevance of these standards in comparison to other private or international requirements, their applicability and the benefits / burdens that derive from their existence. The main stakeholders are operators (and associations) involved in the supply chain, as well as control authorities in the Member States and the Market Advisory Council. The general public may also wish to share their views” . According to this, from ANFACO-CECOPESCA we want to give our opinion. Common marketing Standards, in particular tuna-bonito and sardine and sardine-type preserves, are a useful tool to establish a minimum and adequate criterion for marketing fisheries products such as tuna and sardines, whose supply chain is worldwide. These standards do not imply the application of stricter requirements than those established in B2B relationships and they are of full use for the proper and harmonized functioning of the common market, ensuring a fair and sustainable market for these products. The existing standards and trade descriptions for preserved tuna and bonitos and sardines and sardine-type products were developed with the participation of EU stakeholders to ensure their adaptation to the real needs of the EU market and the EU processing industry. The regulations applicable to the commercialization of preserved tuna-bonito and sardines and sardines-type products are aligned with the corresponding CODEX standards which have been recently updated and have been applied without any problem. Therefore, ANFACO asks that: - Council Regulation (EEC) No 1536/92 of 9 June 1992 laying down common marketing standards for preserved tuna and bonito remains unchanged, as there is no reason to undertake revision. - Council Regulation (EEC) No 2136/89 of 21 June 1989 laying down common marketing standards for preserved sardines and trade descriptions for sardine-type products remains unchanged, as there is no reason to undertake its revision. Additional comment When referring to Council Regulation (EEC) No 1536/92 and Council Regulation (EEC) No 2136/89, ANFACO-CECOPESCA does not agree with the statement appearing the European Commission’s roadmap, when it is claimed that “during the evaluation of the regulation and the impact assessment leading to its revision in 2011 it was highlighted that marketing standards were too rigid and outdated and that more flexible standards should be laid down to achieve the objectives of the Common Market Regulation and to take account of innovation in the supply chain for fishery and aquaculture products.”. For the EU Industry of preserved tuna and preserved sardines and sardine-type products, Council Regulation (EEC) No 1536/92 and Council Regulation (EEC) No 2136/89 respectively are useful and necessary to ensure level playing field and harmonized minimum quality standards. Moreover, they do not prevent from innovation in these categories.
