Response to Net Zero Industry Act

The Boeing Company supports the European Unions plan to enhance Europes net-zero industry competitiveness. The Company welcomes the European Commissions Green Industrial Plan and, in particular, the Net-Zero Industry Act (NZIA). It is clear that the ambitious measures set out in the proposed NZIA to reach the EUs 2030 target to reduce net greenhouse gas emissions, as well as the 2050 climate neutrality target - are a clear example of the EUs willingness to lead the green industrial revolution. We are united with our customers and with governments around the globe in committing to bold climate change ambitions, and supporting the commitment of civil aviation to achieve net zero carbon emissions by 2050. Ambitious climate goals and targets need a comprehensive and credible strategy; ambitious sustainability objectives need a variety of solutions, including the acceleration of fleet renewal, operational efficiency, renewable energy (e.g. sustainable aviation fuels) and advanced technology. Boeing supports the overall objective and measures set out in the NZIA, however, we urge policy-makers to consider sustainable aviation fuels (SAFs) as strategic net-zero technologies, and ensure SAF fully benefits from the priority status given to strategic projects within the NZIA. At Boeing, we believe in a SAF and, not a SAF or solution to meet our shared net zero goal. Massive amounts of SAF will be needed regardless of any scenario for the introduction of future advanced aircraft products or new energy carriers. As part of our SAF and approach, we continue to advance the safety and viability of other renewable energy sources and their use on aircraft. We are committed to deliver 100% SAF capable commercial airplanes by 2030 and are fostering partnerships focused on scaling the availability and use of SAF globally. SAF is a drop-in replacement - works with existing airplanes, yet can lower life cycle carbon emissions by more than 70% compared to conventional jet fuel, and is in regular use today and offers the largest potential to reduce carbon emissions over the next 20 to 30 years, regardless of aircraft type. We recognizes that the future of flight will require the simultaneous pursuit of multiple pathways to achieve net zero carbon emissions. Countries around the globe (e.g. US, Japan, the UK or Canada) are heavily investing and putting in place measures to support innovation and strengthening their production capabilities. In order to maintain the level playing field and fair competition for investments to help move towards net zero, it is of utmost importance that the EU, through the NZIA, recognises the key and strategic role of renewable fuels technologies. Policy is a key instrument for incentivizing the production of SAF. It can provide a clear path to commercialization and unlocking investments in SAF supply chains. Therefore, it is key that SAF fully benefits from the NZIA framework, to ensure the scale-up of SAF across Europe. To date, the maximum potential SAF production capacity in the EU is estimated at around 0.24 million tonnes, which means only 10% of the amount of SAF required to meet the proposed mandate by 2030, according to data provided by the European Aviation Safety Agency (EASA). The report recognizes the significant positive impact SAF uptake can have on the overall emissions of Europes aviation sector and its contribution to achieving the EUs 2030 climate objectives. Drop-in SAF will play a key part in decarbonising the aviation sector as it can be used within the existing global fleet and fuel supply infrastructure. Partnerships are imperative given the need to scale up SAF production by millions of litres in the next decade, and Boeing has key partnerships with several European SAF producers. In conclusion, it is crucial that policy-makers include SAF as a strategic net-zero technology and ensure Europes place at of the development and promotion of a more sustainable aviation sector.

Boeing welcomes the Proposal for a regulation of the European Parliament and of the Council on ensuring a level playing field for sustainable air transport. We appreciate the opportunity to comment on this legislative proposal that advances key sustainable aerospace objectives in Europe. Boeing has been a part of the European aerospace community for more than 80 years. In Europe, Boeing directly employs more than 5,800 talented people and Boeing’s commercial, defence and services programmes support nearly 190,000 highly skilled jobs. We continue to strengthen our presence in Europe by investing in research and development and by contributing to EU long-term goals on environmental sustainability. Policy is critical to accelerate the commercialization of environmentally progressive technology. Boeing appreciates the steps the European Commission is taking to advance the commercialization of sustainable aviation fuels (SAF) by implementing a blending mandate. We encourage the European Commission to also take this opportunity to also support more investment in the SAF industry and complement the proposed mandate with incentives and a book and claim system across Europe. We also encourage the EU to further tailor the proposed legislation to the needs of the aerospace sector so as to level the playing field with other transport modes. SAF is the most direct way to make substantial reductions in net carbon emissions from aviation today. It is already in regular use and offers the largest potential to reduce carbon emissions across all aviation segments. Despite the emission reduction potential, the uptake and commercialization of SAF is in the early stages, and investment is lacking. The EU can overcome these challenges by complementing the blending mandate with effective policies to close the price gap between conventional and sustainable fuel – in the form of market-based mechanisms, incentives, Important Projects of Common European Interest, contracts for the difference or industrial alliances. We recommend that the European Commission works closely with the EU Member States to develop financial incentives at regional and/or at local levels for the development, deployment and distribution of SAF. Given the specific challenges aviation faces to decarbonise and its unique dependency on liquid fuel, prioritising feedstock for SAF and restoring the level playing field between aviation and other transport modes is essential. For over a decade, EU policies have made production of biodiesel and ethanol ground fuels more profitable, and therefore more attractive, than SAF. Overcoming these challenges is fundamental to achieve sustainable aerospace in this decade. Lastly, we believe that the current proposal does not address the fact that few airports across Europe provide SAF regularly and have supplies on site, and, as a consequence, airlines may not be able to uplift SAF on all routes covered under the proposed regulation. We recommend that the European Commission works closely with airlines, airports, and fuel producers to implement a book and claim system to address this issue by keeping an efficient supply chain and avoiding environmental externalities related to the transportation of SAF at the relevant airports. Emission reductions are a global industry challenge, and we encourage the European Commission to continue advancing ambitious policies at regional level while collaborating through international and global platforms to prevent competitive distortion. Given the limited investments in SAF as of today, and the clear signal the proposed blending mandate will provide to the industry, we are convinced that these recommendations can support more investment in the SAF industry and effectively complement the framework set through the Fit for 55 package. We look forward to working closely with the European Commission, the European Parliament and Members of the Council to ensure we scale up SAF in Europe.

The Boeing company appreciates the opportunity to provide feedback on the proposed amendment to Regulation (EU) 2015/640 and its related annex. We strongly support the Commission’s intent to address the unforeseen issues arising from Covid-19, which has resulted in certain aeroplanes which were foreseen to have a certificate of airworthiness issued before 18 February 2021 now being issued with that certificate after that date. Boeing has been a part of the European aerospace community for more than 80 years, with 5,500 talented employees across Europe, contributing to and benefiting from the region’s tradition of innovation and excellence. Boeing’s advanced defence and security systems are in service with 23 European armed Forces. Our long-term industrial partnerships allow us to harness mutually-beneficial cooperation with European partners. The T-7A Red Hawk with SAAB (Sweden) and MH-139 Grey Wolf with Leonardo (Italy) are two recent examples of such reinforcing transatlantic partnering. We hope to continue leveraging strategic partnership across Europe for years to come, delivering the best of industry to Government and global customers. Transatlantic security cooperation in a post-COVID environment: The COVID pandemic has struck the world, our societies and businesses in an unprecedented manner. The crisis is a strategic shock which, like previous ones, is leaving governments, businesses and citizens with great uncertainty as to what the future really holds. The pandemic has made the world more unpredictable, security challenges more acute and cross-border, and transatlantic cooperation even more indispensable. Equally important are deconflicted, convergent EU and NATO priorities, as both are mutually reinforcing. Collective security is not a zero sum game. As Josep Borrell, High Representative of the Union for Foreign Affairs and Security Policy, Vice- President of the European Commission, said during the ‘EU Defense Washington Forum’: As legitimate as the EU’s ambition to emancipate itself as a security provider is, NATO remains the cornerstone of collective defense and security. In order to preserve a strategic and competitive edge in a post-COVID environment, Industry and Governments from both sides of the Atlantic should further: • Advance regulatory alignment. The cost of divergence between the EU and its transatlantic partners will be much higher in the emerging, altered global balance of power, in particular when it comes to regulating new emerging technologies and containing industrial and technological ambitions from less like-minded actors. Rapid progress in revolutionary fields such as artificial intelligence pose both threats and opportunities, making it imperative that partners set common standards and forget an appropriate pathway forward; • Nurture dialogue and exchange information, in particular, when assessing the threat environment and devising response. In this respect, Boeing would welcome the set-up of EU-US Security Dialogue as proposed by the European External Action Service; • Leverage the inherent of value of transatlantic cooperation. EU-US defense and security cooperation is second to none to deliver best-value and best-of-industry to Governments. Sustained security spending should remain a priority of the transatlantic community to accelerate the recovery and address the ever-evolving threat environment. As reinvigorated regional actors are already seeking to assert new levels of influence and the global security environment is deteriorating, regulatory alignment and industrial cooperation should remain the key tenets of a reenergized transatlantic security cooperation in the new normal.
