Response to SESAR Common Project 1: Concluding the pilot phase of the SESAR deployment framework

Ryanair welcomes the work done by DG Move to update the Pilot Common Projects (PCP) implementing regulation (EU No 716/2014) and appreciates the opportunity to comment on the draft implementing regulation on the establishment of the Common Project One (CP1). Technology must be one of the key elements to modernise European ATM and therefore, we consider CP1 essential to achieve this goal. However, we are concerned that the review of the common projects comes at a moment when the aviation industry is suffering the deepest crisis of its history. Airspace Users’ financial resources will be widely limited in the coming years and this will impact our ability to deliver and implement some of the changes required. In this sense, please find attached our comments regarding the draft implementing regulation on the establishment of the CP1. Response to Exceptional measures RP3

Ryanair is deeply concerned that the exceptional measures proposed in the draft legal text fail to address the root problem and will lead to a slower recovery of the European traffic. The shortfall in ATC revenues is entirely due to the actions of the Member States in closing borders and imposing travel restrictions. Consequently, these same Member States must be responsible for covering the full cost of the ATC revenues. The risk-sharing mechanism provided for under Regulation (EU) 2019/317 is designed only to respond to minor traffic changes and is inadequate in dealing with major shock to the system, such as the Covid pandemic which has caused passenger numbers to collapse by 99%. We therefore welcome DG Move’s attempt to amend this Regulation. However, DG Move has not taken on board the feedback provided by the airspace users. This feedback highlighted that DG Move, in coordination with the Member States, must agree a plan to support the aviation industry using all available mechanisms, including National and EU funds. The draft legal text only cites Article 29 (6) of current Implementing Regulation (EU) 2019/317 without providing any additional tool or provision for Member States to support the aviation industry. The regulation must encourage and allow use of the funding sources agreed during the past weeks such us the €750bn European Recovery Funds, or other National sources like the non-discriminatory State aid schemes. DG Move must elaborate on this further. Moreover, we are very concerned that the proposal is highly dependent on the cost containment measures to be delivered by ANSPs, who have barely communicated their plans and/or the expected impact. This information will not be available at least until November according to the draft legal text proposed and even at that stage, their forecasts may not be accurate yet. DG Move and Member States cannot therefore approve these “exceptional measures” as planned in September, as the information required to do a proper risk assessment will be unavailable, and therefore it will be impossible to properly evaluating the impact on future ATC charges. Under DG Move’s current plan, airspace users would be responsible for covering a revenue gap estimated to be over €3bn at a time when our revenues have collapsed (Ryanair has just reported a quarterly loss of €185m, while legacy airlines have been granted over €30bn in State aid). In addition to this, we are faced with the essential task of rebuilding network traffic which has been decimated by Covid-19. DG Move’s current plan is therefore clearly unsustainable and must be amended in line with airspace users’ proposals. The draft legal text shall include a provision to mandate the use of the surplus of over €2bn generated by ANSPs in RP2. This surplus was generated on top of their regulated profits while underspending on planned cost and could help to offset the revenue shortfall discussed. It is essential that DG Move also elaborates on how the cost-containment measures undertaken by ANSPs will be passed on airspace users, in particular how the different State sponsored staff cost support schemes or other similar Government support schemes used by the ANSPs will be used to mitigate this catastrophic situation. We are also astonished to see no reference regarding the assessment done by the EC and the PRB of RP3 performance plans dated March 2020 and the different annual reports related to RP2. These clearly state that the ANSPs’ costs are not aligned with the European objectives and that the ATC actual cost is well below the unjustifiable determined costs claimed by the ANSPs. This is not acceptable. We continue to call on DG Move to reconsider its proposal, and instead to work with Governments to inject liquidity into the system, covering the entire ATC revenue shortfall. This will support the rebuilding of the European aviation industry and benefit European consumers and the wider European economy.
