Response to Revision of the Standardisation Regulation

In its call for evidence, the Commission highlights the need to accelerate the development of harmonised standards and to improve overall planning processes. As an industry that relies heavily on harmonised standards, we would like to flag the need to ensure coherent standardisation and regulatory compliance timelines for manufacturers. In many cases, the application dates set in product-specific legislation do not match the (longer) timelines of the standardisation process, leading to situations where industry cannot use the missing harmonised standards and must go through third party certification and notified bodies instead. This creates compliance bottlenecks and may lead to market removals in sectors with large portfolios and low volumes, such as industrial test and measurement equipment. It would be highly beneficial if the revised Standardisation Regulation could include provisions to avoid such situations, for example by stating that compliance obligations in product-specific legislation should apply as from 12 months after the publication of harmonised standards to the OJEU, or alternatively manufacturers should be allowed to self-assess their products. Manufacturers should not be forced to go through third-party certification because of delays in the adoption process of harmonised standards. Measures should also be taken to increase the number of notified bodies and to avoid certification bottlenecks.
