Response to Evaluation of Standardisation Regulation (EU) No 1025/2012

ETSI RESPONSE TO THE CALL FOR EVIDENCE FOR AN EVALUATION / FITNESS CHECK OF REGULATION 1025/2012 ETSI welcomes the publication of the call for evidence for the evaluation of Regulation 1025/2012 on European Standardisation and the opportunity to provide feedback. The quickly changing technological and economic environment of the past decade makes the EUs ambition to be the leading player in world-wide standard setting all the more important and challenging. ETSI therefore welcomes the Commissions stated objectives of evaluating whether the current Regulation enables the EU to promptly respond to standardization and legislative needs through an inclusive, transparent, participatory and non-discriminatory standards-development process. ETSI is ready to bring in experience from the governance reform carried out over recent months, which included a number of changes required by Regulation 2022/2480, as well as key reform measures to further improve inclusiveness, transparency and broad participation, while operating on the basis of European values as the backbone for successful European and global standards development. ETSI further welcomes the envisaged consultation activities as stated in the call for evidence, and fully supports the Commission and its better regulation guidelines to enable diligent fact-based policy making. ETSI supports the outlined scope and purpose of the evaluation. We are wondering whether it may be of benefit to consider the following two proposals which we submit for kind consideration: Education and skills: The EU Standardisation Strategy addresses "the need for education and skills" in the standardisation area (chapter IV). This topic could be added to the bullet item Integrity and included into the assessment. International and global impact: The EU Standardisation Strategy also stressed the objective of a global leadership role of Europe in standardisation. We would therefore like to suggest having a separate fourth bullet item dedicated to this topic and, inter alia, looking into processes, partnerships, etc. and at ways to promote the global and international impact of European standardisation and standardisation driven out of the EU. ETSI would also like to express support for addressing the topic of Financing. While it is suggested to make the assessment based on a cost/benefit analysis, ETSI would like to propose that a broader perspective might be taken looking also at the European standardisation system, its different ways of working and of financing, the need to fund specific projects as well as part of the operation of the system. ETSI very much thanks the European Commission for being recognised as a key partner for the evaluation. ETSI would like to offer its support to the European Commission when it comes to the execution of the evaluation. ETSI is ready to leverage its broad membership, extensive relations with other organisations, strength both at European and international level and in-depth expertise. for supporting a successful evaluation process. ETSI very much looks forward to participating in the consultation activities and to sharing our experience of and expertise in producing relevant and market-leading standards that promote European innovation and competitiveness.

Response to Cyber Resilience Act

ETSI welcomes the call for evidence for an impact assessment related to a potential Cyber Resilience Act. Developing standards that enable a sustainable and securely connected society has been at the heart of ETSI work for more than 30 years both as a broadly inclusive global international standards body, and in its European Standardization Organization role. In recent years, that role has included working closely with EU bodies, and developing an array of standards and reports supporting EU cyber policies and legislation. ETSI recognizes as extremely important the need to address the security and privacy aspects of the systems with which people interact, or depend upon. Interconnected digital devices, services, and systems have become a part of our everyday lives, as individuals, businesses, and administrations. With our growing dependence on networked digital systems comes an increase in the variety and scale of threats and cyber-attacks. The challenge today and in the coming years is to protect a world where everything is connected and baseline security by design for devices and services has become critical.

Response to Amendment to the Regulation (EU) No 1025/2012 European standardisation

ETSI welcomes the opportunity to provide feedback to the draft Regulation amending Regulation 1025/2012 that was submitted together with the EU Standardisation Strategy on 2 February 2022. ETSI strongly supports the high-level objectives of strengthening the role of and support for standardisation at political level; of recognising the key role of standardisation for a resilient, digital and green EU single market and for strategic autonomy and digital sovereignty; of setting focus on EU interests in European standardisation; and of strengthening the EU’s role in international and global standardisation and the collaboration and dialogue globally. A functional European standardisation system is of major importance for ETSI as are effectiveness and timeliness for providing high-quality standardisation support of the internal market and EU competitiveness. Since its inception in 1988 ETSI has managed well to put emphasis in serving EU regulatory needs with providing European standards on the one hand and serving European and global market needs with highly relevant and widely adopted global standards made in Europe on the other hand In addition, ETSI has a leading role as the European partner in the global partnership projects 3GPP and oneM2M. ETSI values the privilege of being one of the three European Standardisation Organisations (ESOs) recognised by the EU under Regulation 1025/2012 and thus being a key partner of the European Commission in the public private partnership of European standardisation. ETSI’s members rely on this privilege as it enables a vast range of standards that are needed by the market to be accepted within Europe and beyond. The legal proposal put forward by the EC has implications on ETSI’s processes. Over the last weeks ETSI put strong focus and significant investment into analysing the legal proposal, its impact and possible options for the implementation. In particular, ETSI wishes to promote a framework that enables timely and efficient development and availability of European standards while recognising the political considerations and needs as outlined by the European Commission.

ETSI welcomes the latest draft of the Delegated Act (DA) which takes into account a number of the issues raised by the ESO(s) and via the Radio Experts group. Therefore, ETSI believes that the new version is an improvement on the previous and ETSI thanks EC for taking into account ETSI’s previous feedback. ETSI welcomes the on-going opportunities to further refine the DA in an area which has considerable importance for raising the bar for Cyber Security across Europe. However, ETSI has noted a number of areas where ETSI believes further improvement or clarifications are required within the draft DA. (full text enclosed)

Response to Standardisation Strategy

ETSI welcomes the European Commission's initiative for a European standardisation strategy and the opportunity to provide comments on the corresponding roadmap recently published by the European Commission. ETSI very much appreciates the regular close dialogue with the European Commission on the European standardisation system and the European standardisation strategy. This input on the roadmap builds on previous submissions from ETSI, in particular: - the detailed outline submitted in August 2020 on how the ETSI Strategy (https://www.etsi.org/about/our-strategy) and the strategic initiatives from the European Commission inform and feed into each other; - a number of contributions submitted to the EU Multi-Stakeholder Platform for ICT Standardisation (MSP). - the Bildt Report "Calling the Shots" (https://www.etsi.org/images/files/Calling-The-Shots-Standardization-For-The-Digital-Era.pdf) which had been facilitated by ETSI and the report of the Task Force Bildt Report (TFBR - https://www.etsi.org/images/files/ETSI-Report-of-the-Task-Force.pdf) developing a roadmap of actions for the operationalisation of the Bildt Report. Several actions in there are related to the European standardisation strategy but also on specific issues like data or education about standardisation. (full text enclosed)

Response to Requirements for Artificial Intelligence

ETSI welcomes the draft Regulation on AI presented by the European Commission (EC) at https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX:52021PC0206. The draft Regulation builds on the processes of the New Legislative Framework (NLF) putting harmonised European Standards into the focus of demonstrating compliance with the regulatory requirements. This is in line with the view of ETSI that "The NLF should be used for technical regulation in new areas including AI and data." Response to Evaluation of the 'New Legislative Framework' for EU legislation on industrial products

DRAFT CEN CENELEC- ETSI input to the Roadmap for the evaluation of the NLF CEN, CENELEC and ETSI in their capacity as ESOs welcome the opportunity to provide their feedback on the Roadmap for an "Evaluation of certain aspects of the New Legislative Framework" and are looking forward to actively participate in the evaluation process, including the public consultation scheduled for Q1 2021. The NLF since its inception has enabled the production of standards in support of legislation in a swift, efficient and open manner in a variety of domains; this has made standardization a critical resource in building the internal market. Relying on voluntary and consensus-based standards that ensure compliance of products with Union legislation and provide a clear separation between legislation, standards, and conformity assessment avoids the creation of a unnecessary new practices, which would cause confusion in the market place thereby following the principle of proportionality.
