Response to Fitness Check of EU airports legislation

Airport Charges Directive: the ACD is an efficient form of EU legislation, the proof being that it did not require a revision during COVID-19 crisis. It has produced a stable regulatory framework since its implementation, enabling Groupe ADP to successfully deliver an investment of over 460 M per year on the regulated scope since 2011, on behalf of passengers, airlines and other stakeholders. The ACD has provided best-in class airport facilities and quality of service, whilst ensuring airport charges for airlines operating from Parisian airports remain competitive. Sustainable development, connectivity, quality of service and efficient facilities are the challenges the European airport industry will be facing in the years to come: whilst facilitating a competitive environment, the ACD provides a flexible framework that enables regulatory stability. The current regulatory framework is the optimal form of regulation to protect the longer-term needs of the travelling public. Slots: on top of ACI position and propositions, which Groupe ADP shares, we stress that the slot regulation is no longer fit for purpose, since it lacks transparency and results in significant waste of airport capacity. Thus, Groupe ADP urges the European Commission to be bold in its forthcoming proposal since it will be an essential part in the safeguard of competition within the aviation market, and shall ensure consumer interest. In addition to ACI Europe's positions: Groupe ADP would like to see a new definition of slot, ensuring airlines have a greater obligation to use it ; Groupe ADP strongly recommends the allocation of slots to projects where carriers can justify a valid AOC ; Groupe ADP militate in favor of the establishment of a minimum threshold of available slots to automatically trigger a slot pool allocation process. Regarding the New entrant rule: in addition to changes aimed at eliminating the abuse of dominant positions by airline groups at congested airports, Groupe ADP advocates a further rebalancing of the 50/50 rule in favor of new entrants (e. g 60/40), the elimination of the priority given to intra-EU and domestic flights, the definition of local slot allocation rules favoring a diversification of air connectivity as well as taking into account the environmental and quality-of-life aspects of local communities and the increase to 4 years the minimum duration of the projects selected under the new entrant status. Groupe ADP pleads in favor of secondary criterions of allocation which could be established, locally and transparently, with the coordinator. Regarding the wastage of airport capacity and connectivity through schedule fragmentation: Groupe ADP strongly supports the increase of the minimum number of series length slots beyond 5 weeks. Regarding the clamping down on misuse and non-use of slots: Groupe ADP recommends to carry out a study assessing the relevance and feasibility conditions of a slot reservation system. However, we are opposed to any establishment of a secondary trade market for slots for Parisian airports. Ground handling: Groupe ADP emphasizes the position previously taken by ACI Europe on the subject. Airports should increase their remit to define and enforce minimum service level / standards. To reach this goal, the EU should clearly empower airports to implement biding requirements towards ground handlers, thus creating both legal certainty and legitimacy. Ground Handling suppliers should become accountable for their operational & safety performance towards airport operators: Groupe ADP calls upon the EU and Member States to involve airport operators in the oversight of GHSPs, including when taking enforcement measures. The scope of common infrastructure should be expanded; GH operations must become aligned with the decarbonization of airports and the GH market should become socially sustainable.
