Response to Clarifying the provisions for the data communication between aircraft and traffic controllers.

Air France would support the proposed amendment of regulation 29/2009 (DLS IR), with the following comments or proposals: (1) (b) Article 3 paragraph 3 Current date for first-CofA exemption criteria has been set up considering aircraft flight hours with age. It has been agreed that oldest aircraft, after 25 years, fly less and only make a minor DLS contribution in overall airspace. So First CofA before 1995 has been chosen, with regards to the full datalink availability, expected, when decision has been made, for 2020. Today, full datalink is not provided all over Europe, and is not expected to be provided before at least 2022. Moreover, some questions are still open on ground architecture, VDLM2 capacity, network performance, that may delay this date again. It would therefore make sense to align First-CofA exemption criteria to this current status. We would thus propose to reasonably move First CoA exemption date to 1st January 1997, in order to avoid disproportionate investments on some few aircraft, for very few and short contribution to full european datalink (3) (b) Article 14: - We would suggest to add a notion of “on-board datalink platform” in addition to "aircraft type/model" consideration. Indeed, for large fleets like A320 family, datalink architecture may be very different from an aircraft to another, within the same type/model. On A320, FANS ATN capability has been designed on ATSU hardware basis, but not on “old MU” basis. Although it is technically possible to upgrade a “MU A320” to an ATN & BIC configuration, implementation costs are not comparable with an “ATSU A320” upgrade. For some configurations, STC or approved modification may not even be available. Our proposal would then be to rephrase amendment to: “aircraft types/models/onboard datalink platform combinations for which re-engineering costs required would be disproportionate due to old design” In that case, reporting date (Article 14 paragraph 1) should be redefined. Proposal to be made through RMT 0524 process, before end 2019
