Response to Extension of the review programme of existing biocidal active substances

Kemira appreciates the opportunity to provide an opinion with reference to the initiative of extension the review period beyond 31 December 2024. The aim of the BPR is to have safe biocidal products on EU market - ensuring a high level of protection of both human and animal health and the environment, therefore BPR was received with interest by industry. It was expected to simplify and streamline the processes, to ensure a level playing field through the Article 95 list and a high level of harmonisation for biocidal product (BP) authorisation via the mutual recognition or Union authorisation processes. In 10 year we learned that the impact of the BPR on the biocide business is a complex mix of technical, commercial and regulatory challenges. In the above context we support the proposed six-year extension Review Programme even is longer than the three to five years originally suggested. We agree with the assumption that the delay has occurred despite of constant efforts Competent Authorities and Applicants and a new deadline is more realistic and will bring the programme to completion. At the same time we would like to express the concern to the lack of amendment to Article 95(5) of the BPR regarding end of data protection for existing substances. In our opinion this action must be joined by a parallel action by the Commission to remove or amend Article 95(5) BPR to remove hard-stop for data protection in order to prevent serious commercial inequity and a significant risk to public health. This parallel action would simply correct an oversight which occurred when the review program was extended in the past (from 2014 to 2024) but data protection period was not adjusted accordingly (from 2025 to 2036). The intended 10 year data protection is clear from Article 60. We believe this is an unintentional oversight and we opt for a solution in the form of adopting a further delegated act without a need to revise the whole content of BPR. Kemira has made huge investments to fulfil the regulatory compliance imposed by BPR and in our opinion these kind of issues on data protection create market distortion between businesses and again introduce uncertainty in the regulatory process removing incentives to invest in biocides.
