De innovaties die in Nederland worden ontwikkeld dragen niet alleen bij aan de ontwikkelingen van de Nederlandse sector, maar worden ook wereldwijd gedeeld en ingezet. Member States should be allowed to report how "good condition" and reference areas are interpreted nationally. They also request reporting on agro-economic and regional socio-economic impacts.123
Why — National flexibility could allow for less stringent habitat assessments and lower compliance burdens.4
Impact — Environmental groups lose transparency if specific habitat size reporting requirements are deleted.5

Feed back by the Dutch federation of farmers and growers LTO NEDERLAND (in Dutch) LTO NEDERLAND ondersteunt het EU-programma voor promotie van land- en tuinbouwproducten in en buiten de Europese Unie. Hiermee wordt de veiligheid, kwaliteit en duurzaamheid van Europese land- en tuinbouwproducten onder de aandacht van consumenten gebracht, evenals het belang van de Europese land- en tuinbouw voor de leefbaarheid van het platteland. Een sterke plattelandseconomie is nodig om ook in tijden van crises te zorgen voor voedselzekerheid en maatschappelijke stabiliteit. Het EU-programma heeft als doel om de concurrentiekracht van de land- en tuinbouw te vergroten. Dat doel mag niet worden vergeten. Van belang is dat er niet wordt gediscrimineerd tussen verschillende producten en productiewijzen. Alle duurzame voedingsmiddelen en sierteeltproducten moeten in aanmerking kunnen komen voor EU-ondersteuning. De EU-standaarden voor veiligheid en duurzaamheid liggen reeds op een hoog niveau. Het moet niet zo zijn dat de Europese Commissie ideologische keuzes gaat maken voor de consument. Bovendien kunnen producten duurzaam geproduceerd zijn, terwijl de wijzen van bewaren en bereiding niet altijd duurzaam zijn. Georganiseerde boeren en tuinders moeten rechtstreeks voorstellen voor promotie kunnen indienen bij de Europese Commissie. Zij zijn immers het gezicht van de productie van voedsel en groen. Hun activiteiten zijn bepalend voor de kwaliteit van de producten.

Response to Sustainable use of pesticides – revision of the EU rules

The Dutch Organisation for Agriculture and Horticulture (LTO Nederland) represents over 35.000 agricultural entrepreneurs and employers. The Dutch agricultural and horticultural sector is very diverse, with agricultural entrepreneurs active in a wide range of subsectors. The majority of these farmers is represented by LTO. LTO Nederland welcomes the Commission’s initiative regarding the revision of the sustainable use of pesticides directive. However, there are some key issues we consider challenging. Therefore, in the document enclosed, information is provided on the ambition of the Dutch agricultural and horticultural sector and on the possibilites how to improve the Sustainable Use Directive. Obviously, LTO Nederland remains at the European Commission's disposal for any clarification and/or further discussion.

Response to Update of measures to control Xylella fastidiosa

Dutch farmers' and growers' organisation LTO NEDERLAND likes to thank the European Commission for the opportunity to give feedback to the draft implementing Regulation Plant Health – measures to control the bacterial pest Xylella fastidiosa (update). We have a comment concerning article 4 (establishment of demarcated areas): The estimated climatic suitability for Xylella fastiodiosa in the Northern part of Europe including The Netherlands is very low. (source: https://efsa.onlinelibrary.wiley.com/doi/epdf/10.2903/sp.efsa.2019.EN-1667) We question the necessity to establish a demarcated area in these areas to prevent the spread of the disease, when a Xylella infection has been found and confirmed. Elimination of the diseased plants and specified plants in a radius of 50 meter, combined with strict vector control measures, monitoring and a sampling and testing programme should be sufficient to prevent spread of the disease. In The Netherlands, where nurseries with nursery stock and garden plants are often concentrated in specific area’s the establishment of demarcated areas, would negatively affect multiple nurseries and workers at these nurseries and cause considerable economic losses. This would lead to severe disruption in communities affecting the lifes of many people.

Response to Statistics on Agricultural Input and Output

- We need data that meet requirements of our operators. For example: usage of crop protection products needs to be registered in kg active ingredient. But for biological crop protection products, e.g. natural enemies, this needs to be measured differently. But it is important to also measure these sustainable alternatives to provide a full picture. In the Netherlands this is done already, but we believe it is not at European level. - The use of crop protection products should not be measured in weight, but in environmental impact. This is also important if goals are included in the Farm to Fork strategy. - Climatic conditions, seasonality, soil types and farm production types differ enormously across the EU. And so does the level of pressures. So it is important to take this into account when gathering and comparing data between MSs and regions in a coherent way. - The registration of active ingredients may change and fall under a different category (e.g. biological control). This needs to be taken into account when collecting data for statistics. - Sometimes crop protection products are registered for a short period only. This should also be taken into account to allow for a fair comparison between MSs - In relation to the CAP it is important that data collection serves a broad perspective (a broad view). E.g. biodiversity indicators in relation to land scape features and margins. - When data are collected, privacy and data ownership are important. It should always be clear why data are collected, who owns them and how privacy of farmers and growers will be protected. Data provided by a farmers or grower are owned by him/her. We refer to the Code of Conduct on agricultural data sharing, developed in co-operation with COPA-COGECA and which should be applied here. In the Netherlands, JOINDATA is an private initiative that should be contacted by the statistical office. - Privacy is especially important in a relatively small MSs like the Netherlands: some products like specific vegetables are produced by only a small number of growers. So when collecting data, this needs to be taken into account. It may be necessary to collect data in a different way if you know in a member state, there are only a few farmers producing a product. Statistical data should not be used to track the performance of an individual farmer or grower. - The administrative burden of collecting data must also be taken into account. Authorities should ask themselves: is this piece of information ‘nice to know’ or is it really ‘need to know’? Please limit yourselves where possible, since farmers and growers complain a lot about the amount of bureaucracy they come across. Often data are already available (in other government databases, as part of private quality schemes, etc), the approach should be: ‘collect once, use many times’. - For policy and strategy reasons, we need agricultural statistics, for example on the CAP and trade flows. So financing dedicated to agricultural statistics should be preserved. - To finish: it is important to involve the industry when drawing up questionnaires and when analysing data. This should be a requirement of MSs authorities and the European Commission should evaluate how this is being executed.

LTO Nederland, the Dutch Organisation for Horticulture and Agriculture, welcomes the opportunity to contribute to the implementing directive about Plant health: revised import rules to protect plants and prevent the spread within the EU of diseases affecting them. We kindly ask you to consider our remarks about the draft implementing act, Annex IV, part A, section I, point 34, about ‘growing medium, attached or associated with plants, intended to sustain the vitality of the plants, with the exemption of sterile medium of in vitro plants, originating in third countries other than Switzerland’. • There are more materials that can be used as growing medium than mentioned in a i an a ii, e.g. sawdust. We think there should be the possibility to use and import all kinds of materials as growing medium underf the restriction that they have not previously been used for growing plants or for any agricultural purposes. There should also be made an exception for those materials that received an effective treatment to ensure freedom of harmful organism. • The additional demand to store and maintain growing medium under appropriate conditions is only relevant for plants growing in a protected environment • This additional demand is less important for growing medium used for growing of plants outdoors at nurseries (see following remark) • The demands about growing medium since planting at point 34 b i, can not be realised for nurserystock material, and plants for planting of pot- and gardenplants which are grown outdoors in nurseries in the open field. We suggest to skip : - physical isolation of the growing medium from soil and other possible sources of contamination - using water free from harmful organism ‘ And replace this by : - Hygienic and sanitation measures to prevent the introduction of harmful organism When this is adopted then Art 34, b ii, can be an alternative when growers are not able to comply to the hygienic and sanitation measures to prevent the introduction of harmful organism. Finally, we ask you for a transitional period for growers to fulfill the new criteria. Most of nurserystockmaterial and plants for planting of potplants and gardenplants have a cultivation period of several years. Companies, especially those with a long-term relationship with growers in our country, have already started with cultivation of plants for them and cannot easily comply to the new criteria.

Response to Commission Delegated Regulation on the methodology for risk assessments of invasive alien species

With regard to the proposed Commission delegated regulation supplementing Regulation (EU) No 1143/2014 of the European Parliament and of the Council with regard to risk assessments in relation to invasive alien species the ‘Land- en Tuinbouw Organisatie Nederland’ (LTO Nederland) would like you to take due notice of the following considerations the following considerations (part 1 of 2). The level of risk deemed unacceptable for society: According to common EU-law and case law by the Court of Justice, the purpose of the risk assessment is to assess the degree of probability of a species having significant adverse effects on biodiversity and the seriousness of any such adverse effects. The two complementary components of risk assessment are to ascertaining what level of risk is deemed unacceptable and conducting a scientific assessment of the risks. In that regard, it is for the European Commission to determine, based on the criteria of the Regulation, the level of protection which it deems appropriate for society. The Commission however, still fails to determine the level of protection which it deems appropriate for society and the level of risk that is no longer acceptable with regard to the impact on biodiversity. The European Commission still fails to clearly define cut-off values for significant adverse impact for species not yet present in the Union or at an early stage of invasion and most significant adverse impact for alien species already established in the Union on native biodiversity. By failing to take the first step of the risk-assessment system as explained and determined by the Court of Justice, the European Commission fails to prove the need for the listing of the species in relation to the risk a species poses for the biodiversity and ecosystem services in the European Union on a species to species level. Scientific data and the duty of diligence: The Court of Justice requires risk assessments to be based on entirely scientific data. When the precautionary principle is applied, this principle of common EU law to only use scientific data is to be applied just as strict or even more strictly, according to the European Commission itself and the Court of Justice. Nevertheless, art. art. 3 of the delegated act still allows the use of non-scientific data as acceptable evidence. This forms a serious infringement of the principles of excellence, transparency and consistency. Furthermore, when a risk assessments consists merely or entirely of out of the context quotes from (non)scientific research, the risk-assessment cannot be considered to sufficiently take into account the particular circumstances of the case at issue nor to be sufficiently reliable and cogent to allow the Community institution to understand the ramifications of the scientific question raised and decide upon a policy in full knowledge of the facts. The risk assessment must be entirely based on scientific data and the answers to the factual questions must put into context the results of the scientific process in a scientific advice. Therefore, the listing of a species based on out of the context quotes from (non)scientific literature must be considered an infringement on the duty of diligence and cannot be considered to be founded on the principles of excellence, transparency and independence.

LTO Nederland, Dutch Organisaton for Agriculture and Horticulture, welcomes the opportunity to share its views about the plant passports format LTO Nederland has two remarks on item 6 and item 7 of the legend at the Annex. - item 6: “Where applicable, the unique barcode, QR-code or other data carrier, supplementing the traceability code” we suggest to change ‘QR-code or other data carrier' in ‘QR-code, hologram, chip or other data carrier’, in accordance with annex VII part A(2) - item 7: “Where applicable, the two-letter code indicated in norm ISO 3166-1-alpha-2, referred to in point (a) of Article 67 of Regulation (EU) 2016/2031, of the Member State(s) of origin, and, in the case of replacement of the plant passport, the registration number of the professional operator concerned who issued the initial plant passport or for whom the initial plant passport was issued by the competent authority as referred to in Article 93(1) and (2) of that Regulation” LTO Nederland does not agree to include the registration number of the professional operator who issued the initial plant passport in the case of replacement of the plant passport. In Regulation 2016/2031 in article 93 and Annex VII about replacement plant passports, there is no requirement of an unique identification code of the original issuer of the Plant Passport. We think this will be impractical when an operator sells a mixture of different plants of varies origins, or when plants have several operators prior to final sale. This leads to unnecessary administrative burdens for operators. LTO Nederland does agree traceability must be maintained and be visible to competent authorities. With the use of the traceability code (legend item 5) this is already possible.

Dutch farmers' organisation LTO NEDERLAND wishes to contribute to the EU inception consultation on the food chain. Our contribution is attached. In short, LTO NEDERLAND emphasizes the importance of farmers' co-operatives to improve the position of farmers in the value chain and sustainability and innovation in general. Tackling UTPs is important, but this will not be enough to improve the farmers' income. This is based on our experience with the SCI pilot initiative in the Netherlands during 2013-2015 and a farmers' survey we did in 2015. Market transparency needs to be adapted to the needs of the operators. We point out that, in the Netherlands, there is a guideline on competition law and sustainable production which could help the farming sector to improve the general income situation while at the same time meeting the needs of consumers and society as a whole in the future. This could serve as an example at EU level - as stated by the recent Veerman Task Force report.

Feedback to the Commission Implementing Act updating the List of invasive alien species (IAS) of Union concern On behalf of LTO-Nederland, Plantum, Anthos, VBN, LTO Glaskracht and Natuur en Recht. Together we represent at least 6.000 Dutch entrepreneurs: the Dutch nurserystock growers, the Dutch growers of flowers, plants and perennials, the Dutch Flower Auctions, the Dutch plant trade organisations and the Dutch entrepreneurs who are active in breeding, propagation, production and trade of seeds, bulbs, tubers, cuttings and young plants. We are very worried about the ongoing updates of the List of invasive alien species of Union Concern. For the three most common breeded species listed on this Implementing Act, we conclude that they are not qualifying as having a most significant adverse impact. Therefore we request to remove Gunnera tinctoria, Pennisetum setaceum and Asclepias syriaca from the Implementing Act updating the List of invasive alien species. These species do not fulfil the requirements of Regulation 1143/2014 for listing as invasive alien species of Union concern. Our argumentation is represented in the attachment.

On behalf of the Dutch Organisation of Agriculture and Horticulture we like to draw your attention on two issues: 1. About Saperda candida Fabricius the requirements inserted at point 14, (page 8 ) b,i. According to the proposal of the European Comission the place of production where plants have been grown should be in a site with complete physical protection. We think this is hard to realise and strongly doubt if this will be (economically) feasible. 2. About Bemisia tabaci At point 24.3 (page 20). It will be very difficult at some production places of potted plants intended for the final consumer, to keep the production place totally free from Bemisia tabaci. In addition to this we strongly want to stick to the requirements of IPM. Therefore we suggest that the potted plants intended for the final consumer, are inspected prior to delivery to be free from Bemisia tabaci instead of the demand that each production place will be totally free from Bemisia tabaci.
