Improving the working conditions of platform workers

Employment and social affairs

Dignified working conditions are essential to Europe’s economic model. People providing services through platforms often fall outside the scope of protection by EU labour law. The sustainable growth of the platform economy requires better working conditions of people providing services through platforms and adequate social protection. Based on Art 154 TFEU the Commission will engage with Social Partners with a view to put forward an initiative to improve working conditions in platform work.

Bolt warns EU platform rules threaten 150,000 driver jobs

Bolt, 14 Feb 2022

Bolt urges replacing the automatic presumption of employment with a flexible status for dependent contractors. They request removing price and quality controls from the criteria used to determine employment status. The firm argues reclassification should follow an overall assessment of driver independence.
Avoiding reclassification would prevent the total disruption and high costs of Bolt's current business model.
Consumers would suffer from higher transport costs and reduced service availability in remote areas.

Wolt urges clearer criteria for platform worker classification

Wolt requests replacing Article 4(2) criteria with clearer standards based on the EU Court's Yodel case ruling. They want the self-employed to receive equal protections from algorithmic management, particularly extending Article 7(2) rights to self-employed workers. They also advocate for stronger data-sharing provisions with authorities.
This would reduce legal uncertainty about employment classification while preserving their flexible self-employed courier model.
Couriers could lose earnings and work opportunities if forced into rigid employment arrangements.

Deliveroo warns EU employment rules threaten rider flexibility

Deliveroo requests a higher threshold of three criteria to trigger the employment presumption. They also seek legal certainty to provide rider benefits without risking status reclassification.
This would reduce litigation costs and allow them to maintain a self-employed workforce.
Riders lose income and the freedom to choose their own working hours.
