The amount of the de minimis threshold The Czech Chamber of Commerce supports the increase of the de minimis state aid threshold. Since 2006, when the value was determined, the price level in the Czech Republic has increased by more than 55% and it is expected that there will be continual higher inflation in the coming years. For this reason, it is necessary to set the limit to cover inflation and at the same time to be flexible enough in extraordinary situations that require the introduction of a temporary framework, such as the impact of the coronavirus pandemic or the Russian invasion of Ukraine. Transparency requirements The Czech Chamber of Commerce believes that the requirements for transparency can be increased through a mandatory public register, which would be managed and filled with information by the authorities providing state support in individual member states. • The establishment and updating of this register should in no case mean new administrative obligations for companies. • The public officials managing the register should also be responsible for the correctness of the data in the register. • Procedural rules should also be created to resolve discrepancies between the information in the register and reality. Companies should thus have at their disposal a simple mechanism for correcting any incorrect information in the register.

Podporujeme obecné povolení provozu delších silničních vozidel a souprav. Vzhledem k pokroku v technologiích považujeme za efektivní zvýšit rozměry, zejména u délky vozidel a povolit používání modulárních souprav 25,25 metru. Toto opatření je rychle realizovatelné, má relativně nízké náklady s okamžitým kladným dopadem na snížení emisí i energetické náročnosti. Zvýšení objemové kapacity silničních vozidel by snížilo počet vozidel v provozu a může pomoci v situaci, kdy členské státy řeší nedostatek řidičů. Při zachování současných hmotností na nápravu by v celé EU (alespoň na hlavních tazích) měla být povolená hmotnost soupravy 44 popřípadě 48 tun. Delší návěsová souprava nebo i dvou či třínápravové vozidlo např. o 1,5 metru může na silnicích operovat bez větších obtíží. Věříme, že provoz těchto vozidel měl být v EU povolen za jednotných podmínek. Pokud jde o hmotnost vozidel, je otázkou, zda by omezení nemělo být pouze na maximální povolené nápravové tlaky, které mají vliv a dopad na opotřebení silniční infrastruktury.

HK ČR dlouhodobě poukazuje na nutnost nastavení férových pravidel pro výkon ekonomických aktivit v rámci tzv. sdílené ekonomiky. Primární je narovnání podmínek pro poskytování srovnatelných služeb tradičním způsobem a způsobem využívajícím digitální platformu. Narovnání z podnikatelského hlediska zahrnuje jednak respektování regulatorního rámce pro podnikání v ČR samotnou digitální platformou, jednak dalšími podnikateli, kteří své výdělečné aktivity provozují ve spolupráci s digitální platformou (s využitím jejích služeb). Pokud jde o druhou zmíněnou skupinu subjektů, návrh směrnice je v případě osob fyzických všechny apriorně pojímá jako zaměstnance (právní konstrukce tzv. vyvratitelné domněnky). Napomáhají tomu zcela obecná kritéria údajné „kontroly“ platformy nad subjekty, které s ní spolupracují, přičemž pro naplnění domněnky stačí splňovat alespoň 2 z 5 obecných kritérií. Přitom první 3 až 4 kritéria charakterizují racionální podmínky pro vztah mezi jakýmkoliv podnikajícím subdodavatelem a podnikajícím odběratelem jako jeho obchodním partnerem. Není pochyb, že speciálně v ČR v současnosti v důsledku neúměrně vysokých sociálních a zdravotních pojistných odvodů je celá řada aktivit OSVČ zastřením pracovně právního zaměstnaneckého vztahu (tzv. švarcsystém), a proto je zde relativně vysoký počet „podnikatelů“. Navržená paušalizující směrnice je pokusem, jak tento problém řešit ve speciálním případě „zaměstnavatele – digitální platformy“. S jednoduchým paušalizujícím přístupem však nelze souhlasit ani v obecné národohospodářské rovině, ani v případě regulace tzv. sdílené ekonomiky. Na doplnění výše zmíněné zásadní připomínky poznamenáváme, že považujeme za sporné vnucovat OSVČ vstup do pracovněprávního vztahu, pokud si to daná osoba nepřeje. Vyvrácení právní domněnky o pracovním poměru by představovalo pro zúčastněné zbytečné administrativní (a finanční) náklady. Není zřejmé, jaká by měla být aplikační praxe, pokud jde o důsledky apriorní transformace zejména zahraničních platforem do role zaměstnavatelů v rovině vynucení odvádění plateb pojistného na sociální zabezpečení a na veřejné zdravotní pojištění. Není zřejmé zajištění provázanosti s vlastními daňovými povinnostmi digitálních platforem. Návrh jinak potřebné směrnice považujeme za meritorně nedořešený, a proto by měl být vrácen Komisi k dopracování.

We would like to mention 2 practical problems with the Audit reform/Regulation. 1. The non-harmonization of national rules for rotation – there are different rules in different EU states which make practical difficulties for multinational firms (groups). 2. The non-harmonization of EU Audit Regulation rules for tendering auditor and EU and national rules for public procurement. According to EU Audit Regulation, there must be 2 audit firms selected in the tender but according to public procurement rules there can be only one selected firm. For example, there are companies that are utilities contracting authorities listed on the stock exchange and must adhere to both regulations. That makes unnecessary work and administration burden/cost.

Návrh směrnice, který je součástí Evropského pilíře sociálních práv, vnímáme jako snahu o efektivní realizaci práva na rovné zacházení, konkrétně v oblasti odměňování. Tuto snahu obecně podporujeme. Návrh však přichází v době, kdy je třeba do českého právního řádu implementovat řadu již platných evropských norem, např. směrnice EP a Rady (EU) 2019/1152 o transparentních a předvídatelných pracovních podmínkách v Evropské unii a směrnice EP a Rady (EU) 2019/1158 o rovnováze mezi pracovním a soukromým životem rodičů a pečujících osob. Dalším významným tématem s přesahem do právní roviny je digitální transformace hospodářství, jejíž právním vyjádřením je Rámcová dohoda Evropských sociálních partnerů o digitalizaci. V oblasti pracovního a sociálního práva tak dochází k významnému nárůstu regulace, jejíž aplikace v praxi je pro zaměstnavatele administrativně i finančně náročná. V době, kdy se firmy potýkají s důsledky pandemie nemoci Covid-19, je třeba varovat před robustní regulací. Obecně bude v praxi problematické posoudit a vyjasnit klíčové pojmy „odměna“ a „rovnocenná práce“. Návrh směrnice je ambiciózní, ale není vůbec jisté, že navržená pravidla účinně zajistí snižování rozdílů v odměňování mužů a žen.
