Response to Revision of EU marketing standards for agricultural products

Dear European Commission, Please find attached feedback from A.P. Moller - Maersk on the revision of EU marketing standards with regard to ripened banana imports. The attached document aims to provide the European Commission with some information regarding the technological developments within the logistics of fresh fruits and vegetables. The focus is here on the specific case of import of bananas to the EU. The EU marketing standards for agricultural products should continue to ensure a high level of quality. However, as highlighted by the Commission, some standards are no longer in tune with market and technological realities. This is the case for Commission Implementing Regulation (EU) No 1333/2011 laying down marketing standards for bananas and rules on the verification of compliance with those standards. With the new technology available, it is today possible to significantly reduce food waste and GHG emissions whilst securing a larger logistics and supplier flexibility. It is therefore important that the European Commission envisages modernizing Commission Implementing Regulation (EU) No 1333/2011 and allows for the import of ripened bananas. Response to Revision of the Shipping MRV Regulation

A.P. Moller – Maersk welcomes the opportunity to comment on the proposed revision of Regulation (EU) 2015/757 on the monitoring, reporting and verification of carbon dioxide emissions from maritime transport. In general, A.P. Moller – Maersk welcomes the efforts from the European Commission to harmonize the MRV Regulation with some of the technical aspects of the IMO Data Collection System. However, A.P. Moller – Maersk would caution against the decision to allow cargo carried to be a voluntary monitoring parameter. Especially if this leads to the fact that obligations under article 9 (g), article 10 (i) and Annex II on transport work fall and that transport work is thus no longer calculated on actual cargo carried. Indeed, calculations based solely on nominal figures (e.g. nominal deadweight tonnage) are not suited to exemplify the energy efficiency of ships, quite to the contrary. The efficiency of vessels is directly linked to the relation between CO2 emissions and the delivered transport work. The transport work calculation needs to include the actual cargo transported and the utilization of the vessels. Furthermore, if the nominal deadweight tonnage is used as proxy for the cargo carried, this removes one of the original aims of the 2015 MRV Regulation, which was to incentivize emission reductions and energy efficiency. A conservative estimate of 2% emissions reduction as a direct result of better data is included in the original 2015 MRV Regulation. A.P. Moller – Maersk would argue that emission-data driven decisions by shipowners can deliver a substantially larger decrease, as these can serve as an important factor in technical, commercial and operational choices. For A.P. Moller – Maersk, it is clear that one size does not fit all and that maritime transport is composed of diverse fleets and operators. Whilst it can be tempting to align all types of shipping on a nominal DW proxy, this also leads to disputable comparisons in energy efficiency between sectors. Container shipping’s energy efficiency should be measured with a proxy linked directly to actual TEUs transported (as is the case in the current MRV Regulation). This makes sense not only from a commercial perspective (allowing to provide our customers with the footprint of the containers we carry for them) but also from a climate perspective (providing a real energy efficiency measure). The European Commission’s Proposal for a Revision of the MRV Regulation also aims to streamline and reduce administrative burdens. This is the case, with most suggested changes. However, making a key data element, such as cargo carried, voluntary also has unintended consequences on energy efficiency efforts. The benefits of solid data collection far outweigh administrative burdens. Furthermore, the strong efforts by EMSA in the THETIS-MRV module have secured that shipowners can fulfill their monitoring and reporting obligations in a centralized and harmonized way, effectively reducing much of the administrative tasks. Shipping has a clear role to play in lowering greenhouse gas emissions globally. This can only be done on the basis of credible and reliable data. A.P. Moller – Maersk would consequently call for cargo carried to remain mandatory in the EU MRV and looks forward to further engage with the EU institutions on this topic.
