Brot für die Welt begrüßt die Veröffentlichung des Entwurfs für eine CSDD-Richtlinie und sieht darin einen sehr wichtigen Schritt im Rahmen der Transformation zu einer nachhaltigeren und gerechteren Weltwirtschaft. Der Entwurf enthält auch viele Elemente, die zur Erreichung dieses Ziels entscheidend sind. Dies betrifft insbesondere: • die Erfassung von Hochrisikosektoren; • die umfassende Definition der Wertschöpfungskette, welche die Nutzung und Entsorgung von Produkten abdeckt; • die Anerkennung des Rechts auf existenzsichernde Löhne; • die Formulierung von Vorgaben in Bezug auf den Klimaschutz; • die Wahl eines kombinierten Ansatzes zur Durchsetzung der Richtlinie aus präventiv wirkenden behördlichen Kontrollen und zivilrechtlicher Haftung zum Ausgleich bereits eingetretener Schäden. Um tatsächlich einen Beitrag zur Reduzierung von Menschenrechtsverletzungen und Umweltschäden in den Liefer- und Wertschöpfungsketten in der EU geschäftstätiger Unternehmen leisten zu können, müssen in dem Entwurf im Gesetzgebungsverfahren aber noch einige Punkte nachgebessert werden. Das betrifft insbesondere Regelungsvorschläge, die hinter den UN-Leitprinzipien für Wirtschaft und Menschenrechte und den OECD-Leitsätzen als den für den Regelungsgegenstand zentralen international anerkannten soft law-Standards zurückbleiben. • Durch die Beschränkung der Sorgfaltspflichten auf etablierte Geschäftsbeziehungen bleibt ein Großteil der Geschäftsbeziehungen, v.a. auch besonders risikobehaftete kurzfristige oder informelle, außer Acht. Die Beschränkung ist mit den internationalen Standards nicht vereinbar, wonach sich die Sorgfaltspflichten auf alle Geschäftsbeziehungen entlang der Wertschöpfungskette beziehen müssen. Zudem sind damit erhebliche Fehlanreize verbunden: Unternehmen werden dadurch verleitet, schematisch alle etablierten Geschäftsbeziehungen zu überprüfen, statt risikobasiert vorzugehen und ihre Geschäftspartner häufig zu wechseln, statt sich langfristig zu engagieren. • Die vertragliche Kaskadierung und deren Überprüfung durch Audits oder im Rahmen von Industrieinitiativen nimmt im Entwurf eine starke Rolle ein. Es fehlen jedoch Qualitätskriterien und Vorgaben, die sicherstellen, dass Unternehmen sich dadurch nicht ihrer Verantwortung entledigen und die eigene potentiell risikoerhöhende Rolle übersehen. Um dies zu verhindern, sollten auftraggebende Unternehmen dazu verpflichtet werden, ihre Zulieferer durch die Umsetzung geeigneter Beschaffungsstrategien und Einkaufspraktiken sowie Schulungen zur Einhaltung der in den Vertragsklauseln enthaltenen Standards zu befähigen. • Die Beteiligung von relevanten Stakeholdern, wie den Betroffenen der Menschenrechtsverletzungen ist im Entwurf entgegen der internationalen Standards sehr schwach ausgestaltet. Zum einen fehlen in der Stakeholderdefinition in Art. 3 n) NGOs und Gewerkschaften als wichtige Stakeholdergruppen. Zudem ist die Konsultation von Stakeholdern in den Artikeln zu den einzelnen Sorgfaltspflichten häufig nur mit dem Zusatz „where relevant“ vorgesehen. Stakeholder, wie Betroffene, Gewerkschaften und NGOs, sind aber die zentrale Erkenntnisquelle bei der Feststellung von menschenrechtlichen und umweltbezogenen Verstößen und der Identifikation von geeigneten Abhilfemaßnahmen. Ihre Einbeziehung sollte daher fester Bestandteil des Risikomanagements sein. Schließlich fehlen Vorgaben, wie eine wirksame Einbeziehung zu erfolgen hat. • Die zentrale Vorgabe, dass Unternehmen bei Verletzungen, die sie verursacht oder zu denen sie beigetragen haben, auch für Wiedergutmachung sorgen müssen und dass diese verschiedene Formen (neben finanzieller Kompensation, auch Folgenbeseitigung, Rückerstattung und Entschuldigungen) annehmen kann, fehlt ganz. • Die im Entwurf enthaltenen Vorgaben zum Klimaschutz sind zu punktuell, betreffen zu wenige Unternehmen und sind nicht hinreichend klar formuliert. • Die zivilrechtliche Haftung ist ohne eine angemessene Beweislastverteilung nicht funktional.
