Aus Verbrauchersicht ist der Entwurf der Durchführungsverordnung der Kommission zu begrüßen. Eine standardisierte Vorlage wird einheitliche Bedingungen für die Erfassung der folgenden Daten durch die Mitgliedstaaten gewährleisten: Unfalldaten und Informationen für die Aufnahme/Streichung einer Kategorie von Maschinen oder verwandten Produkten in Anhang I der Verordnung (EU) 2023/1230. In einigen Spalten der Vorlage ist eine Nummerierung erforderlich, z. B. in den Y-Spalten zu Artikel 6.5 Buchstabe b, während in der Spalte Erläuterungen unter der gleichen Überschrift Freitextbeschreibungen erforderlich sind, die sehr umfangreich sein können. Ähnliches gilt für die Spalten zu Artikel 6.5(a) und Artikel 6.5(c). Dies kann das Ausfüllen der Vorlage erschweren. Es ist wichtig, dass Freitextbeschreibungen einfach eingefügt werden können. In der Spalte Erläuterungen zu Artikel 6.5(b) wäre es nützlich, auch anzugeben, ob das betreffende Produkt/die betreffende Maschine die relevante(n) Norm(en) erfüllt und wenn nicht, gegen welche Abschnitte der EN(s) verstoßen wurde(n). Wir schlagen vor, dass es eine Möglichkeit geben muss, den gemeldeten Unfall nachzuverfolgen, da die in der Vorlage geforderten Details verständlicherweise auf einem recht hohen Niveau sind und es oft notwendig ist, die Feinheiten der gemeldeten Vorfälle zu verstehen, bevor die tatsächliche Unfallursache festgestellt werden kann. Wir weisen darauf hin, wie wichtig es ist, eine Anleitung zum Ausfüllen des Formulars zur Verfügung zu stellen.

Response to Revision of the Toy Safety Directive

DIN supports the objectives of the revision of the Toy Safety Directive 2009/48/EC and the proposal for a Toy Safety Regulation (COM(2023)462) to increase childrens safety and improve protection from harmful chemicals. We welcome that standards continue to play an important role in achieving these goals, as they specify technical details and thus help toy manufacturers to comply with the essential requirements set out in the Regulation. Since the European standardization organizations review each European standard at least every five years to ensure that it is up to date, the reference to harmonized European standards ensures that toys placed on the European internal market are based on the state of the art. We would like to draw attention to some passages of the proposed Regulation that could be further specified or improved in the legislative process: - Harmonized European standards should always take precedence over common specifications in the implementation of the Regulation. - There needs to be a horizontal approach to common specifications across all single market directives. - Annex III should refer to the general warning sign ISO 7010-W001. - The analytical feasibility, e.g. for chromium (VI), should be taken into account when setting limit values. - Organic tin limit values should be removed from the element migration limit table. - The harmonization between several directives is key to enable an interoperable digital product passport. Please see attached file It is important to emphasize that European standardization is a well-functioning tool also in times of crisis. Specifications in times of crisis are rarely harmonized standards or "normal standardization procedures". Standardization proved its efficiency and fruitfulness right at the start of the Coronavirus pandemic in 2020. In his letter dated March 18, 2020, Commissioner Thierry Breton called on CEN/CENELEC to take urgent action to play a key role in facilitating alternative ways in manufacturing protective equipment and medical equipment and to provide manufactures with guidance and technical specifications. The specification for everyday “community” masks was achieved in record time of just two weeks! While supply chains were disrupted and national borders closed, the entire European (and international) standardization network had joined forces across borders to make standards available quickly and identify respective requirements. Therefore, European politics and standardization proved that it can join forces quickly even in times of crisis.

DIN welcomes the proposed draft amendment to Regulation 1025/2012. In particular, DIN supports the emphasis on strengthening the national delegation principle. This is a core value of European standardization in CEN and CENELEC and international standardization in ISO and IEC alike. The national delegation principle facilitates engagement with all relevant stakeholders. They can give their input most efficiently at national level in their national language. The national positions fed into European standardization are based on the national input and constitute consensus among the national stakeholders. DIN does also welcome the European Commission acknowledging the value of involving national standardization bodies from outside the EEA. Their involvement ensures that European Standards are not only implemented identically in the EEA countries but also in other countries important for the Single Market. It goes in line with the obligation to withdraw all conflicting national standard. This harmonization among all CEN and CENELEC members’ countries is a significant asset for the Single Market and a reason for promoting the European standardization system to other regions. The membership concept of CEN and CENELEC relies on the role of the relevant countries for the Internal Market. Membership is only possible for national standardization bodies from EEA member countries or from countries having agreements with the EU on regulatory convergence to support the Single Market. The voting system of CEN and CENELEC grants all members the same voting rights (with different weights in line with Lisbon and Nice Treaty) but also prevents members from non-EEA countries impeding any decision supported by the majority of members from EEA countries. It is our aim to preserve the strengths of the public-private-partnership between the European Commission and CEN/CENELEC - framed by Regulation 1025/201 - and deliver a robust, resilient and efficient system, when supporting EU policies and legislations. DIN commits to engaging in a continued constructive dialogue with the European Commission.

The Joint Commercial Advisory Group often refers to the CWA 95000 standard (see attachment). This standard includes recommendations for standardization bodies. It seeks to (a) provide educational and contextual information regarding SEP licensing and the application of FRAND, (b) identify and illustrate some of the questions that negotiating parties may encounter, and (c) set forth some of the key behaviors and “best practices” that parties might choose to adopt to resolve any SEP licensing issues amicably and in compliance with the FRAND obligation. Our hope is that this CWA can assist both experienced and inexperienced SEP negotiators and inform any other interested stakeholders how to more effectively reach fair agreements and to better promote the goals and interests of industry, standardization and, ultimately, consumers. Standards organizations could help reduce the number of disputes, but they are not set up to do so today.

Response to Review of the general product safety directive

DIN Deutsches Institut für Normung e. V. as the official national standardisation body in Germany appreciates the opportunity to comment on the GPSD draft as follows: 1) General comments: Standardization in support of the EU legislation is a strategic tool for the success of the Single Market and the competitiveness of European companies, as well as the well-being of European consumers and society - a system copied by partners around the world. We appreciate that this also applies for the European Commission proposal for a GPSR, even though it is not a harmonization legislation. 2) The GPSR proposes to amend the Regulation 1025/2012 on European standardization. This Regulation sets the general framework for European standardization and European Union legislation and policies. Regulation 1025/2012 is fit for purpose and fit for the future. This was also recently consensus among a wide variety of stakeholders in the consultation on the roadmap for the standardization strategy of the European Commission. Therefore, we see no necessity to amend the Regulation 1025/2012 for the specific application of the GPSR and recommend removing all references concerning the adaptation or amending of the Regulation 1025/2012. All standardization requests independent from the legislation or policy that they support shall be dealt with in the Committee on Standards according to Regulation 1025/2012, Article 10. 3) We welcome the results of ex post evaluations, stakeholder consultations and impact assessments particularly concerning the simplification of the standardization processes. The European Commission has already published the Roadmap for the standardization strategy in which the citation of harmonized European standards in the Official Journal of the EU is an important point. We believe that the simplification of the standardization process is of essential but more general nature. It should be addressed in the frame of the standardization strategy and not the GPSR. Moreover, a recently created high-level task force between the European Standardization Organizations (the ESOs: CEN, CENELEC and ETSI) and the European Commission is currently already addressing this topic. Therefore, we recommend deleting any reference to the simplification of the standardization process within the GPSR. Please see the attached file for our further comments.

Response to Revision of the Machinery Directive

Der DIN-Normenausschuss Sicherheitstechnische Grundsätze (NASG) führt als Querschnittsausschuss die Normungsarbeiten bezüglich grundlegender und fachübergreifender sicherheitstechnischer Anforderungen aus. Die Normen des NASG sollen den Entwickler und Konstrukteur technischer Güter darauf hinweisen, wie Sicherheitsaspekte schon in der Entwurfsphase berücksichtigt werden können. Ausgangspunkt dieser Normungsarbeit sind beispielsweise die Richtlinien des Europäischen Parlaments und des Rates zur Maschinensicherheit, zum Explosionsschutz sowie das Produktsicherheitsgesetz (ProdSG). In diesem Zusammenhang hat sich der Beirat des NASG mit dem vorgelegten Kommissionsvorschlag für die Verordnung zur Maschinensicherheit (COM(2021)202) befasst und beigefügte Stellungnahme zu folgenden Punkten verfasst: - Digitale Technologien - Konformitätserklärung - Normugnsauftrag.

Response to Standardisation Strategy

Vision: The desirable situation in 2025 would be the following 1. Anticipation of future standardization needs: A chapter on st. is integrated into every strategy promoting future technologies. Relevant calls for funding from the EC always take into account the initiation of st. projects (st. by default), i.e. standardization organizations (SDOs) are automatically included in priority projects on future technologies and solutions developed in Europe become international standards. 2. Modernization of standards-related processes: European standards are timely developed in an agile and efficient system. With regard to standards supporting EU legislation and policies, the EC is part of this agile system and contributes to its functioning. European standards meet the needs of all relevant stakeholders and increase the competitiveness of European economy, also at global level. Smart standards as a synonym for the digital (machine readable & executable) standard is a central paradigm and strategic objective for the SDOs at European and intern. level. Open source solutions have found their way into SDOs and are being considered as a serious option. 3. Broadened stakeholder participation at national, European and intern. level. 4. International leadership in standardization: Europe has a more assertive stance in intern. st. along the indicators: more resources for experts and project management, a pool of experts, increased expert participation from Europe in intern. st., coordinated input according to policy aims, project management by European national standardization bodies (NSBs) in strategic committees. 5. Education and vocational training in st.: A broad number of experts from all fields of technology- and society-related topics know about st., intern. relations within the st. world, the benefits for their own company and/or country and how to get involved, so that the goal stated in (4) will be supported and achieved. 6. Single Market for services: An increased awareness of the benefits of standards for the competitiveness of the European service sector. 7. The Standardization Regulation : The ESOs are the exclusive service providers for any kind of st. aim of the European legislators. Recommendations: European st. is of private nature, run via the NSBs. NSBs also represent national interests from Europe in intern. st. via ISO and IEC. A strategy of the EC should thus revolve around measures where policy can bring added value to the competitiveness and resilience of European companies and well-being of European citizens. Such as: Focus: • all st. efforts within the ESOs and built on their strong connection with ISO and IEC • within the Public-Private-Partnership between regulators and private st. on a) standards that substantiate the (essential) requirements of law and b) standards that support policy objectives, e.g. research & innovation, twin transitions, strategic autonomy, resilience, competitiveness Incentivize: • the uptake of research results in st. • participation of scientists in st. Coordinate: • a rolling pan-european st. strategy in prioritized technology areas • the close interlinkage between the st. world and other instruments, com-petence centers, or expert groups like Industrial Alliances, PPPc, JRC, IPCEI etc. Support • the active participation of stakeholder-groups with limited resources like small enterprises, start-ups, consumers, social partners, environmental org. in prioritized areas Invest: • in intelligence: o map the SDO landscape in prioritized areas o st. roadmaps in an early stage of the development of a technology o enable the existing body of standards to come up to speed to new technologies o SESEC, SESEI Stipulate • in Free Trade Agreements o ISO and IEC are the prefered platforms for trading partners’ st. efforts o the use of international standards (from ISO and IEC) by trading partners and that SDOs strictly adhere to WTO TBT principles

Response to Requirements for Artificial Intelligence

We welcome the European Commission's proposal for a regulation that focuses on trustworthiness and product safety of high-risk artificial intelligence (AI) for the European Single Market. AI technology will only be used across the board if it is trustworthy and finds acceptance in society. Standards play an essential role in helping to achieve a broader acceptance of AI systems and bolster trust in them. For example, they can define criteria for quality, explainability, fairness, safety, security, privacy, and transparency. We therefore welcome the fact that the Commission assigns an essential role to standards in the safe placing of AI technology on the European Single Market. We further believe that the AIA proposal paves a way for European experts to significantly shape global standards on AI. Response to Revision of the NIS Directive

DIN, the German national standardization body, welcomes and supports the proposal for an update of the directive on measures for a high common level of cybersecurity across the Union (NIS2 Directive) that seeks to improve resilience and incident response capacities of public and private entities as well as competent authorities. We see the imperative need for a harmonized and future-proof European cybersecurity framework and in this regard expressly refer to our joint BDI-DIN-DKE position paper “EU-wide Cybersecurity Requirements Introduction of horizontal cybersecurity requirements based on the New Legislative Framework and bridge to the EU Cybersecurity Act”. Common and harmonized cybersecurity requirements are the most efficient way to achieve a higher level of cyber resilience. Response to Action plan for the development of EU organic production

- To foster organic farming in Europe, the Commission can use standardization: European standards developed by the European standardization organisations, define uniform requirements which can be applied throughout the internal market. Farmes distributors and consumers may use these standards for orientarion. European standardisation also helps to disseminate and exploit technical innovations on the European market. - Standards are also needed as a basis for the thourough certification system requested in the roadmap for the Action Plan. - To make it easier for farmers to document compliance with the legal requirements for organic farmers, a simplifyed and standardized documentation systems needs to be set up. This will also enable farmers to realize the additional documentation requirements (e.g. field applications).
