GESAC demands EU transparency rules for music streaming algorithms

Message — The group requests extending European media rules to include music streaming platforms and video sharing services. They also demand mandatory transparency for algorithms to ensure European works are discoverable.12

Response to Intellectual Property Action Plan

GESAC welcomes the initiative for an IP Action Plan to stress the importance of IP rights for EU’s economy and its competitiveness globally. GESAC representing more than 1 million creators from all sectors through its 33 members (collective management organisations) from across Europe would like to focus its feedback on the issues related to copyright/authors’ rights and rights management. Prompt and faithful implementation of newly adopted Copyright Directives (Copyright in DSM Directive and the Broadcasting Directive) are absolutely crucial for creators in Europe. They set modern and forward-looking standards for the years ahead. We very much look forward to its proper implementation by Member States and also to the Guidelines that will be prepared by the European Commission on Article 17 in a way that follows the word and spirit of the Copyright in DSM Directive. Creators community looks forward that European Commission also makes these new rules of Copyright Directive, especially its Article 17, part of its requirements from third countries in its trade negotiations to ensure a high level protection of copyright and authors’ right in such relations. GESAC also carefully notes European Commission’s work on promoting an efficient use of high quality rights-management metadata in the copyright market. Collective management organisations have been setting the standards in the market in this field for many years. GESAC notes the recent developments in the EU copyright policy that give a particular interest in collective management, and that gradually recognise the importance of collective management of authors’ rights as the reliable and preferable model to strike the right balance in copyright policy. The former developments have given rise to growth of more sophisticated data management in the sector and for its further development the EU policy should more boldly express its commitment to collective management as an ideal model to ensure widest possible access to creative works by consumers and businesses, while ensuring appropriate remuneration of creators. The progress and further investment in the field to develop and streamline state-of-the-art rights management data and systems very much depend on reliable legal framework and the trust that would create in the sector. GESAC and its members are very much interested in contributing to every stage of Commission’s work in this respect
