Response to Review of ecodesign requirements for lighting products

The Motion Picture Association welcomes this opportunity to provide feedback on the draft regulation laying down ecodesign requirements for light sources and separate control gears. Lighting design plays a key role in almost any audiovisual production and can have a significant impact on the final viewing experience of a film or TV show. Therefore, in order to meet viewer and industry expectations, film and TV productions often require lighting products with specific technical characteristics (e.g. high colour rendering, precise beam control, connectivity to high speed networks, etc.). We are grateful that the Commission has previously recognised these specific technical needs when preparing its Ecodesign requirements, and that it has made efforts to do so in this draft regulation, notably by including a number of exemptions for certain lamp bases used by the sector in Annex III. However, whilst we wholeheartedly support the Commission’s goals of greater sustainability and energy efficiency and are taking sustained steps to deliver on such, we regret the impact that the draft regulation in its current format would have on the sector. In particular, the draft regulation would prevent the future availability of certain light sources which have specific technical features that are essential for our sector’s use and, ultimately, for creating the look and feel of the films and series we produce. As a result, the sector would be left with products which are significantly less functional than those it currently uses, meaning that the draft regulation would fail to meet the criteria for implementing measures set out by Article 15(5) of the 2009 Ecodesign Directive. Furthermore, given the high durability of the traditional lighting products used in the sector, banning them is unlikely to bring the desired benefits from an ecological perspective. We identify four concerns we believe remain to be addressed in the draft regulation. These concerns, which are set out in more detail in the attached joint position paper, are: • Stand-by power requirements for film, TV and theatrical lights: the proposed 0.5w limit is an unattainable target for professional lighting products connected to high speed control networks. • White light sources for specific needs of the film, TV and entertainment sectors: the sector has a specific need for high colour rendering light sources, with a full colour spectrum. • Colour-tuneable light and the definition of Green: the proposed wavelength range unnecessarily omits a certain range of green which is used by the sector (e.g. for green screens). • Additional lamp bases for exemption when used in professional entertainment lighting products: a number of specialist halogen lamp bases used by the film, TV, and entertainment sector would currently be prohibited, despite being relied upon for their specific technical characteristics (e.g. precise beam control, quality/clarity of light) and there being no identifiable replacement products available on the market. With this in mind, we urge the European Commission to ensure that the above-mentioned concerns are addressed in the upcoming Implementing Regulation by extending the exemption to some additional specific lighting products, specified in the attachment. This would ensure that our sector can continue to produce quality content under the best conditions, while at the same time allowing sufficient time for the development of suitable technology that can meet the conformity criteria. Dear Madam, Sir, Please find attached the MPA response to the Commission Inception Impact Assessment regarding measures to further improve the effectiveness of the fight against illegal content online. As an accompanying statement MPA would like to highlight that the Commission took the right approach in the September Communication on tackling illegal content online. The baseline option/voluntary compliance by online platforms is our preferred policy option at this point in time. Absent voluntary compliance, legislative intervention to address the abovementioned issues in a horizontal manner will need to be considered. Motion Picture Association
