Response to EU Chemicals Strategy for sustainability - Revision of the Cosmetic Products Regulation

L’Oréal, the worldwide leader in the beauty market, was founded in France in 1909 and has been growing in Europe and beyond ever since. Thanks to continued investment into Research & Innovation (964 million euros invested in 2020) and a stable regulatory framework, the company has been able to provide consumers with a wide range of safe and increasingly performing products which meet their beauty needs and aspirations, using all distribution channels, including e-commerce. Today, Europe at L’Oréal represents more than a quarter of the Group’s sales, more than a third of the Group’s employees and hosts 3 global research centres and 17 industrial sites. We welcome the revision of the Cosmetic Products Regulation as part of the Chemicals Strategy for Sustainability. We fully subscribe and share the Commission’s objectives in favour of a better protection of citizens and the environment, a reinforced framework for innovation for safe and sustainable chemicals and increasing the cost-effectiveness of compliance. As part of L’Oréal for the Future, our sustainability commitments for 2030, we unveiled a new series of objectives to transform the Group while respecting planetary boundaries (i.e. a set of processes regulating the stability and resilience of the earth system). In particular, we have committed to use 95% biobased ingredients, derived from abundant minerals or from circular processes in our formulas by 2030. This objective will be achieved through a new programme for Green Sciences. We would welcome the support of the Commission: - to facilitate the research and development of sustainable alternative solutions (e.g. innovative agricultural practices, biotechnology, green chemistry, eco extraction and formulation); and - to develop harmonised methodologies for the evaluation of product sustainability based on robust process and requirements. This area deserves a continuous and important research effort and start-up funding to realize a transition which will benefit to consumers and the environment. The transition to sustainable by design products and formulas will be gradual as there is no one to one replacement, and a rethinking of the architecture of our formulas will be required. We welcome the opening of a discussion on the digitalization of labelling requirements. This will be an opportunity to help communicate information to consumers in a more effective and engaging way. Digital solutions are best placed to communicate information to consumers in a way that overcomes the constraints of small packaging while reducing the volume of waste. We also support the Commission’s initiative to review the definition of “nanomaterial” to ensure a coherent terminology across the different pieces of legislation relating to chemical products that will result into a more homogeneous interpretation and enforcement across Member States. Finally, we urge the Commission to maintain the specificities of the cosmetics sector in the revision, in particular in terms of risk assessment. An exclusively hazard-based approach, which ignores the notion of exposure to an ingredient, would lead to the loss of ingredients whose safety can be demonstrated, and would disproportionately impact products which play an important role in the protection and well-being of consumers. We look forward to contributing in a meaningful and constructive way to the upcoming revision.
