Counterfeiting is a key issue for the consumer goods industry – not just in the EU but around the world. As set out in the Call for Evidence, counterfeiting not only causes economic harm to companies through a loss in sales revenue and brand equity, but also affects governments through the loss of tax revenue, helps to fund organized crime, and poses risks to the health and safety of consumers. Consequently, companies, including P&G, invest substantially in fighting this issue globally, both online and offline. We applaud and welcome the Call for Evidence on the Toolbox – the latest in the European Commission’s continuing efforts to improve the anti-counterfeiting ecosystem and the opportunity to engage on it. These efforts are not only important for the EU, but also set global standards and put the EU in a better position to engage with third countries in improving anti-counterfeiting best practices globally. Response to Revision of Combined Transport Directive

Article 1 of Directive 92/106/EE ‘on the establishment of common rules for certain types of combined transport of goods between Member States’ established constraints on the initial or final road leg combined transport operations. Article 2 of Directive 96/53/EC ‘laying down for certain road vehicles circulating within the Community the maximum authorized dimensions in national and international traffic and the maximum authorized weights in international traffic’ likewise places restrictions on the initial or final road leg of intermodal transport operations (specifically including those employing 45’ containers). Both of these provisions serve to restrict the catchment from which multi-modal operators can effectively be drawn and are therefore in practice inhibitory to the promotion of multi-modality. This has been borne out by our own experiences which we have previously shared with the Commission. The extent of the impact of such restrictions has also been quantified and documented by the “New ICT infrastructure and reference architecture to support Operations in future PI Logistics NETworks” project supported by the European Union’s Horizon 2020 research and innovation programme under the Grant Agreement No 769119 (see http://www.iconetproject.eu/). This study has confirmed that the more stringent the restrictions on the catchment area of Intermodal terminals (i.e., via explicit km limits on the road legs), the lower the chances of achieving an high level of modal shift via the TEN-T network (unless there are considerable efforts set in motion to establish many more new terminals). The proposed revision of the Combined Transport directive therefore needs to be based on empirical observations rather than any pre-conceived ideas around how to achieve modal shift. We wholeheartedly scenario 2 as a minimum and are open and supportive on scenarios 3 and 4.
