Plateforme de la Filière automobile (PFA) and his members welcome the opportunity to provide feedback to the European Commission in the context of this Call for Evidence. Through this submission, we aim to share insights from the automotive sector to support the further development and fine-tuning of this initiative. Our contribution is based on our experience in automotive sector / industry and reflects both operational realities and the ongoing transformation of the industry. We remain available for further dialogue to elaborate on the points presented in our feedback.

Response to Revision of the CO2 emission standards for cars and vans

Please find attached our position paper. The European automotive industry, more committed than ever to the 2050 climate neutrality goal set by the Paris Agreement, positions itself as a solutions-driven sector in the face of the climate challenge. However, two years after the decision to ban the sale of internal combustion engine (ICE) vehicles from 2035, it appears that - outside the upper segments of the market - electric vehicle (EV) adoption by the middle class remains far below the European electrification trajectory targeted by the regulation. This situation risks jeopardizing both the achievement of climate goals and the sustainability of the European automotive sector, which faces a triple penalty: having made massive investments in electrification, failing to reach the volumes needed for profitability, and potentially incurring heavy fines at a time when manufacturers most need to invest. In this critical context, the CO Regulation review clause represents a major opportunity to collectively assess the impacts of the current regulatory framework and initiate short-term adjustments necessary to better align climate objectives with the preservationand even strengtheningof the European automotive industry

Please refer to the attached document. As a summary, The automotive industry supports the EUs Data Act, which promotes data availability and a more transparent, efficient data economy. It calls for a stable, consistent regulatory framework to support investment and long-term growth. New obligations should be avoided unless justified by thorough impact assessments and alignment with existing rules. Legal uncertainty from premature changes must be avoided. The Data Act already provides a solid basis for data sharing, including for SMEs and research. Additional frameworks risk adding costs without clear benefits, potentially harming competitiveness and increasing vehicle prices.

Response to Format of the carbon footprint declaration for batteries

The National association for French OEM and Tier 1 suppliers (PFA) welcomes the draft Implementing Regulation establishing the format of the carbon footprint declaration for batteries in accordance with Regulation (EU) 2023/1542 of the European Parliament and of the Council. The automotive industry is transitioning to fossil-free products and PFA members believe that in all their actions, they must consider how to reduce climate impact, use of the worlds resource more efficiently and conduct business more responsibly. PFA would like however to highlight some concerns and recommendations on the proposal for the delegated act. We are fully in line with the disclosure of the total CO2-equivalent emissions throughout the battery's life cycle, measured in kg of CO2-equivalent, in the public version of the carbon footprint study. However, this value is not reported in the standard format of the carbon footprint declaration, which makes it less beneficial for customers who are looking for environmentally friendly batteries. Declaring the 'total amount of CO2 equivalent in kg CO2-equivalent' in the common format described in the implementing act would be more helpful for customers. We suggest that this value be included in the standard format.

Response to Initiative on EU taxonomy - environmental objective

Constructeurs, équipementiers et manufacturier de pneumatiques de la filière automobile française réitèrent leur plein engagement dans la décarbonation du secteur des transports et souhaitent bénéficier équitablement des opportunités mises en place par la taxonomie. En ce sens, les modifications proposées et qui font lobjet de cette consultation représentent un effort dans la reconnaissance du large spectre dactivités concerné. Cependant quelques rédactions restent ambiguës ou insuffisantes, et nous demeurons à la disposition des autorités, françaises comme européennes, pour en retravailler le contenu et en assurer la pleine efficacité environnementale. Response to Development of Euro 7 emission standards for cars, vans, lorries and buses

La Commission Européenne a publié sa proposition pour Euro 7 le 10 novembre dernier. Elle propose une évolution des exigences réglementaires pour les émissions des véhicules légers et lourds. Cette proposition arrive quelques jours après la confirmation par lUnion Européenne de la fin des véhicules légers thermiques et hybrides en 2035, en nautorisant à partir de cette date que la vente des véhicules dits « zéro émission à lusage » (essentiellement électrique à batterie ou à pile à hydrogène). La décision de faire du véhicule 100% électrique la solution unique, pour les véhicules légers, afin de répondre au défi du changement climatique nest pas le choix de lindustrie automobile, mais, dès lors que la décision a été prise, lensemble de la filière automobile se mobilise pour sy conformer, en réalisant des investissements massifs dans des délais très resserrés. Imposer dans ce contexte de nouvelles normes démission à léchappement pour les futurs véhicules légers thermiques dici à 2035 ne nous semble pas cohérent ni efficace pour les raisons suivantes : - La norme en vigueur, Euro 6d Full, est très récente (entrée en vigueur tout type depuis 2021) et amène un progrès structurel par lintroduction du protocole RDE. Sa généralisation dans le cadre du renouvellement du parc de véhicules aurait un impact de premier ordre sur la qualité de lair, équivalent voire supérieur à lintroduction de la norme Euro 7, en tenant compte des surcoûts véhicule induits et des effets associés sur le ralentissement du renouvellement du parc. - La mise en place de nouvelles exigences pour une technologie condamnée par ailleurs par la réglementation conduit à distraire de la transition vers lélectrique une partie des moyens humains et financiers disponibles et à augmenter les coûts des constructeurs, dans un contexte où le défi numéro un est de réussir à rendre abordable les véhicules électriques pour le plus grand nombre. Compte tenu de ces éléments, et pour réussir la transition énergétique en cours, la PFA souhaite que les efforts sur la réduction des émissions soient recentrés dans le projet Euro 7 sur les volets qui ne sont pas spécifiques aux véhicules thermiques. De la même façon, pour les véhicules lourds, la proposition de la Commission va ralentir les investissements en faveur de lélectromobilité dans laquelle les constructeurs se sont engagés. Il nous semble en tout état de cause indispensable dattendre la proposition de la commission européenne sur les émissions de CO2 pour se prononcer, dans un souci de cohérence entre deux réglementations sappliquant aux mêmes produits.

Response to Data Act (including the review of the Directive 96/9/EC on the legal protection of databases)

The PFA (Plateforme de la Filière Automobile) welcomes the European Commission’s Data Act proposal and its intention to increase the breadth and depth of data usage within the European Single Market. In our attached position paper (short version), we provide general feedback on the text to feed the legislative debate. The Data Act text sets a regulatory framework for so-called fair access to data generated, as far as the automotive industry is concerned, by connected vehicles. The text needs to be clarified on the aspects raised in our paper, notably the definition of data, products, user, but also on what is accessibility by default, measures of cybersecurity, definition of safeguard for IP, future of Sui generis right for database and entry into force of the text. Clarification and amendments will be necessary that land to a text that will harmonize the implementation of these Act principles in the entire automotive industry, which is the best way to work on the development of the whole connected mobility value chain.
