Response to Revision of the specifications for EU-wide Multimodal Travel Information Services (Delegated Regulation 2017/1926)

Amadeus welcomes the Commissions initiative to update Delegated Regulation (EU) 2017/1926 on multimodal travel information services (MMTIS). Amadeus fully supports the expansion of data to be shared through national access points to dynamic data on disruptions, real-time status information, vehicle occupancy, etc. While this initiative is welcome and necessary, it is not sufficient to make multimodal travel a reality in Europe. The MMTIS Regulation needs to be complemented by the upcoming proposal for Multimodal Digital Mobility Services (MDMS). Such services can only be developed if travelers are free to compare, combine, book, obtain tickets and pay for all available modes and offers. For this to happen, large transport providers including incumbent rail operators and large airlines must be obliged to share relevant and bookable content with intermediaries on fair, reasonable and non-discriminatory terms and conditions. Response to Possible revision of the Code of Conduct for computerised reservation systems (CRS)

Amadeus welcomes the Inception Impact Assessment of the CRS Code of Conduct. Amadeus believes that a significantly revised and updated CRS Code of Conduct is needed to correct serious competition challenges in the EU airline ticket distribution market. As already highlighted by the Commission, the current text of the Code of Conduct is not fit for purpose and must be amended to protect and reinforce the European Single Market in aviation and to ensure consumer choice. Amadeus supports a revised, updated and effectively enforced CRS Code of Conduct, but only if it ensures that: • Consumers have access to an unbiased choice of air fares; • A level playing field exists between all competing players in the air ticket distribution market; and • Small and large carriers compete on equal terms and on the merits of their offers As explained in more detail in our attached position paper, the policy option number 3) ‘’ Partially repeal the Regulation on the CRS Code of Conduct, while updating the scope and other remaining provisions to take into account market developments’’ could be a viable option but only if specific conditions are included in the revised text such as (see further details in the position paper): 1. A new definition of scope is required, taking into account the current dynamics of competition in the airline ticket distribution market. 2. Neutrality and non-discrimination obligations of the Code should be balanced with content quality and commensurate non-discrimination commitments by airlines. 3. A new Code must effectively address the issue of content commitments by airlines, in particular the large airline groups with market power that have an incentive to avoid neutral comparison and competition, in order to reinforce competition and enhance consumer choice 4. Definitions used in the new Code must be updated and based on the merits of what players do. In particular, the neutrality (Article 5.1) and transparency (Article 9) obligations of all players must be redefined and clarified. 5. For a new Code to be seen as relevant and effective, it must be effectively enforced 6. Assess potential overlap of Article 11 with GDPR rules. 7. Ensure reciprocity with the treatment offered to non-EU airlines and CRSs in the European Union (See Article 8). With regards to other policy options identified by the European Commission: On Option 1: Fully repeal the CRS Code of Conduct. The full repeal of the CRS Code of Conduct would be the best alternative if a revised CRS regulatory framework fails to address the market issues identified through the above proposed changes, or if a reasonable balance of stakeholder needs cannot be established by a new Code. Deregulation could also provide a level playing field, provided that EU competition law and other EU regulations address market failures described in this document. On Option 2: Issuing non-binding guidelines to clarify the scope of the Regulation without any legislative change would not improve legal certainty or resolve competition issues. In this option, players that should be subject to the Code to achieve a level playing field can ignore the guidelines, as they are not binding. We believe legal certainty to address these issues is demanded by all market participants and this can only be achieved through a new binding and enforceable CRS Code of Conduct or the full deregulation and repeal of the Code. Further details on the above mentioned issues as well as additional background information is provided in the attached position paper. Amadeus is pleased to continue working with the European Commission and industry stakeholders in this important assessment to reinforce the competitiveness of the airline distribution ticket market and secure consumer choice.

Response to Recast of Regulation (EC) 1371/2007 on rail passengers' rights and obligations

The proposed regulation does not sufficiently recognize that rail journeys are often part of a door to door journey that can involve multiple rail carriers or multiple modes of transport. While other transport modes are not in the scope of this regulation, it would appear that the regulation should include sufficient reference to other modes to facilitate a future regulation that covers a single European Transport Area, whilst the regulation should directly address passenger rights for interline Rail journeys, in terms of disruption, missed connections, and liabilities. A Code of Conduct (CoC) for multimodal transport reservation services containing provisions to ensure the supply of neutral and transparent information to consumers and to prevent abuse of competition would strongly reinforce passenger rights. The existing Code of Conduct for CRSs should be extended to all transport modes, and to any entity engaging in corresponding distribution activity (meta-search, digital service providers, direct connects). Similarly, the scope of article 5 on non-discrimination should be extended to cover transparency and neutrality requirements. In this latter respect, we would make reference to the Bach report on Passenger Rights in all Transport Modes (2012/2067(INI)) paragraphs 36 and 37 as follows: "36. Calls on the commission to ensure that ticketing and transparent pricing are available to everybody without discrimination, independently of the location or nationality of the consumer or the travel agency, and that price discrimination against passengers on the basis of their country of residence is more thoroughly investigated, and where identified, fully eliminated; 37. Calls on the Commission to deal with the transparency and neutrality of distribution channels which have developed outside the scope of Regulation 80/2009 on computerised reservation systems;" The neutral display and transparency obligations of the Code should be balanced with content quality commitments by railways that choose to participate in CRSs, to ensure that the neutral display offers genuine relevance and value to travel agencies and consumers In the event of disruption, passengers are generally well informed about the current leg of their journey. However, there is generally insufficient information relating to connections both for multiple RU rail journeys. Amadeus therefore welcomes additions to article 9 on travel information, in particular with regard to persons with disabilities.
