At eBay, we have long championed both sustainability and entrepreneurship as important common interest goals that help create opportunity for all. Our global marketplace empowers millions of small and medium-sized businesses (SMEs) to participate in global cross-border trade, including more and more in Recommerce, i.e. second-hand and refurbished goods that extend product life cycles and support the EUs green transition. In 2024, Recommerce on eBay helped support $5 billion of positive economic impact, and avoid 1.6 million metric tons of carbon emissions and 70,000 tons of waste globally. As of 2024, over 40% of sales facilitated by eBay come from pre-owned and refurbished items. As such, we welcome the Commissions call for evidence on the possibility to revise the New Legislative Framework. As a key facilitator of circular trade in the EU, we expose below our comments including some targeted recommendations for a potential future NLF revision. Key recommendations: 1. Have the NLF build and expand on existing definitions and obligations for second-hand products and their operators, following recently adopted EU legislation. 2. Enable the voluntary creation of partial Digital Product Passports (DPPs) by second-hand operators to improve traceability and consumer trust. 3. Consider recognising equivalent conformity assessments for second-hand goods imported from key partner countries. 4. Clarify how placing on the market applies to second-hand goods and tailor conformity-related obligations to the real capacities of circular economy actors. 5. Allow EU-based distributors to assume economic operator responsibilities when the original manufacturer is unavailable or uncooperative; 6. Adapt enforcement frameworks and procedures for the future by expanding the use of AI/digital tools as well as enhancing coordinated enforcement actions at the EU level.

eBay welcomes the opportunity to contribute to the Commissions evaluation of the effectiveness, efficiency and continued relevance of the DAC and its amendments, as well as its coherence with other policy initiatives & priorities and the EU added value. While we understand that the evaluation officially spans from the original DAC to its 6th amendment, we would like to share input on its 7th amendment as being the most relevant to our company as an online platform service provider, and to the extent that we have already been able to measure its impacts, both on our own compliance process since its adoption in 2021, and on our users since we initiated the collection of data as required by the DAC in 2023. Through the supporting document, we understand that the European Commission is looking for stakeholders to share their views on several aspects of the DAC and its amendments. We welcome the opportunity to share feedback on the package recently brought forward by the Commission, composed of a proposal for a new Regulation on the Union Customs Code, EU Customs Data Hub and EU Customs Authority, a proposal for amending the Regulation on the system of reliefs from customs duty and the tariff and statistical nomenclature, and a proposal for amending the VAT Directive on its provisions related to distance sale of imported goods. While we support the EUs ambition to make customs processes and controls more efficient and harmonized, we think that this important evolution should be carefully conducted and carry proportionate obligations and responsibilities for all players involved, including online marketplaces like eBay. We also challenge the proposal made by the European Commission of entirely removing the 150 EUR de minimis exemption on customs duties, for reasons further detailed in the attached document. As one of the first online marketplaces to be launched over 25 years ago, eBay has in-depth long-time experience connecting buyers and sellers online. Today, eBay gathers more than 132 million active buyers and millions of sellers globally, both individuals and businesses, which include a large number of small and medium-sized companies (SMEs). At any point in time there are around 1.9 billion listings live on eBay platforms around the world. eBay empowers SMEs to create their own digital storefront and to control their strategy, customer relationship, product marketing and delivery. In fact, as a pure third-party marketplace, eBay never sells its own products and never competes with its sellers. Moreover, eBay does not hold, ship or deliver any of the goods sold via its platform. Our key recommendations include: - Explicitly rule out any non-financial liability stemming from the deemed importer status - Implement good faith clauses to protect deemed importers against miscategorized goods - Align the date of application of the deemed importer regime with the availability of the EU Customs Data Hub - Rescind the removal of the 150 EUR de minimis

Response to Ecodesign for Sustainable Products - Product priorities

eBay welcomes the opportunity to provide feedback on the consultation to identify the New product priorities for Ecodesign for Sustainable Products. We appreciate the Commissions initiative to ensure a more environmentally virtuous Single Market for consumer goods and to promote the growth of the circular economy for European small businesses. At eBay, we find ourselves at the heart of this growth. Founded in 1995 around the sale of a broken item, eBay has long been home to a large variety of offers, from brand new to second-hand, refurbished goods as well as repair parts. As a pure third-party marketplace, eBay welcomes both private individuals and small businesses to buy and sell on its site. Sellers are fully in control of their product pricing, sales and delivery, and are never made to complete against the platform. According to an eBay study released last November 2021, 78% of European small business sellers using our marketplace had sold non-new items, with second-hand and refurbished items representing 52% of their sales. By enabling millions of consumers and businesses to give a second life to goods, eBay can be considered a key player in the circular economy. Absent the Regulation itself addressing the specificities of the second-hand market more clearly, we recommend that, when looking at regulating specific product groups, the Commission takes into account circular economy products with a view to either excluding them from the scope of the regulated product groups or to exempting them from some of the requirements. These products include: Imported second-hand, repaired and refurbished products at large Works of art, collectors items and antiques Unique or handmade products More details about our feedback and recommendation can be found in the attached document.

As we collectively take conscience of the climate challenge ahead, consumers move towards more sustainable online shopping options. According to eBay data, the number of search queries for "sustainable" and "environmentally friendly" offers has increased by almost 100 percent from 2018 to 2019. During the economic recovery from Covid-19, European SMEs will have a great interest and opportunity in responding to the ever-growing demand for second-hand, refurbished, repurposed, ecodesigned or repairable goods. The ability for them to count on a stable, protective and clear legal framework in this context will be crucial. We welcome the opportunity to comment on the Commission’s planned Sustainable Products Initiative which we believe may have an important impact on the way SMEs use online commerce to distribute more sustainable products in the EU market. With our comments in the attached document, we hope to provide constructive views on some of the policy options that the Commission intends to explore as per this Inception Impact Assessment.

As we collectively take conscience of the climate challenge ahead, consumers move towards more sustainable online shopping options. According to eBay data, the number of search queries for "sustainable" and "environmentally friendly" offers has increased by almost 100 percent from 2018 to 2019. During the economic recovery from Covid-19, European SMEs will have a great interest and opportunity in responding to the ever-growing demand for second-hand, refurbished, repurposed, ecodesigned or repairable goods. The ability for them to count on a stable, protective and clear legal framework in this context will be crucial. In 2019, the European Union adopted the “New Deal for Consumers”, an ambitious reform to improve trust and transparency for consumers in the Digital Single Market era. While this legislation has yet to be implemented in many Member States, some measures, included either directly in consumer law or in other parts of legislation may help foster a larger supply in sustainable options for consumers, as well as more consumer trust in these options. The paper attached to this submission details such measures including, among others: - Improve access to relevant product information - Build trust into emerging sustainable trade options such as refurb - Foster a healthy repair market - Focus on positive incentives for better access to sustainable consumption - Increase waste management options for consumers by simplifying Extended Producer Responsibility compliance for SMEs

Response to Digital Services Act package: ex ante regulatory instrument of very large online platforms acting as gatekeepers

eBay welcomes the Commission's intention to adopt an ex-ante regulatory instrument. The creation of the internet has led to the emergence of new economic opportunities and diverse business models. The emergence of online intermediaries, together with the increased availability of information and data, have led to increased consumer choice, access to information and new economic opportunities. Many of these recent digital innovations have significantly benefited European citizens. For example, 98% of small businesses in the EU using eBay engage in exports. On average these businesses reached 21 different countries in 2018, compared to 4 markets for traditional businesses. In addition, approximately 40% of eBay enabled small businesses export their goods to more than 4 continents. Perhaps the most momentous recent development of the digital economy is the digital ecosystem platform. Usually with a dominant platform at the core, an ecosystem company then operates a variety of complementary, interlocking businesses and services that often span several markets while being technically (and financially) integrated with the core platform. In light of this, discussions regarding the need for regulation to complement competition law have emerged. Regulation that addresses anti-competitive practices that require to be treated in a timely manner to prevent irreparable harm from occurring, as trying to reverse the situation ex post may be very difficult. We agree with the European Commission that certain platform ecosystems leverage access to large amounts of data from one area of their activity to improve or develop new services in adjacent markets. We also welcome the fact that the Commission acknowledges that such large online platforms increasingly bundle a broad range of platform- and other digital services into a seamless, data-driven offer. We therefore welcome the opportunity to stress that current competition law and enforcement should be supplemented by new legislation, because the inherent conflict of interest within large digital ecosystem platforms invites certain practices that suppress fair competition in Europe, as rightly identified by the European Commission. The intention to adopt an ex-ante regulatory framework is the right direction, in particular Policy Options 3, together with 3a and 3b. The objective of such regulation should be to intervene more rapidly than can be achieved through current (ex post) enforcement. The public policy objective is clear: to avoid a future where a handful of “digital conglomerates” dominate most markets and competition is confined between these ecosystems.

Response to Report on the application of the General Data Protection Regulation

eBay welcomes the opportunity to comment on the application of the GDPR. eBay respects and supports the protection of privacy rights and the rights of individuals to control their personal data. As such, eBay’s comments on the GDPR and its application in the domain name space go to the heart of GDPR and how certain clarifications could be applied to strengthen the GDPR’s purpose. We therefore hope the Commission the following points in its review of the GDPR’s application. First, GDPR Article 5(1)d enumerates the accuracy principle and eBay suggests that clarification around Article 5 would bolster the intent of the GDPR and support individual rights. Specifically, clarifying that (1) accuracy obligations are not merely reactive but, rather, require controllers to take reasonable steps to verify the accuracy of data at the point of collection depending on the circumstances, in particular, the nature of the personal data and what it is used for (and before such data is included in important databases), and that (2) third parties who rely on authoritative databases are able to invoke the GDPR to notify controllers about and have corrected inaccuracies, would greatly improve the outcome of Article 5. For example, the authoritative WHOIS database (the global record of internet domain name registrants) relied upon globally for the operation of the internet should not be filled with inaccurate data and corrected only once the data subject finds that the data contained in such an important database is incorrect. Second, clarification of the GDPR’s Article 6(1)e and the ability to process data for a task carried out in the public interest would be helpful and welcomed, specifically with regard to databases as important as WHOIS. Clearly, such a database, relied upon globally for internet transactions and investigations, supports the public interest of maintaining a globally stable and secure internet. As such, it would be helpful to clarify how Article 6(1)e could be applied to data processing in the context of a database such as the WHOIS database, even where government actors are not involved in maintaining such a database or EU or member state law does not lay down specific requirements for the processing. Finally, eBay notes that when the public relies on an important database (such as WHOIS) for investigations and commercial transactions, the law’s purpose is strengthened from the capability to process data for the establishment, exercise or defense of legal claims (just as such latitude exists throughout the GDPR for numerous other processing activities). The Commission has an opportunity to clarify that Article 6 permits processing for this very reason -- something that would support individuals who seek to defend legal claims or who would benefit from the pre-adversarial contact that would be afforded by such processing when dealing with internet matters.
