Response to Technical specification for interoperability relating to the telematics subsystem of the rail system

FS Italiane would like to highlight the following key aspects, crucial for the Regulation's effectiveness: - Implementation Deadlines and Realistic Timeframes: Deadlines set out in the regulation appear unrealistic, particularly given the delays in the revision process and the introduction of new requirements. FS believes it is necessary to adjust the deadlines to allow railway undertakings and infrastructure managers sufficient time to adapt to the new regulations without compromising service quality. Our Group emphasizes the importance of a longer transition period to address the complexity of the required adaptations. - OSDM Integration: FS considers that the partial integration of OSDM into the regulation through the use of the TAP B.5 protocol limits the full potential of the model. The restriction of functionalities prevents the full interoperability between railway undertakings and ticket distributors, directly impacting the quality of service provided to passengers. FS recommends a revision of the regulation to allow for the full integration of OSDM or, at the very least, that the OSDM-related aspects be kept as open points until discussions on the full integration of OSDM are finalized. - Role of the LRU: The introduction of the new role of Lead Railway Undertaking (LRU) presents significant challenges, as it implies responsibility for processes outside the direct operations of the railway undertaking. For example, managing timetable data is complicated by the separation of timetables between different railway undertakings and the lack of standardization across countries. Additionally, the legal liabilities associated with the LRU role require further clarification, as the LRU would be held accountable for aggregated data despite having limited control over how other RUs and NAPs handle their data. - Traffic and Train Composition Data Management: Another critical point concerns the proposal to make train traffic and train composition data publicly available. FS shares the concern that this could violate commercial confidentiality, especially regarding freight operations. FS believes that such data should not be made public but only shared with relevant stakeholders in the logistics chain. In any case the IM must not be obliged to publish train composition data for freight trains, it shall be demanded to Freight RUs. Clear definitions of train composition data and train traffic data are needed to avoid ambiguity and ensure protection of sensitive commercial information. - Safety Requirements and Non-Safety-Related Messages: FS Italiane opposes the imposition of safety-related requirements for telematics messages that are not related to safety functions, such as those concerning train preparation or train composition. Existing regulations, including the TAF TSI and OPE TSI, distinguish between safety-related and non-safety-related messages. FS proposes that stakeholders should be free to use such messages for safety purposes through bilateral agreements but this should not be a mandatory requirement. - Transition from XSD Formats to Ontology: FS considers that the proposed transition from XSD format to Ontology (RDF) for telematics messages, while a long-term objective, should not occur until the Ontology is fully developed and tested. The transition should be gradual, supported by an impact assessment and a cost-benefit analysis to ensure that the new system provides real value to all stakeholders. The implementation of several of the provisions and requirements included in the draft Regulation is not feasible based on the current wording, which is very general and subject to different interpretations. We urge the European Commission to redraft the text with a view to ensuring clarity and a sustainable, cost-efficient and business-efficient implementation, including shifting the non-mature requirements as open points.
