Coop de France salue la proposition législative de la Commission européenne publiée le 12 avril dernier sur les pratiques commerciales déloyales en BtoB. Pour les produits alimentaires circulant au sein du marché communautaire, l'harmonisation d'un minimum de règles est assurément nécessaire pour éviter les distorsions de concurrence entre États membres. Toutefois, Coop de France considère que ce projet de directive pourrait être amélioré sur divers points afin de rendre plus effective la lutte contre les pratiques commerciales déloyales entre professionnels du secteur agricole et alimentaire. Dans ce dernier, nous apportons nos éléments d’analyse sur les points proposés par la Commission : pratiques commerciales déloyales, transparence des marchés et les accords pour un meilleur partage de la valeur. Nous complétons cette analyse par des éléments qu’il nous paraît important de considérer lorsque l’on s’interroge sur le fonctionnement de la chaîne alimentaire en Europe : Droit des concentrations, coopératives et marchés pertinents, et droit des ententes.
