Response to the Public Consultation on the Quantum Strategy of the EU Quantum technologies are crucial for Europe's digital autonomy, impacting defense, critical infrastructure, telecommunications, and the technological ecosystem. Spain's robust quantum ecosystem, including key players like Telefónica and various startups and research centers, is pivotal in this development. Quantum Communications and Cybersecurity: Quantum computing poses a threat to current cryptographic methods, necessitating the adoption of PQC and hybrid systems. The EC and various EU Member States have recommended transitioning to PQC. The European Telecommunications Standards Institute (ETSI) is developing standards QSC and QKD. Telefónica is a leader in this area, integrating quantum technologies into its operations and infrastructure. The implementation of quantum technologies in cybersecurity should be approached in two phases: short-term adoption of PQC and long-term development of QKD and Quantum Random Number Generation (QRNG). Quantum Computing and Simulation: Developing a competitive quantum computing infrastructure in Europe is essential. This includes creating national quantum computing centers and fostering strategic agreements with global quantum computing manufacturers. Telefónica's collaboration with the Provincial Council of Biscay and Fujitsu is an example of such efforts. Combining quantum computing with AI initiatives is also crucial for future competitiveness. Sensorics and Quantum Metrology: Quantum technologies enhance measurement precision, impacting various industrial sectors. Synchronization, calibration, and standardization processes can be significantly improved, reducing error rates and democratizing access to standards. Companies like Telefónica can play a significant role in integrating these technologies into their operations and establishing communication networks to facilitate access. Public Policy and Funding Proposals: To ensure the deployment of quantum technologies in Europe, coordinated public investment and public-private partnerships are necessary. Proposals include reallocating unspent funds from existing programs, negotiating future financial frameworks, and creating incentives for adopting quantum solutions in strategic sectors. An IPCEI on Quantum Communications is suggested to fund national QKD networks and ensure their interoperability at the European level. Public support should address market failures and incentivize the deployment of quantum infrastructures, with aid intensities like those in the telecommunications sector. The EU quantum strategy must support secure communications, quantum sensing, and quantum computing through coordinated funding and policy tools. Promoting interoperable national Quantum-Safe networks, upgrading obsolete infrastructure, and fostering hybrid classical-quantum architectures are essential steps. Encouraging adoption in public administration can boost the market for these solutions and generate a spill-over effect on the private sector. Funding pilot tests and certifications in real environments, developing test-beds, and fostering technology clusters are crucial for validating use cases in strategic sectors. Launching training and reskilling programs for researchers, engineers, and ICT professionals is essential. Specializing professional profiles in quantum security (PQC, QKD, QRNG) will ensure a competitive quantum ecosystem. Conclusion: Europe could lead in quantum technologies, securing funding for Quantum-Safe networks and leveraging its innovative quantum ecosystem. A fresh approach to competition policy and strategic public procurement will be essential for achieving technological and digital autonomy. Response to Single Market Strategy 2025

Telefónica welcomes the opportunity to provide feedback for this Call for Evidence and to present its contribution. The Single Market has successfully established a barrier-free space for the movement of goods, services, capital, and people across the EU, efficiently mobilizing resources, and boosting prosperity. However, regulatory and legal barriers now threaten the "four freedoms", causing harm to European competitiveness akin to the original border barriers. The Single Market's shift towards a "harmonised market" risks creating obstacles to these freedoms if uniform regulations or their uneven implementation undermine its foundational principles. The Letta and Draghi reports emphasize the need to restore these principles as part of an industrial strategy for Europe, to counter lagging innovation and competitiveness. They identify telecoms and digital innovation as key transversal areas for strengthening the Single Market and improving industrial competitiveness and resilience. In this context, the Digital Single Market aims to enable European industry and society to seize the opportunities of the digital age, with telecoms at its heart. This sector drives innovation and investment in ultra-broadband networks and technologies such as 5G, AI, and cloud computing, key enablers of EU-wide progress. Reliable, high-quality connectivity across Member States is fundamental to digitalisation, facilitating the seamless flow of goods, services, capital, and people across all sectors, and the scale-up of digital services. Initiatives restoring the four freedoms in telecom markets should be seen as cross-cutting for other European markets. However, regulatory barriers hinder the sectors capacity to invest and innovate. The main consequence is the artificial market fragmentation of local markets. In-market consolidation is particularly important to achieving the local scale - sufficient take-up in the areas of deployment of fixed and mobile networks - necessary to attract investment, support long-term network roll-out and provide advanced, resilient infrastructure. This would deliver greater value for consumers through more choice, improved services and increased innovation without necessarily raising prices. In this sense, merger control policy in the EU has had the unintended effect of creating barriers to the freedom of capitals in the electronic communications market, specifically through exit barriers in the form of imposed remedies to merging parties. We see this as the sector's main barrier to achieving a Single Market. Meanwhile, virtualization, cloudification, and initiatives such as Open Gateway offer the potential for cross-border digital services but depend on high-quality local fixed and mobile infrastructure, which in turn requires sufficient scalecurrently hindered by regulatory obstacles. On top of this, the telecoms sector faces challenges from existing sector-specific regulation, which have led to significant regulatory asymmetries between telecom operators and large digital companies in key markets. A level playing field across the EU is essential to prevent regulatory arbitrage between providers of similar services. In line with Draghis recommendation, we support the reduction of ex-ante regulations that restrict single market freedoms. Priority should be given to horizontal frameworks, eliminating sectoral approaches. For example, the GDPR addresses privacy concerns, making sector-specific rules like 'ePrivacy' redundant. It is also essential to provide additional guidance on network neutrality and Open Internet rules to support innovative use cases, such as those enabled by 5G network slicing and Open Gateway. Striking a balance between regulation and innovation is crucial for technological progress and fostering a dynamic EU digital ecosystem. We attach Telefonica's Single Market position, and a document with evidence of barriers, hoping to support a future-proof strategy for all EU citizens and businesses.

Response to Rules specifying the obligations laid down in Articles 21(5) and 23(11) of the NIS 2 Directive

Telefónica welcomes the opportunity to comment on the draft implementing act under the NIS2 Directive on Cybersecurity Risk Management and Reporting for Digital Infrastructure and Service Providers. We highlight some aspects in the attached document, in particular the need for consistent and proportionate application of security rules across European and national legislation. In this context, it is important to note that the Better Regulation agenda aims to ensure that EU legislation is evidence-based, transparent and takes into account the views of stakeholders in order to deliver sustainable policies and efficient, non-burdensome regulation. We call for the use of international standards to ensure harmonisation, proportionality and efficiency on risk management, rather than the introduction of new requirements, and for the establishment of clear, technology-agnostic criteria for identifying significant incidents to avoid over-reporting and ensure that relevant incidents are adequately addressed. Any changes to the NIS1 thresholds for 'significant incidents' should include a gap analysis of needs, costs and national approaches to ensure proportionality and avoid over-reporting. We suggest that the supply chain proposals be assessed as they may prove overly burdensome, particularly for SMEs, and request a grace period for implementation.

Response to How to master Europe’s digital infrastructure needs?

Telefónica welcomes the European Commissions White Paper (WP) How to master Europes digital infrastructure needs? and the opportunity to provide feedback. The WP recognizes the challenges the telecom sector is facing in Europe and rightly considers broadening the objectives of the regulatory framework beyond end-user protection and promotion of competition by considering industrial competitiveness, economic security, and sustainability. However, lacks concrete proposals and timetable blurring the way forward. The next 12 months are vital. Telefonica urges the European Commission (EC) to draft a legislative proposal, to be effective in the shortest time possible, that effectively addresses identified challenges: a Digital Networks Act (DNA) interpreted as the instrument defining the policy framework for the next decade. DNA should lay the foundations for a new simplified framework removing regulatory restrictions and reduces operational and administrative costs for network operators aiming to achieve a true single market for electronic communications. This new policy framework should: ENABLE INVESTMENT-FRIENDLY MARKET STRUCTURES Scale at local level is urgent and critical for EU telecom operators to be sustainable and profitable and attract private investment. Operators achieve return on investment when there are more customers over the deployed infrastructure at local level. In addition, in-market scale will deliver great benefits to consumer welfare as would foster sustainable network players able to invest in the most advanced, secure, and resilient networks. The review of the EU Merger Regulation is key to responding to new market realities and challenges. REBALANCE THE DIGITAL ECOSYSTEM: INTRODUCING A FAIR NEGOTIATION OBLIGATION AND A DISPUTE RESOLUTION MECHANISM TO COUNTER BARGAINING POWER OF CAPS EC should establish a dispute resolution mechanism to ensure that large Content and Application Providers (CAPs) agree a fair and adequate terms with ISPs for valuable IP data transport service received for cases where commercial negotiations fail. Setting a price for the valuable IP data transport service ISP provide to CAPs would not only restore balanced bargaining power between the parties but also incentivise all key players to use network resources efficiently. PROMOTE INNOVATIVE EU DIGITAL SERVICES: i) Repeal of the e-privacy directive. All digital actors should be subject to the same horizontal privacy rules: GDPR. ii) Open Internet Regulation (OIR) Guidelines. EC should urgently issue a Recommendation that will set out how the current framework should apply to new developing use cases: 5G network slicing and innovative traffic management techniques. Iii) Cloud/Edge services: adopting measures enabling Telco sector evolution. A new common framework should set minimum obligations to balance relationships between Electronic Communication Network (ECN) and cloud infrastructure providers guaranteeing ECNs can keep fulfilling their obligations. REDUCE OVERLY INTRUSIVE REGULATION ON ECN Derogate current SMP regime, eliminate ex-ante obligations and shift to an ex-post model based on competition law and symmetrical regulation of access to passive infrastructures (GIA). Where competition is not present, ex ante measures could be imposed by means of an active wholesale product. Symmetric ex ante regulation (e.g. cost-oriented tariffs on MTRs/FTRs and roaming) should be reconsidered as holding back competitiveness and investment. MAKE SPECTRUM POLICY A LEVER FOR INVESTMENT AND GROWTH i) Create strong expectations of renewal of existing rights. ii) Prevent future scarcity in low and mid-bands by allocating such frequencies based on rigorous and transparent socio-economic cost-benefit analyses. iii) Ensure future awards dont result in inefficient outcomes or disproportionate prices and conditions. Response to Virtual worlds, such as metaverse

Telefonica thanks the opportunity to provide its view on virtual worlds and Web 4.0, a future that some call the Metaverse, as being all of them, expressions of what will be the next generation of digital services that will pervade all aspects of our lives. The digital transformation that the concurrence of technologies like (to mention some) virtual reality, augmented reality, 5G, Edge Computing, blockchain, digital twins, NFTs and the economies related to them, will ground the future of Europe in many aspects, affecting citizens, companies, and governments alike. It is a timely consultation as the previous experience with the development of digital services over Internet, created some unforeseen consequences that challenge Europe values in many aspects, as already depicted by the EC in the Call for Evidence section Problem the initiative aims to tackle. Telefonica wants to call the EC attention to the following aspects on the virtual worlds: The personal data treatment in virtual worlds must differ profoundly from the situation created on the Internet. Peoples privacy and rights must be assured from design. Many jobs of the future, as well as peoples economy will be in these virtual worlds, so it is paramount to give back to the people the control of their data. Europe needs an interoperable and universal Digital Identity that allows citizens to move through different platforms, services or places as it is in the real world. Citizens must be made available to exercise its rights following the philosophy of minimum exposure and, at the same time, be accountable. One of the foreseeable technical solutions is to use blockchain(s) to this purpose though this technology presents some issues with current GDPR. The interoperability must also be considered in virtual worlds, allowing people to use its digital belongings and defend its property. In that sense, when we talk about copyrightable assets living in virtual words, we need to look back to the legal frameworks that already exist in real worlds with the maxim of all rights that exist offline, must also be protected online to ensure legal certainty. In order to assure the foregoing, some adjustments may be necessary when regulating human interaction in digital worlds to ensure solid frameworks for specific uses of copyright protected works in the new virtual scenarios. Networks to access the virtual worlds are also paramount. It is important to note that the traffic that will traverse networks will increase exponentially (even more than today increases) not only because the demands of front end technologies, such as virtual reality or augmented reality, but also by the traffic that back end technologies will demand, such as those related to Digital identity and copyrights enforcement, industry sensitive data from factories to cloud (edge cloud/computing) where Digital Twins will run, etc. Therefore, it is important to understand that virtual worlds are not just more Internet, it is something way more important. Furthermore, this increase of traffic will be accompanied with a more exigent performance in terms of traditional quality of service as well as for cybersecurity requirements. These network deployments are the duty of operators, but Europe must assure that a policy framework that allow the sustainability of them is in place. We accompany this answer with the Telefonica position paper on this matter called Telecommunications networks and the Metaverse that applies equally to virtual worlds and Web 4.0.

Response to Initiative for reviewing and prolonging the “Roaming Regulation”

Telefónica welcomes the opportunity to comment on the EC’s adopted act on the review and prolongation of the roaming regulation. Due to the format limitations for the feedback, more information is provided in the attachment. The reduction of more than 20% of the price caps is clearly disruptive, particularly under the current circumstances. The effect of the COVID crisis on traffic patterns and the challenging requirements for investment in 5G rollout are not considered when fixing the reduction of the caps. As the main background work was carried out before the COVID crisis, its effects could not be considered in the legislative proposal, so there is no way to maintain the conclusions that were drawn before the crisis. This is particularly relevant regarding the wholesale caps that were based on exponential traffic growth expectations not materialized and far from being achieved. The transition from 4G to 5G is not adequately taken into consideration either. The caps are particularly too tight to provide the necessary flexibility and will limit M2M/IoT pricing schemes as the differential attributes of 5G networks could not be considered Obligations on QoS introduce market distortions and regulatory uncertainty. Telefónica considers that the obligations introduced in the proposal go beyond the aim of providing more transparency for the customer and of preventing operators from artificially hinder access to all available technologies and could have unintended consequences. In our opinion, the term “QoS” is a broad concept so, in any case, it should be defined as access to a certain technology. Otherwise the wording is open to interpretation, which can create legal uncertainty, as the provision is not referred to the general QoS assurance when roaming, but to the relative QoS compared to the home network. Nevertheless, Telefónica considers that QoS/access to a certain technology is an important element of competition, to which customers respond both at retail and wholesale level. Operators select on which networks in each country to place the largest parts of their traffic volumes, in order to (i) run an efficient operation that delivers a quality-price ratio consistent with their competitive strategy and (ii) differentiate at retail level, which is an important motivation to innovate. This competitive dynamic is working properly and there is no apparent reason for it to be regulated. A more structural solution is needed to address the issues related to VAS. Despite the VAS numbering database could be a step forward, the proposal lacks specific measures and improvements aiming to limit fraud for this type of services. Accordingly, roaming providers shall have the option to provide their customers access to VAS while roaming on an opt-in basis. In terms of transparency, a central solution such as a website from BEREC or the EU Commission would be advisable. The 112 service is working well for voice and call localisation when end-users are roaming. Telefónica considers that provisions included are not sufficiently concrete (“different possibilities to access emergency services” and “alternative means”) and may lead to an overload of welcome-SMS. It is important to note that the organization of emergency services is a responsibility of Member States and accordingly it should be guaranteed that the roaming Regulation will not transfer this responsibility of organizing PSAPs to telecom operators. The current flexibility in M2M services is still needed. Telefónica believes that the current regulation allows operators to put in place commercial roaming agreements and negotiate alternative price schemes that are better suited to M2M. This flexibility should be preserved in order to allow M2M systems to become mature and achieve a significant customer base. The same applies to the conditions that according to Article 3 can be included in reference offers in order to prevent permanent roaming or abusive use of wholesale access.
