Lewiatan Urges Longer Transition for BPA Restrictions in Food

Polish Confederation Lewiatan is the biggest trade association in Poland. We represent over 4,000 companies brought together in 34 industry and 20 regional associations. Over 20 companies are direct members of Lewiatan. Our members employ over a million employees. 1) We are of the opinion that in order to ensure equitable access to medicines for all EU Member States, a modulation of the market protection instead of the data protection would enable off-patent manufacturers to develop and apply for a marketing authorisation after six years and then to market the product when the other exclusivities run out. This would improve the predictability of the system by allowing developers to properly plan regulatory filings. 2) In order to ensure broad access to medicines it is crucial to set up safeguards to prevent evergreening abuses of the incentive system: There are evidences of the abuse of existing incentive schemes to artificially extend monopolies for blockbuster drugs. It is of crucial importance to ensure that the modulated protection system cannot be misused to create legal uncertainty and to delay competition from b generic and biosimilar medicines. Decisions to extend protections should be made transparently, through the timely publication of the variation process for obtaining the conditional additional years of protection, and there should be an administrative procedure for follow-on developers to challenge those additional protection where there is manifest misuse of the system for additional protection periods. 3) Since the EU has the longest period of regulatory data protection in the world, which delays access, affordability and availability, the cumulated period of data and market protection should be capped at the current maximum level of protection (11 years) and not extended to 12 or 13 years. 4) A system of transferable exclusivity vouchers for antimicrobials in our opinion is not a perfect solution. It creates a market where companies will have an option to buy a monopoly extension for blockbuster drugs. The antimicrobial resistance is a big problem but another solution should be seek. For instance, a cost-effective market policy should be introduced. It has been already mention in the Council Recommendation on stepping up EU actions to combat antimicrobial resistance in a One Health approach. We attach a position paper and views we are in line with. We believe approach presented therein should broaden acces to medicines in all EU Member States.

Response to Review of EU rules on payment services

1. No or limited use of PSD2 SCA exemptions and negative impact of SCA implementation on the user experience during the payment process It is important to note that there is no possibility (or it is limited) to use PSD2 SCA exemptions (Strong Customer Authentication), especially when it comes to PIS (Payment Initiation Services). As a result, the competitiveness and innovation of services based on PIS is severely limited. PSD2 SCA exemptions are not supported by the API and solution design. Undoubtedly, the PSD2 has been effective in increasing consumers' confidence that their data will remain secure during transactions but on the other hand some implementations of the SCA requirement cause a decrease of conversion rate during the payment while the fraud ratio stays untouched. It might suggest that side-effect of some implementations of the SCA has a negative impact on user experience during the payment proces. It is worth pointing out at this point that a convenient purchase process is a key to gain loyal and returning customers. Transaction monitoring solutions combined with payment instruments that allow applying SCA exemptions are a way to increase convenience during payments and limit the number of fraudulent transactions at the same time. 2. Significant difficulties in applying the 'Trusted Beneficiary Exemption' In business practice it is almost impossible to use the 'Trusted Beneficiary exemption'. To clarify, please note that most of the issuers of payment instruments do not provide opportunities for defining a Trusted Beneficiary. 3. The need for customer authentication by both the retailer and the issuer of the payment instrument We would like to emphasize the lack of the possibility of transmitting the result of the risk assessment of the transaction and, if applicable, information about the customer authentication already carried out, to the payment instrument issuer. The lack of such a possibility results in the customer being authenticated by both the retailer and the payment instrument issuer. At the same time it is also worth pointing out that with card transactions managed by card schemes such a possibility exists. Unfortunately, known implementations of PDS2 PIS do not provide such an opportunity.

Response to Revision of Food Information to Consumers for what concerns labelling rules on alcoholic beverages

Zdaniem Konfederacji Lewiatan w opublikowanym przez Komisję Europejską dokumencie „Wstęp do oceny skutków” (inception impact assesment) wprowadzenia obowiązkowego podawania składników i informacji o wartości odżywczej na etykietach wszystkich napojów alkoholowych, należy pozostawić opcję „0”, która umożliwia nadal dobrowolne podawanie wykazu składników i informacji o wartości odżywczej na etykiecie napojów alkoholowych lub w inny sposób, np. online, a jeśli informacja o wartości odżywczej jest podana na etykiecie, może być ograniczona do wartości energetycznej. Należy podkreślić, że etykiety produktów alkoholowych już teraz muszą zawierać mnóstwo obowiązkowych informacji, a ich powierzchnia jest zwykle ograniczona, co już powoduje problemy z ich czytelnością dla konsumenta. Informacje mogą być umieszczane w Internecie, a na etykiecie np. kod QR, który pozwoli włączenie odpowiedniej strony internetowej. Większość dorosłych chętniej skorzysta ze strony internetowej z pełnymi danymi niż będzie próbować odczytywać coraz mniejsze litery na etykietach, zapełnionych informacjami. Ponadto warto przypomnieć, że każda dodatkowa informacja na etykiecie czy opakowaniu pociąga za sobą koszty ich ponownego przygotowania i wymiany. Obowiązek dostosowania etykiet napojów alkoholowych do wymogu prezentowania na etykiecie informacji nt. wszystkich składników produktu, w wielu przypadkach będzie wiązało się z przeprojektowaniem butelki dla produktu, a to oznacza bardzo wysokie koszty do poniesienia przez producenta.

Dziękujemy Komisji Europejskiej za umożliwienie nam wniesienia wkładu w przegląd przepisów UE dotyczących informacji przekazywanych konsumentom. Konfederacja Lewiatan jest polską organizacją biznesową, reprezentującą interesy pracodawców w Polsce i Unii Europejskiej, skupiamy ponad 4100 firm zatrudniających w sumie ponad 1 mln osób. Jako Konfederacja Lewiatan popieramy wprowadzenie harmonizacji prawa, która ułatwi prowadzenie działalności gospodarczej, jednocześnie dbając o zdrowie konsumentów. W odniesieniu do wdrażania systemu etykietowania uważamy, że należy ustanowić jasne i przejrzyste ramy wprowadzenia, zarządzania, monitorowania i zmiany. Nauka o żywieniu, oczekiwania konsumentów i ograniczenia środowiskowe będą ewoluować; w związku z tym istotne jest, aby podmioty sektora spożywczego miały wgląd w terminy wdrażania i przyszłe zmiany systemu etykietowania. Proces powinien pozostać przejrzysty i otwarty na opinie wszystkich obywateli i zainteresowanych stron sektora spożywczego. W sprawie zmian w zakresie podawania daty minimalnej trwałości, doceniając wagę problemu marnowania żywności, proponujemy odstąpienie od pochopnego wprowadzenia rewolucyjnych zmian w tym zakresie, szczególności polegających na całkowitym odstąpieniu od obowiązku podawania takiej daty, czy też na wprowadzeniu nowych oznaczeń dotyczących daty minimalnej trwałości. Właściwą drogą w tym zakresie jest naszym zdaniem poprzedzająca wszelkie zmiany pogłębiona i oparta na dowodach analiza zarówno rzeczywistej percepcji tych zmian przez konsumentów, jak i ekonomicznych skutków proponowanych zmian dla przemysłu spożywczego i handlu. Zgadzamy się, że w celu ograniczenia marnotrawstwa żywności (wynikającego z braku zrozumienia przez konsumentów) należy stosować nadal tylko jedno oznaczenie daty (odpowiednio minimalnej trwałości lub przydatności do spożycia) na raz. Aby zapewnić satysfakcję konsumentów, tylko data minimalnej trwałości „Najlepiej spożyć przed” (oznaczająca okres zachowania najwyższej jakości żywności) powinna być umieszczana na produktach trwałych, podczas gdy w przypadku łatwo psujących się produktów spożywczych jedyną wskazaną datą powinien być termin przydatności do spożycia.
