Packaging industry urges EU to digitalise product compliance rules

Why — Digitalisation would help companies avoid repetitive packaging changes and lower administrative costs.3
Impact — Member States lose the ability to enforce unique national language and reporting formats.4

EUROPEN urges legal clarity for chemical recycling in plastic bottles

Message — EUROPEN calls for legal recognition of chemical recycling and mass balance accounting to meet targets. They argue that rules should cover only bottle bodies, caps, and lids, excluding labels.12
Why — Flexible rules would lower compliance costs and simplify administration for packaging manufacturers.34
Impact — Environmental groups lose as excluding labels reduces the total volume of required recycled plastic.5

Packaging industry urges EU to end single market fragmentation

Message — EUROPEN requests harmonized rules to prevent member states from creating divergent national requirements. They advocate for a mandatory Single Market test and stricter enforcement of trade rules.123
Why — Standardized rules would eliminate the high costs of redesigning packaging for different national markets.4

Packaging Industry Urges Infrastructure Investment Alongside New EU Rules

Message — The organization requests mandatory collection targets and obligations for Member States to invest in sorting and recycling infrastructure. They argue that sustainability requirements on packaging alone will not succeed without infrastructure capable of handling recyclable and reusable materials. They also call for exemptions for already-packaged products and clear timelines for secondary legislation.123
Why — This would give them more time to adapt production and reduce costs from redesigning packaging.45

EUROPEN, the European Organization for Packaging and the Environment, supports the overall objectives of the European Commission’s Ecodesign for Sustainable Products Regulation (ESPR) proposal to reduce the negative life cycle environmental impacts of products and improve the functioning of the internal market. The packaging value chain is constantly innovating to ensure the uptake of sustainable packaging solutions, supporting the EU climate and circular economy goals. This is done working together with product manufacturers to identify new solutions aimed at advancing the sustainability of both the packaging and packaged products, while continuing to protect products and ensuring their safe delivery to consumers and businesses. Response to Waste Framework review to reduce waste and the environmental impact of waste management

EUROPEN supports the general objective of the revision of the Waste Framework Directive (WFD) to improve the overall environmental outcome of waste management in line with the waste hierarchy and the implementation of the polluter pays principle. The review of the WFD must be carried out in line with the policy objectives of the European Green Deal and the new Circular Economy Action Plan, which set the basis for an innovation-driven policy agenda to pursue sustainable growth and encourage both ambitious and economically viable solutions to scale-up circularity and contribute to climate neutrality. When it comes to packaging and packaging waste, it is also important to ensure a strong alignment between this revision of the WFD and the ongoing review of the Packaging and Packaging Waste Directive (PPWD) and upcoming policy framework on bio-based, biodegradable and compostable plastics to maximise effectiveness and avoid inconsistencies. The review of the Waste Framework Directive must contribute to: 1. Strengthening the harmonisation and enforcement of EU regulatory requirements to improve recycling 2. Developing a well-functioning EU market for Secondary Raw Materials to achieve overall environmental benefits and drive the circular economy 3. Tackling inadequate collection of packaging waste to achieve the EU waste recycling targets 4. Response to Amendment of Regulation (EU) No 282/2008 on the recycling of plastic materials to be used as food contact materials

To protect the product, guaranteeing safety and hygiene for consumers, is a key functionality of packaging and the first priority for the food and drink packaging supply chain. It is also what drives the search of the most sustainable packaging solutions, including for the further uptake of recycled content. EUROPEN, the European Organisation for Packaging and the Environment, fully supports the objective of the draft Regulation on recycled plastic materials and articles intended to come into contact with foods to extend the plastic recycling capacity in the EU, and to increase recycled content in plastic products and packaging while ensuring a high level of protection of human health. The review of the rules on recycled plastic materials and articles intended to come into contact with foods must ensure policy coherence, enabling the ambitious environmental objectives of the European Green Deal and the new Circular Economy Action Plan, and support investments in innovation. As input to this consultation, we are providing specific comments on the draft text. You will find them in the paper attached, mirroring the structure of the proposed Regulation.

Response to Contingency plan for ensuring food supply and food security

EUROPEN – The European Organization for Packaging and the Environment - welcomes the Commission’s initiative to develop a contingency plan to ensure food supply and food security across the Union during emergency situations. The packaging value chain fully supports the objective of this initiative as the ongoing Covid-19 crisis has exposed the need to make the EU food supply chain more resilient. The EU contingency plan should be developed on the basis of the lessons learned from the Covid-19 health crisis. In this context, we wish to highlight the essential role of packaging in the delivery of essential goods during the unprecedented sanitary crisis by enabling the safety, accessibility, affordability and availability of food supplies across the EU. More specifically, the recent crisis clearly demonstrated the intrinsic role of packaging within the food supply chain. Packaging prevents spoilage and food waste by protecting food products and enabling these to remain fresh and safe for consumers longer. This function becomes even more important during emergency situations when, as an example, delays in shipping are incurred. This should be fully taken into consideration when designing a contingency plan to address any future crisis. Packaging is an essential component of the product groups which have been identified by the European Commission as critical following the pandemic outbreak. To support the self-isolation measures imposed by national governments, a well-functioning packaging supply chain proved to be particularly critical to ensure the uninterrupted delivery of packaged goods safely from factories, through retail and e-commerce, to consumers. As rightly pointed out by the European Commission, uncoordinated national responses during a crisis situation can worsen the problem of supply chain disruption at the EU level. For example, unilateral national reactions run the risk of leading to unintended negative effects on other Member States, as demonstrated by the initial disruptions experienced in the EU during the first outbreak of the Covid-19 pandemic. As a result of the measures taken by governments and the Commission to contain the pandemic, the packaging supply chain experienced a number of critical impacts: e.g. closures and disruptions in the operations of production facilities, obstacles to the circulation of packaged goods within the EU, delays at country borders for the delivery of (packaged) products and packaging materials. The level of coordination needed during time of crisis can be best achieved through coordinated action and policy consistency at the EU level. The crisis has shown that uncoordinated actions from Member States can also put at risk the integrity of the Single Market. The free movement of goods across Member States is a critical element to guarantee food supply during times of crisis. The future EU contingency plan should therefore fully recognise the key role of trade in ensuring food security and develop mechanisms to ensure the smooth functioning on the Single Market during times of crisis. EUROPEN and its members remain at the disposal of the European Commission and EU governments to support their efforts in ensuring the food supply and security during the ongoing health crisis and look forward to contribute to the discussion on a common EU food crisis response mechanism in the context of the upcoming consultation process.

We also specifically support the objective of moving towards a harmonised EU approach to measure and communicate accurate and reliable and meaningful information on the environmental performance of (packaged) products. As general principle, this must be carried out in line with the policy objectives of the European Green Deal and the new Circular Economy Action Plan, which set the basis for an innovation-driven policy agenda to pursue sustainable growth and encourage both ambitious and economically viable solutions to scale-up circularity and contribute to climate neutrality. Response to A new Circular Economy Action Plan

We welcome the opportunity to submit our feedback on the Roadmap on a New Circular Economy Action Plan. EUROPEN, the European Organization for Packaging and the Environment supports the objective to transition towards a more circular economy in Europe. The proposed New Circular Economy Action Plan, as part of the Green Deal, will be an important follow-up measure to the Circular Economy Package of 2018. EUROPEN’s members include material producers, packaging converters and brand owners in Europe across a wide range of sectors and all materials, offering a broader supply chain perspective without favouring any packaging material or system. The roles and functionalities, but also packaging’s environmental performance, are relevant at different stages of a packaged product’s lifecycle and are different for each packaging type. On average in the EU, considerable progress has been made in increasing packaging waste recycling and recovery rates over the last three decades. However, substantial differences in packaging waste management performance, infrastructure and culture in Member States still exist today. EUROPEN supports and will contribute to the Commission’s work to ensure that a viable and constructive new Circular Economy Action Plan is developed. EUROPEN agrees with the Commission’s recognition that its environmental objectives need to be aligned with the EU Industry Strategy while maintaining industry competitiveness as its integral part. To this end, the principle of having science-based policy making based on a holistic impact assessment to reach a balance between social, environmental and economic aspects of the EU Green Deal while reducing Greenhouse Gas emissions are supported by EUROPEN. Response to Reducing marine litter: action on single use plastics and fishing gear

EUROPEN represents the packaging supply chain in Europe, representing not only the plastics packaging supply chain, but also the supply chains for metal, glass and paper packaging. EUROPEN supports the overarching objectives of promoting a transition to a Circular Economy and tackling marine litter, while ensuring the efficient functioning of the Internal Market. EUROPEN members commit to be part of the solution. To this end, we will support the EU institutions to help ensure that a Single Use Plastics Directive tackles marine litter holistically, incentivising solution-driven innovation with sufficient development time from R&D to commercialised solutions. This approach should help avoid (unintended) disruptive consequences and risky legal precedent-setting which would jeopardise the efforts of the packaging supply chain towards a circular economy. The lack of policy coherence, due to multiple and fragmented policy processes, threatens the adoption of a coherent EU policy framework for packaging. Potential regulatory confusion and various legal interpretations at EU and national level will lead to disruptive effects across the different packaging materials which effectively compete in various markets and applications. Our recommendations (see our attached position paper) aim to ensure the Commission’s legislative proposal meets its intended objectives, while also supporting the EU’s objectives for sustainable growth and global competitiveness, in line with the three following interlinked principles: 1. Policy coherence; 2. Proportionality; 3. Better regulation.
