LGBTI Groups Demand Cross-Border Healthcare Access for Marginalized Communities

Message — The organizations request inclusion of LGBTI civil society in stakeholder assessments. They seek clarification on whether the directive enables access to reproductive technologies, transition-related care, and specialized treatments unavailable in home countries, and whether it protects continuity of care when moving between member states.1234
Why — This would expand healthcare access for LGBTI people facing discriminatory national policies or unavailable treatments.56

Response to Preventing and combatting gender-based violence

ILGA-Europe, a regional network fighting for the rights of LGBTI people across Europe and Central Asia with over 600 member organisations in 54 countries, welcome the commitments made by the previous initiatives such as the EU Gender Equality Strategy 2020-2025, the EU LGBTIQ Equality Strategy, the Action Plan on Gender Equality and Women's Empowerment in External Action 2021–2025 (GAP III) and Victims’ Rights Strategy to assess the intersection of gender with other inequalities, and the recognition that gender stereotypes put all people at risk, without negating the unequal power relation that women and girls are forced into. With this feedback ILGA-Europe wants to highlight the specific needs and vulnerable situation LGBTI people and specifically LBTI women face at risk of and as victims of gender-based violence and domestic violence and puts forward recommendations on how the impact assessment will be made fully inclusive, and thus live up the commitments made. Summary of recommendations: In order to ensure that women and girls in their diversity enjoy full and equal protection throughout EU Member States, it is imperative that the Commission develops a holistic legislative initiative that provides minimum standards on gender-based violence and domestic violence as proposed under option III. The proposed initiative must be worded and designed so that resulting policies and actions will address the full variety of intersectional experiences of women and girls, including LBTI women and girls in accordance with international and regional human rights framework. The initiative should harmonise terminology as much as possible where it is mentioned in the new Gender Equality Strategy, by framing the initiative in reference to women and girls in all their diversity, which the Gender Equality Strategy defines as “where women or men are mentioned, these are a heterogeneous categories including in relation to their sex, gender identity, gender expression or sex characteristics . It affirms the commitment to leave no one behind and achieve a gender equal Europe for everyone, regardless of their sex, racial or ethnic origin, religion or belief, disability, age or sexual orientation”. In addition, the initiative should ensure inclusion of experiences of LGBTI people and children in the context of domestic violence by using broad definition of domestic violence to include specific forms of violence against LGBTI children, intimate partner violence among LGBTI couples, intergenerational violence and violence in the domestic unit as it is reflected in the Istanbul Convention. In cohesion with the Gender Equality Strategy and common European values, this initiative should reflect the reality of intersecting gender-based oppressions. Therefore the EU should consider including indicators related to SOGIESC, and collect disaggregated data on the bases of sexual orientation, gender identity and expression, and sex characteristics. In its continued efforts the EU must improve the quality of partnership by ensuring continued EU coordination and dialogue at the international level with the UN and Council of Europe, as well as coordination at the national and local levels with women’s and LBTI grassroots organisations, among other actors. LGBTI organisations directly working with violence against LBTI women and girls and LGBTI victims of domestic violence and victims support and crime reporting, coming together in the ILGA-Europe network should be included in consultation processes. Response to EU Action Plan of Gender equality and women’s empowerment in external relations for 2021-2025

It is a pivotal moment in Europe, and beyond, when it comes to discussions of gender and gender equality. As the EU has clearly indicated, its recent Gender Equality Strategy applies to “women and men, girls and boys, in all their diversity”. Going further, the Strategy explains that “the expression ‘in all their diversity’ is used in this strategy to express that, where women or men are mentioned, these are a heterogeneous categories including in relation to their sex, gender identity, gender expression or sex characteristics. It affirms the commitment to leave no one behind and achieve a gender equal Europe for everyone, regardless of their sex, racial or ethnic origin, religion or belief, disability, age or sexual orientation”. In keeping with this understanding, ILGA-Europe has prepared a briefing which highlights opportunities for policy cohesion between the Gender Equality Strategy and the Gender Action Plan III in terms of LGBTI inclusion and intersectionality, to ensure that the EU’s policies, programmes, and positions are comprehensive, cohesive, and modern, address the gender-based needs of all women and girls in Europe and beyond, and acknowledge the existence of non-binary and third gender European and global citizens. ILGA-Europe urges gender-neutral language in EU Cancer Plan

Message — The organization requests moving away from binary gender categories to ensure trans and intersex people can access appropriate screening. They recommend using body-part specific language and implementing specialized training for healthcare providers.123
Why — LGBTI individuals would gain access to life-saving screenings currently denied by gender-binary administrative systems.4
Impact — Insurance providers and national health systems would need to update their gendered administrative frameworks.5

Response to EU Action Plan on Human Rights and Democracy 2020-2024

In addition to the broader issues around human rights and democracy that will have been commented on by colleagues from civil society in Brussels, we would like to highlight that the EU Action Plan on Human Rights and Democracy 2020-2024 should make specific reference to how LGBTI rights can be protected beyond the EU. In many countries LGBTI people face persistent and deep-rooted discrimination in society, including in public services, the media and from politicians. The EU committed to defending LGBTI rights in its external policy, when it adopted the LGBTI Guidelines in 2013, which instructs its delegations to protect all human rights of LGBTI people on the basis of existing international legal standards. We ask the EU Action Plan on Human Rights and Democracy 2020-2024 to fully recommit the EU to its LGBTI Guidelines and to foresee a guidance document with technical details and good practice examples in order to aid the EU Delegations in implementing them effectively. As human rights, democracy and rule of law face fresh challenges both inside and outside the EU, human rights defenders and vulnerable groups are exposed to more severe discrimination. Several countries still criminalise same-sex relations, and hate-crime and hate speech against LGBTI people goes unpunished in a majority of cases in the EU’s Eastern neighbourhood. In addition, as backsliding in rule of law appears in many countries, the rights of LGBTI people and human rights defenders to freedom of assembly, freedom of expression and freedom of association is increasingly threatened and denied. We urge the EU to fight for decriminalization of same-sex relations, as well as for equality before the law regarding hate-crime, hate speech and anti-discrimination legislation in all spheres of life (employment, healthcare, education, housing, social care etc.) All such legislation (including relevant articles in criminal codes) should contain grounds of sexual orientation, gender identity and sex characteristics. The EU must continue defending and supporting LGBTI people’s right to freedom of assembly, expression and association, which is crucial for their participation in democracy and enjoyment of fundamental rights which should be enjoyed by all people. Response to Measures to further improve the effectiveness of the fight against illegal content online

This feedback concentrates on (illegal) hate speech online, including around the Code of Conduct on Countering Illegal Hate Speech Online. In communicating about initiatives to tackle speech that incite hatred and violence, the explicit inclusion and mention of grounds beyond xenophobia and racism is beneficial for enabling a comprehensive tackling of online hate speech on all grounds, including those targeting people for their gender, gender identity, gender expression, sexual orientation, sex characteristics, disabilities, or any other status. Particularly in public communications, the specific stating of these (and other) grounds can signal to the affected communities as well as would-be perpetrators that the EC takes a firm position on this issue, and has the interests of these communities in mind. We echo the concern that participation in the current voluntary schemes is limited to a small number of mostly big players, as raised in the sub-section ‘The need for faster and more effective detection and removal of illegal content’(p.3). It should also be recognised that similar problems and disadvantages as those highlighted for smaller platforms are experienced by civil society organisations working on the reporting of online hate speech (in trusted flagger and non-trusted flagger capacities), with regard to limited financial and human resources to identify and report illegal content. Measures to lower the barriers to participation for a greater number of more diverse CSOs should be provided, including financial and technical support. We appreciate that it is noted that “limits between illegal content and content which is objectionable is sometimes blurred” (p.6). It is important to recognise that some content can be harmful despite being legal, particularly in the context of hate speech, where grey areas are plentiful. The black/white distinction between legal and illegal may work with regard to e.g. property/intellectual rights issues, but risks leaving victims of online hate speech vulnerable if nuance and context are not taken into account. In discouraging over-cautiousness in removing content, it is also important to beware of going too far in the opposite direction, and allowing harmful content to remain online because of uncertainties around its illegality. The wellbeing of victims should always be at the centre of all interventions, as emphasised in the Victims’ Rights Directive (2012/29/EU). One way of addressing this is to provide training and facilitate exchanges between organisations reporting hate speech and online platforms; for CSOs to train online platforms on the grounds on which they work and share their support needs, and for the platforms to train CSOs on how best to navigate the platforms to ensure quick and effective responses. It should also be recognised that while trusted flaggers are useful for accelerating the reporting process on different platforms, it is important not to lose sight of the goal of attaining efficient and effective responses for all who report, and thus to ensure that regular users do not become sidelined by a focus on trusted flaggers. I.e. beware of creating hierarchies, such as between those with ‘trusted flagger’ status and those without. Disaggregated data should be collected; when it comes to online hate speech, data should be equally collected and made available in such a way as to make it possible to monitor the response and removal rate for different grounds of victimisation, including race, colour, religion, gender, gender identity, gender expression, sexual orientation, sex characteristics, migration status and other statuses. This will contribute to a more nuanced understanding of where there is the most need for support, and will enable resources to be concentrated for targeted interventions.

Response to Council Recommendation on Common EU Values

Full contribution in attached PDF document ILGA-Europe’s recommendations The EC initiative to propose Council recommendations is an opportunity for the European Union to clearly state that learning environments should be welcoming and safe for all, and that member states, local and regional authorities need to ensure that schools are places where young people start to own values such as respect, tolerance, and equality. It is important in this context to restate that LGBTI people and children of Rainbow families are full members of our societies, and that therefore active measures should be taken to ensure safety, respect, protection against discrimination and equal access to education for them. ILGA-Europe wishes to make the recommendations below, following the areas highlighted in the Roadmap: Refocusing learning objectives and content - Ensure that all work on social and civic competences includes respect and celebration diversity, rather than simple promotion of tolerance, and explicitly includes the grounds of sexual orientation, gender identity/expression and sex characteristics; - Employ a human rights based discourse, promoting equality among all and highlighting that LGBTI rights are human rights; - Empower students by making them part of the conversation; - Use an intersectional approach by highlighting that some students face multiple discriminations in learning environments. Empowering teachers - Teach teachers about diversity, including among other staff and among students; - Equip teachers with tools to deal with diversity in educational settings and to facilitate conversations on diversity, as part of lessons or as conflicts arise; - Equip teachers with tools to fight hate speech and violence whenever it occurs and on whichever ground, including when it is based on sexual orientation, gender identity and gender expression. Inclusive learning environment - Take concrete measures against violence and bullying at school, including violence based on sexual orientation, gender identity/expression and sex characteristics; - Build inclusive school curricula that offer a positive representation of vulnerable and marginalised groups, in order to fight against harmful stereotypes and promote diversity, including children that are LGBTI and children in Rainbow Families. Cooperation with the community - Support existing and future initiatives to involve the LGBTI community in conversations about diversity in schools; - Promote the use of non-formal methodologies in interventions on diversity in schools, in order to reach to all students regardless of their learning styles or eventual difficulties.
