Why — This would enable the company to secure green capital and improve its sustainability ratings.45
Impact — Unequal treatment harms the competitive opportunities of suppliers and risks millions of European jobs.67

Response to Transitional measures for smart tachograph 2 regarding its use of OSNMA

Continental, as a manufacturer of tachographs with an extensive history and experience in this field, would like to contribute to this public consultation regarding the transitional measures as outlined in documents draft implementing regulation - Ares(2023)1295561 and Annex - Ares(2023)1295561. After careful review of the documents mentioned above, we welcome the Commissions proposal due to various reasons. Firstly, the proposal reflects a very practical approach which will deal with the current technical challenges that industry faces with the delayed availability of the Galileo OSNMA authenticated signal. From our own experience of software updates on our tachographs in the field in the past, we see that the required Software update will be part of the periodical inspection procedure of the tachograph (the tachograph has to be calibrated every 24 months), as proposed in DG Moves transitional measures and could be easily integrated in the periodical inspection procedure, not excessively increasing the required time. Secondly, we welcome the Commissions approach, as it clearly takes potential costs for this software update into account. The proposal assures that the related costs and time efforts of such Software update shall be kept as low as possible. Furthermore, such a software update during the legally prescribed periodical inspection will avoid extra costs for additional workshop visits to just perform the software update. In general, we support that the already mandated software updateability of the smart tachograph version 2 will be utilized to introduce a harmonized Galileo authenticated signal (OSNMA) via software update in the field. 1) Continental welcomes the effort to create a Delegated Regulation, as the industry requires certainty and a common direction. 2) Continental is ready to deliver technology for the implementation of the DA and is willing to help further develop its framework, particularly, to add possible other communication technologies to the delegated regulation. 3) While the DA provides an industry-wide framework, Continental advocates further industry/government collaboration to improve certain provisioning and operational elements, which will help to ensure the security, maintainability, and cost effectiveness of the system when deployed en masse. The Annex 3 “Certificate Policy” enforces usage of Common Criteria certified cryptographic module as well as the Annex 4 “Security Policy” imposes Common Criteria certification for complete ITS-Stations. While this approach is common for smart cards and cryptographic modules, it is new for Electronic Control Units in the Automotive Domain and there is an absence of Protection Profiles describing security requirements to be evaluated during certification. To safeguard fast deployment we propose to delay requirement on security certification until appropriate certified Protection Profiles are available and base the security requirements to the upcoming automotive compatible cybersecurity standard ISO/SAE 21434. Response to Commission Implementing Act on on-board weighing equipment

Continental does welcome the EU initiative with the view to prevent infrastructure damages, to improve road safety and to underline fair competition via truck overload detection. Unfortunately, EU member states will have to carry an administrative burden which could have been shared with centralized functions, such as services provided by DG JRC. The weight detection and weight information should be regarded as a focal point for various use cases that are being developed, on a legislative level and a technical level: 1. Overload detection 2. eCall for HDVs 3. Cabotage 4. Tolling Hence, the EU could widely benefit from a systematic approach, looking for additional synergies, and joining single use cases to strengthen the societal and economic benefits and values that innovation can bring. Therefore, the legislative approach is disappointing from an Innovation perspective. Furthermore, the transport industry and the enforcement community should benefit from day one of this legislation coming into force, bringing more efficiency to the control in the field. The low level of accuracy and the very low level of security (for phase 1 and phase 2) indicate that the system will not be able perform as expected to support meaningful enforcement efforts in the field, leaving the transport industry and enforcement community to carry additional costs with no direct or indirect benefits. Challenges - Missing analysis on the security for OBW will imply that the available weight data can not be trusted fully, the level of automated road-side checks as well as the detection rate can only be improved marginally, if at all - Two steps approach will introduce a system, which is not fully supporting the initial purpose in regards to accuracy, interoperability and reliability (trustworthiness); Furthermore, due to certain reasons, the introduction date for the STAGE 2 could be postponed once again or for an indefinite period of time - Focus on indication of the total weight is questionable, due to the fact that the road safety as well as the road worthiness are also affected negatively, if just one axle is overloaded - Number of the Member States willing to use OBW is still unknown, this fact could have negative impact on the decisions and the cost structure of the industry - Missing impact assessment could lead to disproportionate burdens for the stakeholders - Missing information on technical affects and feasibility leads to the fact that the majority of the respective use cases could remain uncovered - Dynamic systems require a certain time and distance to be driven before weight values can be measured. This means that drivers might only notice the overloading of the vehicle after several kilometres and have no chance to react accordingly Proposals - The trustworthiness regarding the available weight information is crucial for Enforcement Purposes, therefore the security measures shall ensure a proper protection of the whole system - One step approach should be preferred, and the introduction date should be postponed, if needed, so that the affected parties are able to introduce the fully compliant OBW system as soon as possible (e.g. May 2022) - The axle weight determination should be obligatory, so that the road safety as well as the road worthiness could be improved in parallel - Perform analysis, assessments and definitions to be able to introduce more complete version of the Implementing Act, especially in regards to Reliability, Interoperability and Compatibility of the system to be introduced - An indication of the Member States willing to introduce the OBW system could help the industry to make proper decisions

Response to Radio equipment support access to the E112 emergency services

Continental welcomes the EU commission initiative to improve E112 calls for hand held phones with detailed GNSS/WiFi location information. No impact is currently foreseen in this draft delegated act on telematics control units embedded in the vehicles and that are in charge of eCall on top of many other services. We however anticipate that 2G and 3G networks will soon disappear (in the 2020-2030 timeframe) together with the Circuit Switched technology that the current eCall implementation requires to send mandatory data via the inband modem (MSD). Hence Continental urges the EU commission to work on the roadmap to the next generation eCall system (e.g. NG112) otherwise eCall units in the car will be useless! We foresee that the sending of the MSD via the same mechanism as the AML could be an interesting fall back option to the inband modem. Indeed, when the network reception conditions are weak, inband modem information transfer may be not possible whereas SMS sending is. This is due to the nature of the channels used for the SMS that can cope with weaker RF conditions. AML could also be an interim solution while waiting for the NG112 one.
