They demand that mobile standards remain included in the rules to prevent companies from bypassing requirements. The group also proposes that independent bodies determine fair rates before any legal injunctions are granted.123

Response to European Critical Raw Materials Act

The Mercedes-Benz Group AG would like to give the attached feedback to the European Critical Raw Materials Act. Mercedes-Benz is committed to a fully electric future of mobility. A core element of our sustainable business strategy is Ambition 2039. The ambition is to make our entire fleet of new vehicles net carbon-neutral along the entire value chain and over the vehicles' entire life cycle by 2039 from technical development to the extraction of raw materials, to production, service life and recycling. By the end of this decade, we will be ready to go all-electric wherever market conditions allow. Access to critical raw materials such as cobalt or lithium, for example, is essential for the success of this transformation. We therefore welcome the European Critical Raw Materials Act, as it is necessary that the EU takes measures to strengthen the resilience of the European value chain, e.g. for batteries. In addition to strengthening domestic production, processing and recycling, access to third markets via trade agreements and strategic raw materials partnerships is crucial for the procurement of strategic raw materials. There is no doubt that in the future, a significant share of critical raw materials in the EU will continue to be imported. The arguments, addressed by Deutsches Aktieninstitut e.V., are fully supported by Mercedes-Benz Group. This particularly applies to the mentioned impact on risk transparency and bureaucracy. In addition, Mercedes-Benz Group is realizing the outsource of EMIR reporting obligation as part of countermeasures, designed to address the overall tight cost situation due to inflationary economic developments. By such outsource, Mercedes-Benz Group wants to dampen pass through effects to customer pricing, and safeguard overall profitability and growth perspectives by utilizing efficient G&A cost structures. A revocation of the EMIR reporting exempt for internal derivatives, introduced just in 2019, would lead to an insource requirement for EMIR reporting at Mercedes-Benz Group as such data is not available for external trading partners. As a result, it would cause high effort for and investments by the Group to (i) re-establish technical functionalities in its Treasury System to cope with EMIR requirements, (ii) upgrade the Treasury System to newest EMIR syntax requirements applicable by April 2024 (EMIR ReFit initiative was the reason to outsource the topic), and (iii) to increase recurring G&A cost by contracting additional staff to run the respective reporting processes. Considering the above mentioned topics and the fact, that EMIR reporting of internal derivatives does by far not enhance risk transparency for corporates as their risk exposure is much more driven by material flows than by internal derivative contracts, we have a strong preference to keep the existing exempt rule on the reporting of internal derivatives. Further, predictability and stability of law are preconditions for successful entrepreneurial activities. According to our opinion, the risk is transparently described by the reporting of all externally contracted derivatives in conjunction with applicable hedge accounting rules as this (i) limits the utilization of derivatives to risk management purpose only, (ii) describes the total risk within a group structure due to netting approaches and (iii) also provides reasonable possibilities to reduce administrative burden of such obligation.

Response to Revision of the specifications for EU-wide real-time traffic information services (Delegated Regulation 2015/962)

As a vehicle manufacturer (OEM) that will be responsible for both data provision and in-vehicle services under the revised delegated regulation, we have comments on the present draft. We share the view that road safety and efficiency can be improved with data-based services. We take the position that this should based on use cases. We see little use in providing data based on a predefined list without specific use cases. As has already been shown in the delegated regulation on SRTI, it is more expedient to work with events instead of data points. In this case, data holders can provide data relevant to the provision of the services in question from the existing data. OEMs do not (and cannot) collect the data listed in the annex on the state/real-time use of the network in the required form. The majority of data points would have to be generated (if possible) via a combination of different raw data, which must necessarily be done off-board due to the limited computing capabilities in the vehicle. Often, these data can be fed into the system much more easily from other sources. Road operators, for instance, can collect and pass on information about road closures or construction sites more easily and reliable than the OEM who has to combine different data to generate less accurate and reliable information. For this reason, again, a data provision based on use cases is more suitable than a rigid data list. The same applies to the rules regarding the updates. The data is not collected by the OEM in a form that allows direct compliance with the regulation. Vehicle sensors only report an actual state: e.g. if an obstacle on the lane is detected or not. OEMs can therefore not update the data in principle as they can only report data as the sensors collect them. With regard to the data in the annex, it should be noted that an OEM cannot generate all this data in the sense of regulation, particularily data on the real-time use of the network. These can possibly be collected via the sensors in the vehicle, but an OEM only has information about the share of its fleet in the total traffic volume. For the actual use of the road network, the data would have to be aggregated elsewhere. At the same time, navigation apps, for example, prove that this data already exists in aggregated form. Due to the large number of users of navigation apps, many of the listed data types for using the network are already centralized and available in large numbers. For this reason, too, the rules for ITS applications that are generated and operated "on-board", but not via vehicle resources (e.g. Smartphone apps) are to be clarified. In addition, the roles and tasks of data providers/users, as well as the quality requirements for data and updates under Articles 4-11, should be more clearly defined and revised with the involvement of data producers. We welcome the possibility of making data available through a third party database or aggregator, but see the need to specify the data producer's responsibility for the quality of the data to avoid uncertainty. Article 3 (6) should be supplemented to the effect that the data holder is only responsible for the quality of the data until it is handed over to a third party. Since the provision and retrieval of data depends on the NAPs, we appreciate the stronger coordination mechanism for the NAPs established under the ITS Directive. We want to point out that more ITS-related services could already be implemented, if the maturity level of the NAPs allowed it. With regard to European harmonisation, we recommend minimum standards for NAPs to facilitate cross-border data exchange, or even to create a single European access point. Further regarding EU harmonisation, we would also welcome a uniform compliance process across Member States. Should each Member State create its own distinct procedure for proof of compliance, this would lead to unnecessary additional effort for the actors involved.
