Airport industry urges EU funding for dual-use infrastructure upgrades

Message — The organisation requests common safety approvals for civil and military aircraft, infrastructure upgrades at dual-use airports, and harmonised diplomatic clearance procedures. They seek EU financial support for airports to accommodate military operations alongside civilian traffic.1234
Why — This would enable airports to handle military transport without separate approval processes and secure funding for required upgrades.56

Airports Council International urges expanded state aid exemptions for regional airports

Message — The organization requests raising the operating aid threshold to airports handling up to 1 million passengers annually, or at minimum 700,000 passengers. They also want 100% aid intensity allowed for investment aid to airports below 1 million passengers.12
Why — This would reduce administrative burden and provide faster access to public funding for struggling regional airports.34
Impact — Larger airports could face increased competition from subsidized regional airports for routes and passengers.5

European airports urge extension of state aid beyond 2027

Response to Rationalisation of reporting obligations – outline of draft proposals in the field of mobility and transport

ACI EUROPE is the European region of Airports Council International (ACI), the only worldwide professional association of airport operators. We advance the collective interest of Europes airports. ACI EUROPE represents over 562 airports in 50 countries. Our members facilitate over 90% of commercial air traffic in Europe. We welcome the opportunity to respond to the consultation on the rationalization of reporting obligations in the field of mobility and transport. The EC proposal concerns reporting requirements in two Directives with relevance for airports: Article 1(4) of Directive 96/67/EC (the so-called Ground Handling Directive) requires Member States to inform the Commission annually about the airports falling within its scope, which depends on their levels of passenger traffic and freight handled. It also requires the Commission to publish the list of airports in scope of the Ground Handling Directive. Article 1(3) of Directive 2009/12/EC (the so-called Airport Charges Directive) requires Member States to publish a list of the airports on their territory to which that Directive applies, which depends on their traffic or their position as larges airport in a Member State. ACI EUROPE supports the proposal to delete article 1(4) of the Ground Handling Directive and article 1(3) of the Airport Charges Directive. We agree that all such information is publicly available and easily accessible to stakeholders from airports, airport associations or from Eurostat. In order to reduce administrative burdens, it is appropriate to remove this obligation of reporting and publication. Streamlining and ensuring fitness of existing Directives applying in air transport should be a mantra that guides the European Commissions legislative review process.

Response to Accreditation of Qualified Entities

ACI EUROPE support in principle the provisions in the draft DA laying our the provisions for an accreditation system for entities performing oversight or certification activities. We believe that specialised non-government entities could fulfill these roles competently particularly given the increasing challenge of filling expert positions in both industry and government agencies. We suggest that a provision is added ensuring that in the event of the suspension or revocation an organisation's accreditation the provision of oversight and/or certification activities is not affected. A guidline on what generic criteria an organisation must fulfil to potentially qualify as an accedited entity should be included in the DA.

Response to Revision of the Visa Suspension Mechanism

On behalf of ACI EUROPE, I would like to thank the European Commission for giving us the opportunity to provide our thoughts on the initiative EU visa policy - revision of the visa suspension mechanism. The attached document summarises the joint position of the aviation industry on this matter, notably: - The re-introduction of a visa requirement should remain a mechanism of last resort without any automaticity; - The travelling public and the industry must be well in advance and clearly informed in case of visa suspension. This should avoid unnecessary pressure on air carriers and airports, leading to excessive waiting time at border control, jeopardising connectivity; - The impacts of any visa suspension on other EU border management tools, such as EES and ETIAS, shall be duly addressed for coordinated functioning. This should prevent travellers from showing up at the external borders without the required visa, impacting the passenger experience, airlines liability and the border crossing points at airports; - The revised suspension mechanism must unilateral, non-coordinated, knee-jerk national restrictive measures (as seen during the COVID-19 pandemic).

ACI EUROPE, representing over 500 airports in 55 countries, supports the European Commission's initiative to review the Slot Regulation. ACI EUROPE believes that the following elements should form part of a revised Regulation: - Greater transparency in the slot allocation process; - More scope to ensure that slot allocation takes into account the economic and connectivity strategies of airports and the related needs of their local markets; - Ensuring that airlines make full and proper use of the slots allocated to them; - Strengthening the new entrant rule so as to deliver greater competition at Europes airports and more choice for passengers which caters to their needs. Response to Update of common rules for the allocation of slots at European Union airports

Airports welcome the opportunity to provide comments on the European Commission’s planned update of the Slot Regulation so as to maintain relief measures, as appropriate, due to the COVID-19 pandemic and the Russian invasion of Ukraine. ACI EUROPE has consistently, over the period of the COVID-19 crisis, supported a progressive reinstatement of airport slot usage requirements, as the market stabilizes and recovers. The current alleviation measures in Regulation 2021/250 foresee a return to the 80/20 rule in the Winter 22 season, which ACI EUROPE has supported. As such, our comments below should be read in this context. Please see the attachment for ACI EUROPE's full statement. In summary: - ACI EUROPE supports the Commission's intention to maintain provisions for coordinators to grant JNUS related to the COVID-19 pandemic and the Russian invasion of Ukraine. Any extension of JNUS provisions for COVID-related restrictions must maintain the current regulatory wording and EUACA guidance at a minimum. - ACI EUROPE supports the Commission’s intention to maintain the planned return to 80/20 in W22. - Regulation 2021/250 introduced positive changes in the form of the revised definition of New Entrant, and the requirement for airlines to return unused slots to the pool at least three weeks in advance. Response to Better protection for passengers and their rights

European aviation has a long-held tradition of defending passenger rights. Indeed, based on the experience acquired in the past, those rights have been recognised and transposed to other modes of transport. European airports are committed to the continuous improvement of the quality of the services offered to passengers and to the effective enforcement of their rights. Regulation 261/2004 provides the common basic framework for information, assistance, reimbursement, rerouting and/or compensation under certain conditions in the event of denied boarding, cancellation or long delays of flights. Regulation 2027/97 transposes the Montreal Convention into European law. These two regulations and the Montréal Convention do not impose any legal obligation on European airports, based on the principle that a passenger’s primary relationship is with the air carrier, with whom they have entered into a transportation contract. ACI EUROPE calls for a swift adoption of the revision of these regulations. This should allow addressing their uneven and poor enforcement, based on the fact that National Enforcement Bodies and air carriers have different interpretations of the legislation and in particular of the scope of Regulation 261/2004. The current sanitary crisis also highlighted the limitations of Regulation 261/2004. As mass disruptions case scenarios have not been foreseen, air carriers could not fulfil their obligations and failed to offer passengers the rights to which they were entitled. ACI EUROPE will support the development of a financial protection scheme to protect passengers and air carriers against the risk of crisis, exceptional liquidity events or insolvency regarding the reimbursement of tickets, rerouting and assistance of air passengers. Similar situations of unprotected passengers take place in Europe on a regular basis, in cases of denied boarding, cancellation of flights or long delays not associated with extraordinary circumstances. European airports routinely provide support beyond their legal obligations to stranded passengers: e.g. people travelling without a visa (dozens of people per day at major hubs) or travelling on separate tickets and missing a flight segment. This led to a reinforcement of their preparedness and resilience procedures. ACI EUROPE therefore calls for the active participation of air carriers, ground handling providers, suppliers operating at the airport and national authorities (Civil Protection or equivalent) in contingency plans to reinforce the effective protection of passengers’ rights.

Response to A Drone Strategy 2.0 for Europe

ACI EUROPE welcomes and strongly supports the initiative for a Drone Strategy 2.0 for Europe. The airport industry has been a proponent of new process and technological innovations for many decades. This includes the usage of drones for operational and commercial purposes at and around airports. We also welcome the fast progress made by EASA with regards to providing a framework for the entire value proposition of drones. While concerns about societal acceptance of technological innovations need to be taken seriously, we believe that familiarity with new technologies are a catalyst for acceptance. This will require high visibility and a wide-ranging, regular presence of drone applications across Europe. The Urban Air Mobility Initiative & network of demonstrators are an effective tool to promote awareness as well as to develop technology and know-how for safe UAS operations in suburban and urban spaces. Critically for airports, UAS operations for whatever purpose should not have any negative implications on an airport’s capacity. That is to say that UAS flights at or in the vicinity of airports must be devised in a manner that does not interfere with regular manned aviation or occupy any slots allocated to regular commercial manned flights. However, a number of projects with significant potential to foster development of UAS services struggle to get off the ground due to lack of support from local, regional and/or national authorities. Their reluctance often stems from the relatively slow evolution of regulations and/or tried and tested (as well as certified) technology at this relatively early stage of development of the technology and its use cases. We therefore believe that an official European endorsement for companies or consortia working on demonstrators / test flights aiming to demonstrate the feasibility of UAS, operational procedures and use cases could help secure the necessary support from competent local/national authorities. Such an official European endorsement would constitute an interim step towards supporting the development of necessary regulations and industry standards and best practices, basing it on real experience and data needed to satisfy better regulation requirements. Given the high speed of development both in business models, services and technology, endorsing actual trials brings visibility, experience, data and development for this emerging industry. As the voice of the airports, we would furthermore like to highlight that the safe integration of U-space with controlled airspace should be included in the Drone Strategy 2.0 for Europe. Airports will be important destinations for VTOL air taxis but also for delivery services by UAS, and the use of UAS in the airfield and landside operations of the airport. Integration of air spaces therefore needs to be considered explicitly in the strategy. In addition, the development of standard procedures for drone operations at airports bears further consideration in order to benefit from the opportunities provided by drones for efficient airport operations while managing the associated risks.

Response to Evaluation of Regulation on reporting, analysis and follow-up of occurrences in Civil Aviation

With regard to the evaluation of Regulation 376/2014, ACI EUROPE wishes to submit the following initial comments on issues which should be considered in this process: • Alignment with other regulations at both European and national levels needs to be ensured, including the new EASA Basic Regulation. For instance, in one Member State, certain requirements of the Regulation cannot be met by airports as the entity responsible for doing so is set out by law. • Duplication of reporting obligations must also be avoided. There is no benefit for an airport to report issues that are completely unrelated to its operations (e.g., mechanical malfunction of an aircraft, ground service equipment issues, etc.). However, some authorities expect that airports report every minor event that happens at the airport, which is time-consuming and may create confusion. While this can help to get multiple perspectives on an event, it would be good to have some clarity around expectations, as at the moment airports can submit over a dozen reports per month which simply describe the event and state that the airport is not investigating due to having no involvement in the event. • Clarity is required as to the appropriate mechanism for reporting cybersecurity and drone incidents, and if not already the case then these should be brought within the remit of the Regulation. • The possibility of industry bodies extracting information relevant to their own interests from the European Central Repository, rather than having to request such information from their national authorities, should be examined. Airports who file reports furthermore do not receive information on other parties’ reports, the status of official investigations, etc. Management of an airport should be able to access information relating to incidents reported at that airport and could receive a report on all occurrences happening at their airport on a regular basis, particularly where the issuance of an Airworthiness Directive or Safety Information Bulletin has not been required. • The ECCAIRS format is too complex and limiting, and more oriented for actors other than airport authorities (i.e. airlines). A new ECCAIRs must have a simple compatibility factor, i.e. it must be designed so as to make it easy for the various incident reporting systems to transfer data.
