Transport unions demand worker protections in military mobility plans

Message — The ETF proposes using the 'home base' concept to determine applicable labor laws and calls for a ban on bogus self-employment. They also firmly oppose any attempts to restrict the fundamental right to strike for air traffic controllers.123
Why — These reforms would improve working conditions and protect transport workers from social dumping and job insecurity.45

Response to Evaluation of the Common Fisheries Policy

The ETF has consistently supported the need for a Common Fisheries Policy (CFP) that aligns with environmental sustainability objectives. However, we emphasize that the social and economic dimensions of fisheries are equally crucial, as a high number of individuals, workers, and communities depend on the sector's existence. In our view, these three pillarsenvironmental, social, and economicmust be pursued with equal priority. We have observed that environmental sustainability has often been prioritized at the expense of economic and social goals, though we acknowledge the initial efforts made in the past few years to address this imbalance. The ETF has persistently urged national and European institutions to give due attention to the human and labour aspects of a sector facing severe challenges. Despite the EU being a significant seafood market, the number of vessels, companies, and workers in the EU fleet has steadily declined. In some regions or fleet segments, this decline has been drastic, leaving the sector teetering on the brink of survival. Fishers are calling on institutions to address other human activities that stress marine biomass, such as pollution and the impacts of climate change, rather than placing the entire burden on the fisheries sector. The ETF highlights that numerous measures have been implemented in recent years, including significant reductions in fishing efforts, the landing obligation, and the regulation of specific fishing gears, without adequately considering the clear social consequences for employment and working conditions. These factors have contributed to making fisheries jobs increasingly unattractive, leading to a labour shortage and a growing reliance on migrant workers in the EU fleet, which brings challenges related to fair conditions, pay, certification, and rule enforcement. Fisheries have undoubtedly paid a higher price than other sectors by being grouped under the portfolio of the Environment Commissioner. The ETF is particularly concerned that, given the global and competitive nature of the fishing market, these factors could severely undermine the EU fishing sector and its workforce. The EU already imports more than 70% of the seafood it consumes, and this percentage risks increasing further. We do not want to find ourselves in a situation where we import even more products from countries that do not adhere to comparable environmental and social standards. The ETF has continuously worked, including through the European Social Dialogue Committee for Sea Fisheries and the Advisory Council, to raise awareness about the need to focus on the social and economic health of the sector, particularly concerning the socio-economic consequences of decisions made at the EU and national levels. For these reasons, we believe that a thorough evaluation of the CFP must address the shortcomings in the socio-economic aspects of EU fisheries. While maintaining the fundamental objectives of environmentally sustainable fisheries, we must strive for a better future for the sector.

ETF reply to consultation on the draft implementing decision setting Union-wide performance targets for the ATM network for RP4 General comments The European Transport workers Federation regrets the absence of update of the indicators used for the measurement of the performance of Air Navigation Service Providers in a desperate attempt to leverage the SES2+ trilogue outcome. Interdependencies between KPAs remain untackled and some indicators still largely reflect behaviours outside the control of ANSPs. Safety The amendments of the questionnaire are generally acceptable for us, ETF welcomes that safety is not entirely taken for granted. Capacity We come from a situation where to manage cost pressure induced by COVID many providers cut recruitment and this staff will be lacking to provide the capacity levels expected in this target proposal. ETF therefore consider that these targets are not achievable especially when the efforts on ATM charges demanded is so high. Environment Even during the lowest traffic situation with reduced military activity, the proposed targets have not been achieved. The targets are therefore not achievable and should not be set because the indicator is not reflecting the ANSPs actions on environmental issues but mostly the flight planning attitude of the airlines. We strongly encourage the Commission to research on the feasibility of a situation where a centralised entity is in charge of assigning a route and flight levels to airspace users requesting to fly from A to B at time T with operational constraints C, D, Cost-efficiency These targets are simply unachievable, unrealistic and are sending a counterproductive message to providers on recruitment which will only result in a situation where we push in time the resolution of the capacity issues. We call for a radical change in approach allowing a bottom-up exercise to be performed to ensure investments can be secured as well as recruitment before targets can be set.

Response to Better protecting sharks through sustainable fishing and trade

The EU has the most advanced policy to pursue and combat illegal, unreported, and unregulated (IUU) shark fishing. All EU vessels must comply with the policy of fins attached in shark landings. Sustainable shark management and their fisheries are meticulously regulated by different countries in their jurisdictional waters and by Regional Fisheries Management Organizations (RFMOs) in all oceans. The EU fleet has never practiced "finning": there have been no infractions or sanctions for this practice. We are of the opinion that the proposals of the European Citizens' Initiative of 2023 "Stop Finning, Stop the Trade" go beyond responsible management of environmentally, socially, and economically sustainable shark fishing. It seeks to achieve a purely environmental goal, sacrificing jobs and responsible businesses for an idealistic purpose. The measures proposed by this initiative would involve prohibiting a perfectly legal and sustainable economic activity in Europe (especially in Spain and Portugal), generate serious consequences for our economies (especially for Galicia and northern Portugal) and consumers both in Europe and Asia, force the transfer of processing and trade from EU vessels and catches to non-EU countries, and the Asian demand would have to be met from other fleets operating with lower standards. In our opinion, new proposals in this domain should focus on enhancing science, management, control, enforcement, traceability, and international cooperation among stakeholders and administrations.

ETF urges EU to reinstate strict labor reporting rules

Message — The ETF calls for reinstating the original, stronger reporting requirements for all companies. Reporting on non-employee workers and collective bargaining must remain mandatory rather than voluntary. Implementation delays should be removed to ensure immediate transparency across global operations.123
Why — Standardized data allows the federation to monitor labor rights and employment practices effectively.45
Impact — Irresponsible businesses lose the opportunity to hide labor violations through selective reporting.6

Response to Energy transition of EU fisheries and aquaculture sector

The ETF welcomes the possible initiatives to be taken by the Commission to limit the dependency of the fisheries sector from fossil fuels. The costs for fuel represent a high share of the total costs of running a fishing company and therefore all increases in the costs of fuels have negative ripercussions on the pay of employed fishers. Having said so there are some important issues that need to be taken into account due to the peculiarity of the fisheries sector. - One important parameter to keep the fishing capacity under control is the gross tonnage limitation. As ETF we have called the Commission to review the way this ceiling is calculated to allow fishing vessels to have more space and facilities on board for the crew. As newer and greener propulsion systems and stockage of alternative fuel will need more volume that the current systems, the gross tonnage limitation will need to be reviewed. If not, there will no be incentive to decarbonise the vessels, because it would be mean less space on board for the catches. - If the gross tonnage limitation would be reviewed in order to incentivise the energy transition, it will have to be reviewed also to allow and incentivise better working and living conditions on-board. One of the factors that cause the low attractiveness of the sector to young generations is precisely the working and living conditions on-board and the wellbeing and safety of workers is not less important than decarbonisation of the sector. - It should be taken into account that the space on-board is even more reduced by the stockage of unwanted catches due to the implementation of the landing obligation. Furthermore, fishers also catch everybody plastics and trash at sea. If we want fishers to play a key role in these respect (bringing back to shore unwanted catches and plastics) and also install more modern and greener propulsion systems on the vessels, the gross tonnage must be reviewed in a way that all these considerations are taken in due account. - in certain regions of Europe, like the Mediterranean, the fishery sector is struggling to stay alive. And this was the case also before the energy crisis hit hard. Hence, for these fleets - that are also aged - the installation of greener engines is certainly not the priority. And also such innovations require investments that are hard to fund when the sector is perceived without perspective. - old vessels were designed to work with certain engines. The innovative engines can also require different vessels' shape meaning that old vessels cannot be retroffited. Additionally the replacement of a propulsion system on an old vessel can change the balance initially designed. This can have also safety implications that need to be taken into account. - upgrade/modernisation of fishing gears can also be a way to reduce fuel consumption.

European Transport Workers' Federation urges EU ban on forced labour fish

Message — The ETF requests a ban on fish products linked to labour abuses and forced labour. They suggest implementing measures similar to illegal fishing regulations and enforcing international social standards. Why — A ban would protect legitimate fisheries workers' interests from competition based on exploitation.5

Response to Amendment to the delegated act on the functioning of the Advisory Councils under the Common Fisheries Policy

The European Transport Workers' Federation values the work of the Advisory Councils and is active in a number of Committees. The ETF welcomes the fact that the amendments clarify that organisation representing employees such as the ETF belong to the 'sector organisations' as stated in annex 1.c. Nevertheless, the ETF would like to highlight the following points: - Art. 4.2 states that the 'The chairperson may originate from outside the membership of the Advisory Council'. We believe that the President should come from the membership of the AC, for a purpose of representativeness and to avoid possible interference from outside the Council. - Art 4.2 states that the President and Vice-President must be an expression of the two groups (sector organizations and other interests) and that this principle must be applied, where possible, also in the working groups. This appears to the ETF an unpractical and artificial solution, that risks to paralyze the AC's work and exacerbate conflicts. Additionally, from our experience, this solution would be very difficult to apply in the working groups. - The compulsory performance review every 5 years (art. 7) risks to become a bureaucratic exercise that weighs down the work of the ACs. The ETF is of the opinion that monitoring the work of the Advisory Committees is already possible thanks to the wide representativeness of their membership and the regular participation of the Commission in the activities of the Committees. The ETF members think that the measures highlighted above would end up in a bureaucratic burden for the Advisory Council and would not facilitate the work. The members of the Advisory Councils are professionals from the fishing sector and the ACs should be bodies as active and dynamic as possible. We also believe that the Commission should take more into due account the opinions of the Advisory Committees, even when these have been expressed by a majority and not by unanimity.

Response to Driving and rest times for bus and coach drivers

The European Transport Workers' Federation (ETF) considers that any change to the current EU legal framework on driving and rest time rules in bus and coach will come against the policy objectives of the Regulation. It will fail to improve working conditions in the sector, and will negatively impact the safety of drivers, passengers, and all other road users. In saying this, the ETF flags up the dangerously high levels of driver fatigue in the bus and coach sector. The unfriendly work schedules, inadequate rest, weekends away from home, combined with poor levels of pay, and lack of decent facilities make the bus and coach transport utterly unattractive for job seekers. To support the sector in its recovery from the COVID-19 pandemic and to make the bus and coach sector more resilient, sustainable, and attractive, the root causes of the above-described issues need to be addressed. We need a bus and coach sector that meets the expectations of today’s workforce in terms of quality of work and life as well as in terms of pay. Any extension of the working and driving hours in bus and coach will lead to a further deterioration of road safety for passengers and users, and of working conditions for bus and coach drivers. The ETF firmly believes that the targeted stakeholder consultations will take into account the views of all stakeholders including the ETF. The ETF insists it needs to be included in the targeted consultation of stakeholders notably because the ETF is the only representative of aviation workers from all aviation sub-sectors (ground handling, air traffic management, aircrew). The European Transport Workers’ Federation represents 5 million transport workers including approximately 370,000 aviation workers around Europe. While ETF understands the need to act swiftly on this initiative to help the aviation sector and contribute to its recovery, the ETF strongly opposes that no full impact assessment be done. While it is clear that the current situation requires urgent actions by the Commission, an assessment of consequences looking into social and employment aspects of possible amendments and revisions to the Regulation is absolutely necessary.

Response to Sustainable and Smart Mobility Strategy

The ETF welcomes the long-awaited roadmap to the Smart and Sustainable Mobility Strategy. However, we would like to begin this feedback with the call to revise the planned publication time of the Strategy. As already stressed in the letter sent to Commissioner Valean on 22 July, and co-signed by CLECAT, EBU, EMPA, ESPO ETF, FEPORT and INE, we request an extension to the deadline for the public consultation till the end of October and a consequent postponement of the Strategy. Transport is clearly a backbone of the European project, and the COVID-19 pandemic has shown how critical it is to ensure a proper functioning of the sector. At the same time, the necessity to make the transport greener remains as urgent as ever. We therefore believe that more time is needed for properly running the consultation, in a way that a thorough evaluation of the consequences of the COVID-19 crisis can be taken carried out by stakeholders as well as by EU member states. It is also crucial to remember that the EU transport industry is a workplace for 10 million people. The recent pandemic has highlighted their role as key workers, yet they are completely overlooked in the roadmap, apart from some general statements. In a situation where labour abuses, bad working conditions and social dumping are a sad reality in the sector, this omission is unfathomable. Admittedly, the roadmap mentions as a separate point the need to ensure a just transition, but the remainder of the sentence suggests a focus on the transport users. In contrast, it is necessary to apply the employment considerations throughout the strategy, and not only as an afterthought. Hence, please find in the attached document our remarks and suggestions that will bring forward a more socially sustainable transport in Europe.

The fact that the one year period starts counting on the same day that the Commission gives the organisers the go ahead, does not allow for a proper preparation stage for a structured launch of the ECI. A buffer period of, say, maximum two months should be given before the actual start. It should not be expected that the prepare the whole process without knowing whether or not the Commission will accept to register the ECI. Also in some countries the requirements for identification of the signatories to the petition are seen as too personal data to be provided to "an unknown" entity and some less "invasive" form of identification should be thought. It is common that concerns are raised about the possible abusive use of the data collected. The EU should consider having some form of simple publicity of the ongoing ECIs in key national media: TV, radio spots of a few seconds with the web addresses for more information would be justified.
